HILLSBOROUGH TOWN BOARD
June 11, 2001

The Hillsborough Town Board held a regular meeting on June 11, 2001 at 7:30 PM in the
Hillsborough Town Barn. Present for the Board Meeting were Mayor Horace H. Johnson, Sr.,
and Commissioners Frances Dancy, Evelyn Lloyd, Kenneth Cbavious, Mark Sheridan, and Brian
Lowen. Present were Town Manager Eric Peterson, Town Clerk Donna Armbrister, Finance
Director Sherry Carter, Planning Director Margaret Hauth, Town Engineer Kenny Keel,
Management Intern Jim Klingler, Public Works Director/Assistant Town Manager Demetric
Potts, Police Captain Chip Liner, Police Sergeant Joseph Holloway, and Town Attorney Bob
Hornik.
Mayor Horace H. Johnson, Sr. calIed the meeting to order at 7:30 PM.

Mayor Johnson read the Public Charge.

4. PROCLAMA TIONS/RESOLUTIONS
A. Presentation of Town Board Thanks Certificates to Police Chief Nathaniel Eubanks and
Sergeant Joseph Holloway
Mayor Johnson read and presented the Town Board Thanks Certificates for Police Chief Nathaniel
Eubanks and Sergeant Joseph Holloway. Sergeant Joseph Holloway accepted the Certificates on behalf
of both law enforcement officials since Police Chief Eubanks could not be present.
5. APPROVAL OF THE MINUTES OF THE MAY 14TH, 2001 REGULAR BOARD MEETING
AND CLOSED SESSION, AND THE MAY 21ST, 24TH, AND 29TH BUDGET WORK
SESSIONS

Upon a motion by Commissioner Dancy, seconded by Commissioner Lowen, the Board moved to
approve the Minutes of the May 14th, 2001 Regular Board Meeting and Closed Session, and the May
21st, 24th, and 29th Budget Work Sessions as presented by a vote of 5-0. The motion was declared
passed.

7. REPORT FROM THE TOWN ENGINEER
Town Engineer Kenny Keel presented a status report on all current Water and Sewer projects.
8. REPORTS AND PRESENT A TIONS
A. Presentation ofG.F.O.A. Distinguished Budget Presentation Award to the Town of
Hillsborough
Mayor Johnson presented the Government Finance Officers Association Award to Town Manager Eric
Peterson.
B. The Chairpersons of the annual Hillsborough/Orange County Chamber of Commerce Hog Day
will discuss the June 15th and 16th Hog Day Events
Jim Dooley, Chairman of the Hog Day Committee and Craig Lloyd from the Hillsborough/Orange
County Chamber of Commerce appeared before the Board to thank them for their support of the Hog
Day annual event.
. 9. ITEMS FOR DECISION - CONSENT AGENDA
A. Consider Approval of Ordinance to Amend Chapter 13 (Cemeteries) of the Town Code
B. Consider approving Inter-local Agreement with Orange County for the Town to continue
receiving Fire Inspection Services in FYOI-02
Upon a motion by Commissioner Dancy, seconded by Commissioner Lowen, the Board moved to
approve Items A and B of the Consent Agenda as presented by a vote of5-0. A copy of the Ordinance
to amend Chapter 13 of the Town Code is hereby made a part of these official Minutes as an
Attachment.
10. ITEMS FOR DECISION - REGULAR AGENDA
A. Consider Adoption of the FY2001-2002 Budget Ordinance
Town Manager Eric Peterson there was an omission in Section 10 of the Budget Ordinance ofa
Hydrant Meter Deposit of$800.
Mayor Johnson polled each of the Board Members regarding their position on the proposed tax rate
increase and proposed water rate increase and structure change.

