This is a formal request for records pursuant to the Public Records Act, Florida Statutes,
Chapter 119.01, et seq.
This firm represents FD Destiny, LLC in the above -captioned matter. Pursuant to the
Public Records Act, we request that your office provide us with a copies of the following
documents:
1. All documents relating to the fire that occurred at 3145 N. Ocean Boulevard, Gulfstream,
FL 33483-7369 on or about October 29, 2018 including police reports, inspection
reports, fire marshal' report, insurance reports, dispatch log, dispatch notes, notes,
witness statements, transcripts, videos, photographs, etc.
2. All documents relating to any correspondence (including text messages and emails) with
City Departments, Insurance Companies, Fire Department, EMTs, Emergency Services,
etc. regarding the fire that occurred at 3145 N. Ocean Boulevard, Gulfstream, FL
33483-7369 on or about October 29, 2018.
3. All documents relating to any correspondence (including text messages and emails) with
the owners of the property, Anthony V. Pugliese, III and/or Laura K. Pugliese regarding
the fire that occurred at 3145 N. Ocean Boulevard, Gulfstream, FL 33483-7369 on or
about October 29, 2018.

If this request for records is denied either in part or in whole, please advise us in writing,
as required by section 119.07(2)(a) of the basis for your contention that the record or part of it is
exempt from public inspection. In addition, we request that your written statement explain with
particularity the reasons for your conclusion that the record is exempt. If the exemption you
assert applies to only a portion of the records, we request that you delete the portion you claim is
exempt and provide us with photocopies or electronic documents of the remainder as required by
section 119.07(2)(a).
We will be happy to reimburse your office any fees for duplication and/or certification of
the copies that you are authorized by section 119.07(1)(a) to charge. Please advise if there is a
charge for searching and copying these records and if the total cost, including copying, will
exceed $100.00 prior to providing us with the copies. If possible, we request electronic copies of
the documents. Unfortunately, we are under a deadline and would greatly appreciate it if this
request could be expedited as soon as possible.

After speaking with your paralegal, Diane Nixon, on May 14, 2019, I informed her that the
Town of Gulf Stream uses Delray Beach for fire and EMS services. She replied that you had
sent the same request to Delray and would wait for a reply from them directly, not needing us to
reach out to them, but you would still need anything the Town has in its custody regarding the
above request.
We have provided everything the Town has regarding the above request. We consider this
request closed.

INCIDENT SUMMARY
ON 10/29/2018, AT APPROXIMATELY 1753 HRS. ALL GULF STREAM POLICE UNITS WERE DISPATCHED TO A
RESIDENTIAL FIRE WITH FLAMES SHOWING THROUGH THE ROOF AT 3145 N. OCEAN BLVD. UPON ARRIVAL,
ENTRY TO THE PROPERTY WAS MADE VIA THE SERVICE ENTRANCE USING GATE CODES TO OPEN GATE. FIRE
WAS VISIBLE IN THE THREE CAR GARAGE AREA AND SPREADING FAST TO THE SECOND STORY ART LOFT.
SGT. PASSEGGIATA REQUESTED DISPATCH TO NOTIFY OCEAN RIDGE POLICE TO SHUT DOWN SOUTH BOUND
TRAFFIC FROM WOOLBRIGHT. DISPATCH OFFERED DELRAY POLICE UNITS TO ASSIST WITH TRAFFIC,
OFFICER FAHEY ALONG WITH THE DELRAY UNITS CONTROLLED TRAFFIC FLOW AND DETORED TRAFFIC
THROUGH GULFSTREAM RD. SGT. PASSEGGIATA AND I MADE ATTEMPTS TO CLEAR THE HOME AND
EVACUATE ANYONE IF NECESSARY BUT IT WAS DETERMINED NO ONE WAS HOME OR ON THE PROPERTY.
DBFD WAS UPDATED REPEATEDLY AS TO THE CONDITION OF THE FIRE AND RESIDENCE PRIOR TO THEIR

ARRIVAL. ALL GATES TO THE PROPERTY WERE SUBSEQUENTLY OPENED TO ALLOW DELRAY BEACH AND
PALM BEACH COUNTY FIRE FULL ACCESS TO THE PROPERTY. THEIR RUN NUMBERS WERE DB18013258 AND
PBCTY 18113562. DISTRICT CHIEF AMELUNG WAS ON SCENE FROM PALM BEACH COUNTY FIRE AND CHIEF
SCHAINUCK WAS ON SCENE FROM DELRAY BEACH FIRE. THE HOMEOWNER/VICTIM WAS NOTIFIED AND
SUBSEQUENTLY RESPONDED TO HIS RESIDENCE. SEVERAL OF HIS EMPLOYEES THAT WORK AT HIS
PROPERTY WERE ALSO SUMMONED TO THE SCENE TO ASSIST FD WITH THEIR KNOWLEDGE OF THIS LARGE
PROPERTY. SGT. PASSEGGIATA NOTIFIED CHIEF ALLEN. CHIEF ALLEN ARRIVED A SHORT TIME LATER ALONG
WITH LT. HASELEY AND TOOK COMMAND OF ALL POLICE OPERATIONS. GULF STREAM UNITS MAINTAINED
SECURITY AND TRAFFIC CONTROL POSTS UNTIL THE FIRE DEPARTMENTS CLEARED THE SCENE. AFTER THE
FIRE DEPARTMENT CLEARED, TWO GULF STREAM POLICE UNITS WERE ASSIGNED TO THE PROPERTY/CRIME
SCENE FOR THE REMAINDER OF THE NIGHT. THE FIRE MARSHALL ALSO RESPONDED DURING THE FIRE
EVENT AND RETURNED THE NEXT MORNING TO CONCLUDE HIS INVESTIGATION.
