STAFF REPORT 'i PLANNING COMMISSION MEETING: October 21, 2014 \\ � CITY COUNCIL MEETING: November 13,2014 LOCATION: 21 Pulaski St. PINS: 4-0001-02-016 &4-0001-02-017 APPLICANT: Tony Petrea OWNERS: Tony Petrea &Daley Brown EXISTING USE: 2 lots with historic battery PROPOSED USE: 1 lot with historic battery ZONING: R-1 USE PERMITTED BY RIGHT: yes COMMUNITY CHARACTER MAP: North Beach Neighborhood APPLICATION: Lot Recombination PROPOSAL: The owner/applicant is requesting to combine two lots into one lot. ANALYSIS: The current owners of 21 Taylor Street finalized possession during July 2013. The two lots are located within the historic Fort Screven area. There is a historic battery crossing the common property line of Lot 6 and Lot 7. The current request is to combine Lots 6 and 7 into one lot. The lots are in zone R-1, Single-family Residential. The minimum lot size for R-1 is 12,000 square feet [Section 3-090(A)]. Neither of these lots of record meets the R-1 minimum lot size. Based on the available information the combination of Lot 6 plus Lot 7 will meet the 12,000 square foot requirement. The required building setbacks in an R-1 zone are 20-feet for the front and the rear, and 10-feet on each side. The footprint of the historic battery does not meet the required setbacks. Consideration by the Planning Commission and the Mayor/City Council is necessary for the proposed lot recombination because Staff cannot approve a lot recombination with a nonconforming structure [Section 5-041, Lot Recombination: Recombination of lots in their entirety may be approved by staff so long as there is no creation of a nonconforming lot or structure.]. The surrounding area is dense residential with single-family and condominium dwellings. Below are the Recommended Development Strategies outlined in the Comprehensive Plan for the North Beach Neighborhood Character Area.The proposed Lot Recombination meets the applicable strategies. Comprehensive Plan—Community Character Area North Beach Neighborhood—Section 1.2.9 Meets Recommended Development Strategies Strategy Y/N or N/A 1. New development,redevelopment and restoration should be consistent with existing character Y of the area in terms of mass, scale, use and density. 2. Establish standards and design guidelines for signage. Develop a "theme" for signage to N/A ensure that it is consistent and fits with the character of the area and the Island as a whole. 3. Provide signage for landmarks and commercial businesses in this area. N/A 4. Historic structures should be preserved whenever possible. Y 5. The City should provide appropriate incentives for historic restoration projects. N/A 6. Pursue historic district/historic structure designations for appropriate areas within this district. N/A 7. Ensure continued preservation of old growth trees,parks and greenspace. Y 8. Support the continued development of the Tybee Island bikeway including bike lanes and N/A multi-use trails. 1 If this Lot Recombination is granted, submittal for City signatures of a recombination plat prepared by a Georgia- registered Land Surveyor will be required. According to the Flood Insurance Rate Map (FIRM) dated 09/26/2008 this site is within Flood Zone AE with a Base Flood Elevation 14.The Shore Protection Act and Toe of Dune lines shown on the attached plat have expired. STAFF FINDING Staff finds the requested combination of Lots 6 and 7 at 21 Pulaski Street to be in keeping with the Land Development Code and the Comprehensive Plan.