After some discussion and upon a motion by Commissioner Dancy, seconded by Commissioner Lloyd,
the Board moved to adopt a 60-cent tax rate increase by a vote of 3-2 with Commissioners Dancy,
Lloyd and Lowen voting Aye, and Commissioners Chavious and Sheridan voting Nay. The motion

was declared passed.
. Upon a motion by Commissioner Lloyd, seconded by Commissioner Chavious, the Board moved to
leave the Water Rate Structure the same (out-of-town rate is double) and adopt a 13% increase for both
in-town and out-of-town customers by a vote of 4-1 with Commissioners Lloyd, Chavious, Dancy, and
Lowen voting Aye, and Commissioner Sheridan voting Nay. The motion was declared passed.
Upon a motion by Commissioner Dancy, seconded by Commissioner Lloyd, the Board moved to adopt
the Budget Ordinance with the aforementioned amendments by a vote of 4-1 with Commissioners
Dancy, Lloyd, Chavious, and Lowen voting Aye, and Commissioner Sheridan voting Nay. The motion
was declared passed. A copy of the Budget Ordinance is hereby made a part of these official Minutes
as an Attachment.
B. Presentation on Request for Annexation for approximately 340 Acres near the Intersection ofI-
40 and Old NC 86
Jack Smyre appeared before the Board and presented an Annexation request for 344 Acres in the
northeast quadrant of South Churton Street (old 86) and the 1-40 Interchange. This assemblage is
proposed to be a mixed-use development providing commercial, residential, office and civic uses.

Upon a motion by Commissioner Chavious, seconded by Commissioner Lloyd, the Board moved to
direct the Town Manager to proceed with an Annexation Feasibility Study at the expense ofthe
developer by a vote of 5-0. The motion was declared passed.
Dani Black, citizen, addressed the Board and requested they consider alIowing this development as
opposed to the Hampton Pointe Development because of the mixed uses.
C. Consideration of an Amendment to Section 6A of the Town Code to instalI a stop sign, north
and south bound, on Hayes Street where it intersects with Latimer Street (3-way stop)
By consensus of the Board, this Item was deferred until the July Board Meeting.
D. Consideration of subdivision to create one new lot on a private street off Latimer Street
Planning Director Margaret Hauth presented the preliminary plan for the Felts subdivision. She
explained that since the plan shows a private road (rather than public), a full subdivision review is
required. The Planning Board reviewed this plan at their June meeting. They unanimously
recommended approval of the plan with the condition that the owners maintain a 12' wide cleared
right-of-way along the private road to facilitate emergency vehicles.
Upon a motion by Commissioner Lowen, seconded by Commissioner Lloyd, the Board moved to
approve the Felts subdivision to create one new lot on a private street off Latimer Street with the
condition that the owners maintain a 12' wide cleared right-of-way along the private road to facilitate
emergency vehicles by a vote of 5-0. The motion was declared passed.

E. Consideration of an Ordinance to rezone 58 ac at NC 86/1-85 from Limited Office to
Entranceway Special Use (Tax Map 4.45..4c)
F. Consideration of Master Plan/Special Use Permit for Hampton Pointe project (Tax Map
4.45..4c)
Planning Director Margaret Hauth presented Items E. and F to be considered together. Hauth reported
that the Planning Board had discussed the plans at both their February and March meetings. The issues
they discussed related to the scale of the buildings, intensity of the use on the site, employment
opportunities, shopping opportunities, need to protect historic area on site, walkability, the surrounding
road network, and stormwater/impervious surface. The Planning Board voted to recommend approval
of the rezoning request based on a 7-1 vote. The Planning Board's motion to recommend approval of
the special use permit/master plan received a 4-4 vote.
Developers Bill Anderson and Jerry Dickens presented changes and additions to the Hampton Pointe
Development plans for the Board's consideration and fielded questions from the Board.
Marianne Rislay, citizen, addressed the Board and stated that she would like to know what the use
capacity ofHwy 86 is.
Amy Newton, citizen, addressed the Board and expressed her support of the Hampton Pointe
Development.
Michael Gering, citizen, addressed the Board and expressed his concerns with the scale and character
of the proposed development.
Rachael Royce, citizen, addressed the Board and spoke in opposition of the Hampton Pointe
Development.
ADDED ITEM: Letter from Citizen
Mayor Johnson read a letter he had received from Marie Doklovic, citizen, which expressed her
support of the Hampton Pointe Development and expressed her wishes of what type of retail would go
m.
After much discussion, and by consensus, the Board moved to defer further discussion on this Item
until the June 25th Work Session. Commissioner Lloyd asked Plarining Director Hauth to invite the
Orange County members of the Economic District Development Workgroup to attend.
G. Consider accepting utilities for Phase 2A ofChurton Grove
Town Engineer Kenny Keel presented this Item for the Board's consideration. Engineer Keel stated
that he has inspected the water and sewer facilities that were instaIled to serve Phase 2A of the Churton
Grove Subdivision and is satisfied with the quality and workmanship of the facilities. The facilities
meet or exceed the Town Specifications, and all Phase 2 fees have been paid (including the perpetual
maintenance fee for the pump station). Engineer Keel recommended that the Board accept the water
and sewer utilities serving Phase 2A of Churton Grove Subdivision and explained that acceptance will
transfer ownership ofthe facilities to the Town and initiate the one-year warranty period.

