ADOPTED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD THIS 15TH DAY OF OCTOBER, 2001 PUBLISHED IN PAMPHLET FORM BY THE AUTHORITY OF THE PRESEINT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, WILL COUNTY, ILLINOIS, THIS 24RTH DAY OF OCTOBER, 200I . ~~ ORDINANCE NO. 2062 AN ORDINANCE ESTABLISHING THE RECAPTURE COST OF CERTAIN PUBLIC IMPROVEMENTS FOR ALAN DALE DEVELOPMENT, INC. WHEREAS, on July 7th, 1997, the Village of Plainfield , an Illinois municipal corporation, hereinafter referred to as "Village" and Alan Dale Development, Inc. and Phyllis Jordan as Trustee entered into a certain Annexation Agreement recorded as Document #R 9707$936, for property located on the north side of 135th Street directly to the west of Walker's Grove Subdivision; and WHEREAS, said Annexation Agreement provided that the Village would assist Alan Dale Development, Inc. in recapturing the cost of certain public improvements which provided a benefit to certain property along the south side of 135 h Street; and WHEREAS, that said improvements have been completed and said costs have been certified and approved by the Village's Engineering Consultant; and WHEREAS, Chapter 65 of the Illinois Compiled Statutes, Section 5/9-5-1 through 5/9-5-3 provides that where public improvements in the opinion of the corporate authorities may be used far the benefit of property, not in the subdivision or Planned Unit Development far which a building permit has been issued may be reimbursed to the developer constructing same; and WHEREAS, said improvements constructed by Alan Dale Development, Inc. provide valuable improvements for the benefit of the property described in Section 3 herein. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, WILL COUNTY, ILLINOIS AS FOLLOWS: Section 1. That the above preamble is hereby adopted as findings of fact as of fully set out herein. Section 2. That there is hereby imposed on the property described below a reimbursement sum of $219,356.70 to be paid as reimbursement for the below described public improvements at the simple interest rate of 4% per annum: Water mains $ 90,731.75 Sewer mains $ 6,208.95 135th Street Improvements 122 416.00 Total Improvements $219,356.70 y Section 3. Legal Description of Benefitting Property: THE NORTHWEST QUARTER OF SECTION 5, IN TOWNSHIP 36 NORTH, AND IN RANGE 9, EAST OF THE THIRD PRINCIPAL MERIDIAN, IN WILL COUNTY, ILLINOIS. This Ordinance shall be in full force and effect from and after its passage, approval., and publication as required by law. The recommended expenses were based on information taken from correspondence received by our office. The developer reviewed and contacted this office with differences. We have reviewed the developer's comments and agree that a revision to our letter of September 19, 2001 is required. A summary of our revised recommendation is as follows: Item 1. 100% Cost of Off-Site Watermains Total Cast: $ 69,586.00 100% $ 69,586.00 Item 2. 50% Cost of Off-Site Sanitary Sewer Total Cost: $ 12,41'7.90 50% $ 6,208.95 Item 3. 50% Cost of On-Site Waterrnain Total Cost: $ 42,291.50 SO% $ 21,145."15 Item 4. 50°10 Cost of 135th Street Improvements Total Cost: $244,832.00 SO% $ 122,416.00 Village of Plainfield Project No. 69384 September 28, 2001 Page 2 Item 5. & 6. Addition of the cost of a watermain casing pipe and engineering costs. Item 2. Revised costs incurred by the developer and engineering costs. Item 3: Revised costs incurred by the developer. Alan Dale installed and paid for said. improvements, and those improvements have benefit to properties other than Nature's Crossing. All costs have been certified by the Village's Consulting Engineer per the attached letter, and the total amount of the recapturable expenses is $219,356.'10. These costs will be paid by the property on the south side of 13Sth Street when it annexes to the Village. The Ordinance, if passed, will be recorded against the property so that any potential developer will be made aware of the recapture obligation. Recapture of costs in this mariner is allowed under State Statutes, and the Village agreed to the recapture in the Annexation Agreement for the Nature's Crossing Subdivision. Staff s recommendation is for a motion to adopt the recapture ordinance.
