HomeMy Public PortalAbout2012-07-31 Special MeetingBAL HARBOUR VILLAGE COUNCIL MEETING MINUTES SPECIAL MEETING - JULY 31, 2012 A Special Meeting of the Bal Harbour Village Council was held on Tuesday, July 3.1, 2012, at the Bal Harbour Village Hall Council Chambers (655 — 96t Street, Bal Harbour, Florida). 1. CALL TO ORDER/ROLL CALL: The meeting was called to order at 6:32 p.m. by Mayor Rosenfield. The following were present: Mayor Jean Rosenfield Assistant Mayor Joni D. Blachar Councilwoman Patricia Cohen Councilman Martin Packer Alfred J. Treppeda, Village Manager Ellisa L. Horvath, MMC, Village Clerk Matthew Pearl, Village Attorney Absent: Councilman Jaime M. Sanz As a quorum was determined to be present, the meeting commenced. 2. PLEDGE OF ALLEGIANCE: The Pledge was led by Jay Smith, Director of Human Resources and Community Outreach. 3. RESOLUTION: The following Resolution was read by title by Mrs. Horvath: A RESOLUTION OF BAL HARBOUR VILLAGE, FLORIDA, RELATING TO THE PROVISION OF SECURITY AND LANDSCAPE SERVICES, FACILITIES AND PROGRAMS IN THE GATED RESIDENTIAL SECTION OF BAL HARBOUR VILLAGE, FLORIDA; DESCRIBING THE METHOD OF ASSESSING SECURITY AND LANDSCAPE COSTS AGAINST ASSESSED PROPERTY LOCATED WITHIN THE GATED RESIDENTIAL SECTION OF BAL HARBOUR, FLORIDA; DETERMINING THE COST OF SECURITY AND LANDSCAPE SERVICES, FACILITIES AND PROGRAMS AND THE INITIAL SECURITY AND LANDSCAPE ASSESSMENTS; DIRECTING THE PREPARATION OF AN ASSESSMENT ROLL; AUTHORIZING A PUBLIC HEARING AND DIRECTING THE PROVISION OF NOTICE THEREOF; AND PROVIDING AN EFFECTIVE DATE. Mayor Rosenfield opened the meeting to public discussion. Dina Cellini, 211 Hai Crass Drive, addressed the Council. Mr. Pearl explained that the public hearing for the Final Assessment Resolution was scheduled for September 131h. Ms. Cellini voiced concem that approval of the Resolution would lock the Village into the formula. She voiced specific concern regarding the formula for the assessment for the Yacht Basin. She clarified that there could potentially be multiple people living on boats in the marina in the future. She requested that the assessment formula be re -considered to reflect the number of people living in the marina on their boats. Ms. Cellini suggested that the definifion of the private recreational facility, assessment properly or dwelling unit, etc. be expanded to give the Village the chance to change the formula in the future if necessary. She questioned what a formula change would require. Mr. Pearl explained that the Resolution would not lock the Village into anything and changes could be made in the future. Assistant Mayor Blachar clarified that there wouldn't be a problem with changing it in the future. Mr. Pearl agreed. Mr. Treppeda reported that the RAC (Gated Residential Section Advisory Committee) discussed the assessment formula at several meetings and agreed to the formula presented. Mayor Rosenfield questioned if people living on the boats needed to meet the same rental requirements. Mr. Treppeda was not aware of anyone living on the boats and clarified that the marina was only for docking purposes. Councilwoman Cohen questioned how it would be determined if someone lived on their boat or not. Councilman Packer discussed concems with short term rentals for boats and if that would be covered under the Village ordinance. Mr. Treppeda reported that the marina did not have hookups to sewage etc. and that people were not supposed to be living on them. Mayor Rosenfield noted that a code enforcement officer would have to determine if someone was living on a boat. Mr. Treppeda was not aware of anyone reporting a problem with that. Assistant Mayor Blachar was under the impression that nobody lived on the boats. Ms. Cellini had not seen anyone living on the boats, but was told that by somebody else. She wanted to make sure that the Village was covered, if the Owner decided to make improvements to the marina in the future by adding sewage hookups, etc. There being no additional comments, Mayor Rosenfield closed the public discussion. A motion was offered by Councilman Packer and seconded by Assistant Mayor Blachar to approve the Resolution. The motion carried (4-0): thus becomin, Resolution No. 2012-759. 4. ADJOURN: There being no further business, a motion was offered by Assistant Mayor Blachar and seconded by Councilwoman Cohen to adjourn.
