ORDINANCE NO.19 9 s AN ORDINANCE ALLOWING A BUILDING SETBACK VARIANCE FOR THE PROPERTY LOCATED AT 59 DIVISION STREET IN THE VILLAGE OF PLAINFIELD, WILL COUNTY, ILLINOIS r WHEREAS, PerryCo. has requested a building setback variance from the requirements of thirty (30) feet to approximately eleven (11) feet; and WHEREAS, the Zoning Ordinance sets forth the current side yard variance of this building is approximately (20) feet WHEREAS, the Zoning Board of Appeals have made the following findings based upon the evidence presented to it: A. The variance is in harmony with the general purpose and intent of this chapter. B. Strict enforcement of the chapter would result in practical difficulties or impose exceptional hardships due to special and unusual conditions which are not generally found on other properties in the same zoning district. C. The property cannot yield a reasonable use if permitted only under the conditions allowed by this chapter. D. The variance, if granted, will not alter the essential character of the neighborhood and will not be a substantial detriment to adjacent property. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, AS FOLLOWS: Section 1.The President and Board of Trustees of the Village of Plainfield hereby adapt the findings of the Zoning Board of Appeals as its own and that the petition requesting a variance for a building setback as requested by PerryCo. as to the real estate hereinafter described be granted. Territory Described. SEE EXHIBIT "A" WHICH IS ATTACHED HERETO AND MADE A PART HEREOF ,. Section 2. There is hereby granl:ed a building side yard setback variance from the requirements of thirty (30) feet to eleven (11) feet to allow a vestibule at 59 Division Street.
