MINUTES Board of Commissioners Monthly Workshop Monday, June 25, 2001 - 7:30 p.m. Town Barn The Hillsborough Town Board held a Monthly Workshop on June 25, 2001 at 7:30 PM in the Hillsborough Town Barn. Present for the Workshop were Mayor Horace H. Johnson, Sr., Commissioners Kenneth Chavious, Frances Dancy, Evelyn Lloyd, Brian Lowen, and Mark Sheridan. Staff present were Town Manager Eric Peterson, Planning Director Margaret Hauth, Town Clerk Donna F. Armbrister, Finance Director Sherry Carter, Police Chief Nathaniel Eubanks, Public Works Director/Assistant Town Manager Demetric Potts, Code Enforcement Officer Todd Chavious, Management Intern Jim Klinger and Town Attorney Bob Hornik. 1. Open the Wor~hop Mayor Horace H. Johnson, Sr. opened the Workshop at 7:31 PM. 2. Agenda Changes & Agenda Approval Mayor Johnson requested the Board add a Resolution to Receive Grant Funds to the Agenda. By consensus, the Board agreed to consider the Resolution at that tinle. . Town Manager Eric Peterson presented the Resolution for the Board's consideration. Upon a motion by Commissioner Lowen, seconded by Commissioner Dancy, the Board moved to approve the Resolution Authorizing the Town Manager to Execute the Offer and Acceptance of Loan or Grant for Water Supply System Project with the State of North Carolina Department of Environment and Natural Resources, Division of Environmental Health as presented by a vote of 5-0. The motion was declared passed. A copy of the Resolution is hereby made a part of these official Minutes as an Attachment. 3. Updates from Mayor & Board members on Key CommitteeslIssues Commissioner Lowen updated the Board on the Board on the activities of the Schools and Land Use Committee. 4. Discuss the Board's Options Regarding the pending votes on Hampton Pointe (re-zoning and Special Use Permit), to Correct the Problem of Not Having Sworn Testimony at the Public Hearing for Hampton Pointe's Special Use Permit - Please see Memorandum from the Planning Director 5. Consideration of an Ordinance to rezone 58 acres at NC 86/I-85 from Limited Office to Entranceway Special Use (Tax Map 4.45.4c) - Hampton Pointe . 6. Consideration of Master Plan/Special Use Permit for the Hampton Pointe Project (Tax Map 4.45.4c) - Hampton Pointe Items 4,5,' and 6 were taken together. 1 148 . Bill Anderson, representing the Hampton Pointe Development, appeared before the Board and stated that he appreciated the Town's Planning Director calling him to apologize and explain the situation of not having sworn testimony at the Public Hearing. He restated their desire to continue working with the Town to come to a consensus on the proposed development plans. Paul Newton addressed the Board and expressed his support of the Hampton Pointe project. Jerry Dickens, representing the Hampton Pointe Development, reiterated to the Board their desire for the Board to make a decision on this project as soon as possible. Marianne Risley addressed the Board and expressed her concerns regarding the traffic problems in that area regardless of whether or not the Hampton Pointe project is approved. Matthew Farelly appeared before the Board and discussed his fears that the Hampton Pointe Project would pull commerce away from the downtown Hillsborough area. Syd Alexander requested that if the Board agreed to hold another Public Hearing, that they also hold a vote on the proposed Hampton Pointe Development that same evening. Vickie Atkinson addressed the Board and expressed her concerns with the proposed development. . Norma Preston also addressed the Board expressing her concerns. Craig Benedict, representing the Orange County Board of Commissioners and the Orange County Representatives on the Economic Development District Taskforce, addressed the Board regarding the concerns of the County and the EDD Taskforce. He presented the County's recommendations for the Board to consider. A copy of these recommendations is hereby made a part ofthese official Minutes as an Attachment. Mayor Johnson polled the Board members regarding their stance on this Item. Commissioner Chavious stated that he wished to reserve his comments until such time that a vote is taken Commissioner Lowen stated he would like to see the Board come to some decision on this proposed development. Commissioner Sheridan said he would also like to see a decision made. Commissioner Lloyd declared that she does not want to see all of the development in the EDD happen in the same location. . Commissioner Dancy expressed her feelings that the Board can work with the developers if both parties are willing to compromise. 2 . . . .: 149 Commissioner Lloyd made a motion to deny the Ordinance to rezone 58 acres at NC 86/I-85 from Limited Office to Entranceway Special Use (Tax Map 4.45.4c) - Hampton Pointe. This motion failed for lack of a second. Upon a motion by Commissioner Lowen, seconded by Commissioner Chavious, the Board moved to schedule another Public Hearing to receive comment on the proposed Hampton Pointe development for July 24, 2001 at 7:00 PM at the Courthouse by a vote of 4-1 with Commissioners Lowen, Chavious, Dancy, and Sheridan voting Aye, and Commissioner Lloyd voting Nay. The motion was approved. Mayor Johnson caIled for a 5-minute recess. Mayor Johnson reconvened the meeting. 