Upon a motion by Commissioner Lowen, seconded by Commissioner Lloyd, the Board moved to
accept the utilities for Phase 2A of Churton Grove by a vote of 5-0. The motion was declared passed.
H. Consideration of Amendment #2 to the Engineering Contract with W.K. Dickson on the Water
Plant Upgrade
Town Engineer Kenny Keel presented the Contract Amendment for the Board's consideration. Keel
explained that the Contract Amendment covers some additional work that the NC Division of
Environmental Health-Public Water Supply section required as a condition of approval of the Water
Plant upgrade plans. W. K. Dickson has completed this work, and the plans have been approved for
construction. Some funds are also included for electrical work that was inadvertently left off
Amendment No. 1 which has also been completed.
Upon a motion by Commissioner Lloyd, seconded by Commissioner Sheridan, the Board moved to
approve Amendment #2 to the Engineering Contract with W.K. Dickson on the Water Plant Upgrade
by a vote of 5-0. The motion was declared passed.
1. Consideration of Tourism Board Grant Applications with requests exceeding $5,000:
1. Historic Hillsborough Commission (Burwell School Historic Site)
2. Orange County Historical Museum
3. Alliance for Historic Hillsborough (2000-01 Media Plan)
Commissioner Sheridan reviewed the three Tourism Board Grant Applications for the Board's
consideration.
Upon a motion by Commissioner Dancy, seconded by Commissioner Lloyd, the Board moved to
approve the Tourism Board Grant Applications from:
1. Historic Hillsborough Commission (Burwell School Historic Site) in the amount of
$20,000
2. Orange County Historical Museum in the amount of$22,500
3. Alliance for Historic Hillsborough (2000-01 Media Plan) in the amount of$12,000
by a vote of 5-0. The motion was declared passed.
J. Discuss what the ''HOT TOPIC" will be for the June 25th Work Session
By consensus, the Board agreed to discuss the Hampton Pointe Development.
11. APPOINTMENTS
A. Appointment of Cathleen Turner to serve on the Hillsborough Tree Board
Upon a motion by Commissioner Lloyd, seconded by Commissioner Sheridan, the Board moved to
appoint Cathleen Turner to serve on the Hillsborough Tree Board by a vote of 5-0. The motion was
declared passed.

B. Recommendation to Orange County for Brian Ketchum to serve a 2nd term as Hillsborough's
representative on the Solid Waste Advisory Board
Upon a motion by Commissioner Lloyd, seconded by Commissioner Lowen, the Board moved to
recommend to Orange County to have Brian Ketchum to serve a 2nd term as Hillsborough's
representative on the Solid Waste Advisory Board by a vote of 5-0. The motion was declared passed.
12. ADJOURN
Upon a motion by Commissioner Dancy, seconded by Commissioner Lowen, the Board moved to
adjourn at 11 :00 PM by a vote of 5-0. The motion was declared passed.

