WHEREAS, Commissioner Alvin Burke, who passed away on August 4, 2021, was elected to the City of Opa-Locka City Commission in 2018; and WHEREAS, to recognize Commissioner Burke's contributions to the community, the City of Opa-Locka ("City") desires to designate Curtiss Drive (from Sultan Avenue to Harem Avenue) as "Commissioner Alvin Burke Drive"; and WHEREAS, Commissioner Alvin Burke dedicated his life to the City of Opa- Locka where he served as the President of the Opa-Locka Booster Club, led food and toy drives for the community, and served as a faithful City Commissioner; and WHEREAS, the City of Opa-Locka finds that it in the best interest of the City to honor Commissioner Alvin Burke by designating Curtiss Drive as Commissioner Alvin Burke Drive. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, AS FOLLOWS: SECTION 1. RECITALS The recitals to the preamble herein are incorporated by reference. SECTION 2. ADOPTION The City Commission of the City of Opa-Locka hereby approves the designation of Curtiss Drive from Sultan Avenue to Harem Avenue as "Commissioner Alvin Burke Drive. SECTION 3. INSTRUCTIONS TO CITY CLERK The City Clerk is directed to transmit a copy of this Ordinance to Miami -Dade County Mayor and to the Miami -Dade County Board of County Commissioners for consideration. Ordinance No. 2021-17 SECTION 4. SCRIVENOR'S ERRORS Sections of this Ordinance may be renumbered or re -lettered and corrections of typographical errors which do not affect the intent may be authorized by the City Manager following review by the City Attorney and without the need of a public hearing, by filing a corrected copy of same with the City Clerk. SECTION 5. SEVERABILITY If any clause, section, or other part or application of this Ordinance is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or application of this Ordinance. SECTION 6. CONFLICT All ordinances or resolutions or parts of ordinances or resolutions in conflict herewith, are hereby repealed. SECTION 7. CODIFICATION This Ordinance shall be codified in the Code of Ordinances when the code is recodified. SECTION 8. LIBERAL CONSTRUCTION The terms and provisions of this Ordinance shall be liberally construed to affect the purpose for which it is adopted. SECTION 9. EFFECTIVE DATE This Ordinance shall take effect upon the adoption of this Ordinance by the Commission of the City of Opa-Locka and upon a filing of a certified copy hereof with the Florida Department of State, if necessary, and is subject to the approval of the Governor or Governor's Designee. Joanna Flores, CMC City Clerk City of 0pa40cka 1 SUNDAY NOVEMBER 2a 2021 CITY OF OPA-LOCKA NOTICE OF OPA-LOCKA CITY COMMISSION VACANCY The City of Opa-locka (the "City") is seeking to fill a vacancy in the City Commission resulting from the resignation of Mayor Matthew A. Pigatt on November 10, 2021. At the November 17, 2021 Special Commission Meeting, the City Commission directed the City Clerk to issue a Notice of City Commission Vacancy to provide an opportunity for all interested individuals to apply for consideration. Pursuant to City Charter Section 2.7(c), the City Commission has 30 calendar days following the occurrence of the vacancy to fill the vacant City Commission position. In accordance with City Charter Section 5.1, each applicant shall be a qualified elector of the City residing in the City for more than 365 days prior to the date of application. The individual appointed to the City Commission will serve until November 2022.
