HomeMy Public PortalAboutOrdinance 2033- ~ T ORDINANCE NO. 2 0 3 3 AN ORDINANCE ALLOWING INTERIOR SIDE YARD SETBACK VARIANCE FOR THE PROPERTY LOCATED AT THE NORTHWEST CORNER OF 1347 N. DIVISION STREET IN THE VILLAGE OF PLAINFIELD, WILL COUNTY, ILLINOIS WHEREAS, The Animal Care Center has requested an interior side yard setback variance from the 15 ft interior yard setback that is required in the B-4 District; and WHEREAS, the Zoning Board of Appeals have made the following findings based upon the evidence presented to it: A. The variance is in harmony with the general purpose and intent of this chapter. B. Strict enforcement of the chapter would result in practical difficulties or impose exceptional hardships due to special and unusual conditions which are not generally found on other properties in the same zoning district. C. The property cannot yield a reasonable use if permitted only under the conditions allowed by this chapter. D. The variance, if granted, will not alter the essential character of the neighborhood and will not be a substantial detriment to adjacent property. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, AS FOLLOWS: Section 1.The President and Board of Trustees of the Village of Plainfield hereby adopt the findings of the Zoning Board of Appeals as its own and that the petition requesting a variance for an interior side yard setback from the 15 ft interior yard setback that is required in the B-4 District as to the real estate hereinafter described be granted to 4.5 feet on the southeast side. THE SOUTH 260 FEET OF THE NORTH 1612 FEET OF THAT PART OF THE NORTHWEST QUARTER OF SECTION 10, LYING WEST OF THE CENTERLINE OF THE DUPAGE RIVER, ALL IN TOWNSHIP 36 NORTH, RANGE 9, EAST OF THE THIRD PRINCIPAL MERIDIAN, IN WILL COUNTY, ILLINOIS, COMMONLY KNOWN AS 1347 N. DIVISION STREET, PLAINFIELD, ILLINOIS. ~ ` ' Y.. ~ i Section 2.There is hereby granted a variance for interior side yard setback from the 15 ft interior yard setback that is required in the B-4 District to 4.5 feet on the Southeast side.