Article I
DEFINITIONS: APPLICATION
Section 13-1 Definitions
Unless the context otherwise indicates, the following
words shall have the meaning indicated when used in this
Chapter.
(I) Administrator. The person designated by the
Board to perfonn the functions and exercise the
responsibilities assigned by this Chapter to the
adm inistrator.
(2) Lot A plot of ground within the Town
cemetery consisting of two or more burial
spaces, as shown on the official cemetery map.
(3) Marker. A plaque installed at ground level at
the site of a grave to indicate the name, date of
birth, and date of death of the person buried
there.
(4) Mausoleum. A structure or building
substantially exposed above ground intended to
be used for the entombment of remains of a
deceased person.
(5) Monument A memorial stone or other
structure erected at a grave site in remembrance
of the deceased.
Section 13-2 Application of Provisions
The following Sections apply to all cemeteries
within the Town: Sections B-3, 13-4, 13-5 and 13-6.
The remaining Sections of .this Chapter apply only to
cemeteries owned or operated by the Town.
Article II
GENERAL REGULATIONS

Section 13-3 Burial Onlv in Cemeteries
No person may bury or cause to be buried the body
of any deceased person within the Town limits in any
place other than a church cemetery or a cemetery
operated by a governmental entity or a private cemetery
licensed or specifically exempted from licensing
according to the North Carolina Cemetery Act (Article 9
ofG.S. Chapter 65).
Section 13-4 Disruptive Activity Prohibited
(a) No person may drive any motor vehicle of any
kind in any cemetery except upon the main
roads and avenues provided therein for
vehicular traffic. Excluded from this

prohibition are any types of equipment
necessary for grave preparation or monument
setting.
(b) No person may drive any motor vehicle or park
any motor vehicle in any cemetery unless in
attendance at burial services or otherwise
engaged in activities consistent with the use of a
cemetery as a cemetery.
(c) No person may take any dog (except when on a
leash), horse, or other animal into any cemetery
or allow any animal to run at large therein.
(d) No person may intentionally disrupt any funeraJ
services or disturb the quiet and good order of
any cemetery by exft-e~ely loud or boisterous
conduct. Except in the case of military funerals
and veterans or military commemorative
exercises, no person may carry or discharge
fireanns in any cemetery.
(e) No person may post or attach any bills, posters,
placards, pictures or other form of political or
commercial advertising within the cemetery or
on the inside or outside of any wall or fence
enclosing any cemetery. (AMENDED 05-09-

Sedion 13-5 Desecration or Public and Private
Cemeteries
As provided in G.S. 14-150.1, if any person shall
willfully commit any of the acts set forth in the following
subsections, he shall be guilty of a misdemeanor and
shall be fined not more than one hundred dollars ($100)
or imprisoned for not more than thirty days, or both, at
the discretion of the court.
(I) Throwing, placing,. or putting any refuse,
garbage, trash, or articles of similar nature in or
on a public or private cemetery where human
bodies are interred.
(2) Destroying, removing, breaking, damaging,
overturning, or polluting any flower, plant,
shrub, or ornament located in any public or
private cemetery where human bodies are
interred without the expressed consent of the
person in charge of said cemetery.
Provided nothing contained in this section shall
preclude operators of such cemeteries from exercising all
the powers reserved to them in their respective rules and
regulations relating to the care of such cemeteries.
Section 13-6 Removine: or Deracine: Monuments
and Tombstones
As provided in G.S. 14-140, if any person shall,
unlawfully and on purpose, remove from its place any
monument of marble, stone, brass, wood, or other
material, erected for the purpose of designating the spot
where any dead body is interred, or for the purpose of
preserving and perpetuating the memory, name, fame,
birth, age or death of any person, whether situated in or
out of the common burying ground., or shall unlawfully
and on purpose break or deface such monument, or alter
the letters, marks or inscription thereof, he shall be guilty
of a misdemeanor. Provided that nothing contained in
this section shall preclude operators of public or private
cemeteries from exercising all the powers reserved to
them in their respective rules and regulations relating to
the use and care of such cemeteries.
Section 13-7 Hours or Operation
(a) The Town cemetery shall remain open to the
public throughout the year from sunrise until
sunset.
(b) No person may enter the Town cemetery at any
time other than the hours of operation
established by subsection (a).

(b) No person may place on or around any grave
site a fence, border, picture, toy, handmade
ornament, or other self-described memoriam
between the first day of March and the last day
of October each year.
(c) The Street Sllperintendent Public Works
Director or his designee may enter any lot and
remove any tree, shrub, or other plant that
hinders the maintenance of any part of the
cemetery. This also applies to the items
referred to in subsection (b).
(d) The Street Sllperintendcnt Public Works

plants of any kind from the cemetery as soon as
they deteriorate or otherwise become unsightly.

Article III
DESIGNATION AND SALE OF
CEMETERY WTS AND SPACES
Section 13-13 Ril:!:hts of Owner of Certificate of
Burial Ril:!:ht
(a) The Certificate of Burial Right entitles the
owner thereof (i.e. the purchaser) to use the
designated spaces as a place of burial for any
person they choose (provided that Section 13-
14c is not violated) subject to the terms and
conditions of this ordinance and subject to the
Town's authority to operate, regulate, controL,
and abandon cemeteries.
(b) Upon the death of the owner of a Certificate of
Burial Right, all rights evidenced by such
certificate shall pass to the owner's heirs,
legatees, or devisees in the same manner as
other interests in personal property. In addition,
the Town will refund., without interest, any
sums paid for spaces that the owner of a
Certificate of Burial Right no longer wishes to
reserve, upon surrender of the Certificate of
Burial Right covering those spaces. In order to
receive the refund., the owner of a Certificate of
Burial Right must provide the Certificate for
surrender. (Deleted text to charge additional
fees for owners of Certificate of Burial Rights
to change the desighatipn of persons entitled to
be buried in"spaces covered by the certificate.)
Section 13-11 Cemetery Map Required
(a) There shall be maintained in the Town Clerk's
office an official c~n\etery map which shall
depict, as accurately as possible, the boundaries
of the Town cemetery and the location and
dimension of all lots and spaces within the
cemetery.
(b) Burial rights in all lots and spaces shall be sold
in reference to the official cemetery map.
Section 13-12 Purchase of Burial Ril:!:hts
(a) The Town shall sell burial rights in cemetery
lots and spaces in accordance with the
provisions of this Chapter and the schedule of
fees set forth in the Miscellaneous Fees and
Charges Schedule maintained in the office of
the Town Clerk.
(b) Differential fees shall be charged according to
whether the person intended to be buried in the
space with respect to which a burial right is
purchased is a Town resident or a Town tax
paying non-resident at the time such right is
purchased. The same fees shall apply whether
the burial plot shall be used for interment or
cremation.
(c) A Certificate of Burial Right shall be issued to
the person who purchases a burial right. The
certificate shall identitY the purchaser and the
specific lots or spaces to which the certificate
applies. There shall be no conveyance of title
to any grave space, but the right or privilege of
interment shall be sold as herein provided and
such right or privilege shall be evidenced by the
Certificate of Burial Right.
(d) For the purpose of selecting a specific lot or
space, the purchaser of a burial right may be

any burial right for the purpose of sale or
exchange.
(b) No person may sell or exchange any burial right
for a profit or gain.
(c) No Town resident or Town tax paying non-

burial right(s) at an in-town purchase rate for
the intended burial of an out-of-town (non

(a) No monument or marker shaJl be placed on any
site except under the supervision of and
according to the instructions of the Town Clerk,

or other designated representative of the Town.
(b) Grave space markers shall be composed of
either a marble or granite base and shall be a
maximum size of 52 inches by 18 inches
(double) and 28 inches by 16 inches (single).
No marker composed of a brick or concrete
base of border shall be permitted. All markers
in Zones 9, 10, II and 12 must be fIat markers
level with the surrounding ground.
(c) Monuments or markers which do not otherwise
satisfy the requirements of this section may be
allowed upon approvaJ by the Board of
Commissioners if the requested monument or
marker will not impair the use of adjoining
grave spaces and will not require a substantial
incr~ in future, maintenance and repair
needs.
Section 13-19 Installation. Repair or Removal of
Monuments
(a) Should any monument or marker in the Town's
cemetery at any time become unsafe, unsightly,
or in need of repair or resetting, the cemetery
administrator shall notify the owner of the
relevant Certificate of Burial Rights of such
condition and shall request such person to make
any needed repairs under the administrator's
supervision.
(b) Nothing in this section shall obligate the Town
to place, replace, or repair any monument or
marker in the Town's cemeteries.
(c) Exceptions handled on a case by case basis.

Article V
BURIALS
Section 13-21 Burial Procedure

(a) No grave may be opened and no burial may
take place in a Town cemetery except by a
licensed Funeral Director or his employees
under the supervision of the Town Clerk, Street
Sl-Jperiateadeat, or other designated
representative of the Town. The Town shall be
notified at least ten hours in advance of any
funeral for which a grave shall be opened.
Town staffwiU not be available to provide this
service on weekends.
(b) No grave may be opened and no burial may
take place in a Town cemetery until a grave
space for the burial has been marked by a
Town representadve. Marking of graves prior

the funeral, a grave space sinks below the level
of the surrounding ground, becomes eroded, or
has otherwise become unsightly due to the lack
of proper restoration or stabilization, the Town
shall so notify the responsible Funeral Director
who shall ensure that appropriate corrective

action is taken within ten days following such
notification.
(I) If the Funeral Director fails to correct the
problem within the period specified above
following notification from the Town, the
Town Manager shall notify the Funeral
Director in writing that the Funeral
Director's privilege of conducting burials
within any Town Cemetery is suspended
until the defective condition is remedied.
(2) No Funeral Director may conduct any
burial within any Town Cemetery after
receiving the notice specified in
Subsection (I)'until th~..Town Manager
has notified the Funeral Director in writing
that the. defective condition has been
remedied and the suspension is lifted.
(3) Any suspension imposed under this section
may be appealed to the Board of
Commissioners. An appeal is initiated by
filing a written notice of appeal with the
Town Manager. An appeal stays the
suspension pending the outcome of the
appeal.
AAy violation of Sect ion 13 2 I ( e) shall oonstitute 8fl

(d) No grave shall be opened to a depth ofless than
5 feet to the bottom thereof except in the cases
of cremations.
(e) All graves shall be level with the surrounding
areas and no mounds shall be allowed.
(f) The usage of each burial space shall be limited
to one of the following: (I) the interment of
one human body; (2) the interment of one
human body and one cremation urn; or (3) the
interment of no more than four cremation urns.

Section 13-22 Records of Persons Buried
Required
The Town Clerk shall keep as complete and accurate
records as possible of the name and burial plot of every
person buried in the Town Cemetery.
Section 13-23 Disinterment Procedure
(PROPOSED AMENDMENT 06-
11-2001)
(a) No disinterment may take place in a town
cemetery except by a licensed Funeral Director
or his employees pursuant to a valid and un-
revoked permit for disinterment/re-interment
issued by the Orange County Health
Department under the supervision of the Town
Clerk, Street Sl:Iperintendent, or other
designated representative of the Town. The
Town shall be notified at leastten (10) hours in
advance of any disinterment.
(b) Marking of graves prior to opening for
disinterment shall be accomplished according
to the specifications and in the presence of the
Town Clerk, Street Sl:Iperintendent, or other
designated Town representative. Town stIIll
w/ll not be available to provide this service on
weekends.
(c) All disinterred graves shall be restored to a
condition level with surrounding areas.

(a) A violation of any of the following provisions

(b) A violation of Section 13-4 (a) and (b) shall
constitute ftR infraetion a misde~anor,

of fifty dollars ($50).
(c) Violations of any of the Sections listed in
subsections (a) and (b) shall also subject the
offender to a civil penalty of twenty-five
dollars ($25). Ifa person fails to pay this