7. Discussion/Presentation Regarding the Proposed Development at 1-40 and Old NC86 Matthew Farelly appeared before the Board and spoke in favor of this proposed mixed-use development and suggested the Board consider this as an alternative to the proposed Hampton Point Development. Max Preston addressed the Board and encouraged the Board to consider and take action on this proposed development before making a decision on the proposed Hampton Pointe Development. Scott Radway and Jeff Birtch, representing Kinley-Hom/Benchmark Group Developers, presented the proposed Development at 1-40 and Old NC 86 Plans for the Board's consideration. Scott Radway also gave a brief history of this proposed development and how the process has proceeded to this point and fielded questions from the Board. 8. Other There was not other business discussed. 9. Adjourn Upon a motion by Commissioner Lowen, seconded by Commissioner Chavious, the Board moved to adjourn at 9:50 PM by a vote of 5-0. Benedict, AICP, Planning Director on behalf of the Orange County Board of Commissioners . DATE: June 22,2001 Subject: Hampton Pointe Project These comments are respectfully submitted. The purpose of the Hillsborough Area Economic Development District (EDD) is to provide a long term, viable, mixed use development area that creates a variety of good employment opportunities and stable tax base.. The positive benefits of an economic development district should far outweigh the costs of services and the potential adverse impacts upon the quality of life as it relates to traffic congestion. The Hampton Pointe project, as proposed, does provide certain positive aspects: 1. Appropriate place for commercial retail 2. Enhanced tax base 3. Increased employment opportunities 4. Water and Sewer operating revenue. . However, there are certain basic Economic Development District principals that are being compromised by this proposal. . . . ~. 152 A. It does not promote sustainable mixed-use development with a variety of jobs, industry and services. B. It does not distribute peak traffic patterns. C. In general, does not provide living wage jobs. D. Does not provide long-term economic stability because retail is a fragile sector. In fact, the proposed project would: · overly consume the retail market that was intended to be distributed throughout the EDD area with various access points on New and Old NC 86 near 1-40 and 1-85. · create traffic congestion because of its intense retail nature. · weaken or undermine the entire Economic Development District opportunities on development proposals which need a minor mix of retail and which will someday be the Town of Hillsborough's long term stable tax base. What the county respectfully offers as comment, to the Town of Hillsborough for their deliberation is the following: 1) A sincere thank you to the Town of Hillsborough for being a partner in past and future EDD endeavors and improved excellent communication. 2) Scale the project down 30% of the retail total and replace 150,000 square feet building and 500 associated parking spaces with landscaping to meet impervious requirement and improve site plan aesthetics 3) Require traffic improvements to complete 4 lane divided highway with turn lanes from entrance to 1-85 access. 4) See list of site plan enhancements (Exhibit 1): · Parking lot and pedestrian circulation . Hampton Pointe Master Plan Staff Comments - January 2001 l'5'a' " v The following items have been identified as unsatisfactory and should be revised to reflect the following: Parking and Loading 1. North Carolina State Building Code requires additional handicap accessible stalls. 2. No handicapped parking is provided to be readily accessible to Building 3. 3. Loading areas to be designated at sides and rear of buildings. 4. Eliminate all parking stalls that backup directly into main access points. Landscaping 1. Landscape divider strips to be provided at each parking aisle perpendicular to parking spaces. 2. Landscaping required around base of structures to offset long expanses of wall surface. 3. Additional and extensive landscaping required at perimeter of property and along street rights-of-way. 4. Provide additional open space/tree preservation buffer between parking lot and road rights-of-way. 5. Parking area quadrants to be separated by landscaping. Impervious Surface 1. 69% impervious surface indicated on plans does not include additional impervious surface which will result in development of outparcels. Maximum impervious surface recommended for the entire project is 50%. Additional development of outparcels could result in impervious surface exceeding 80%. Architectural Considerations 1. Add offsets to Building #1 and landscape around perimeter to provide relief from long, uninterrupted expanses of wall. (Move center section of building forward) 2. Move loading area to opposite end of building or side of building to avoid circulation difficulty, to improve aesthetics and move heavy loading traffic away from food store and towards garden area. 3. Building architecture (exterior election) could use enhancement. Site Layout '.' '." 154 1. Building #3 not allowed in rail station reserve area. . 2. Move most of outparcels to a walkable area. 3. Leave/add natural areas along corridor. RoadwayslTransportation 1. Align signal for cross access between truck/gas stop. 2. Widen NC 86 to four (4) lane divided highway. 3. Accommodate future rail stop area and provide bus drop off zone. 4. 100% retail can overburden traffic capacity of roadways in area and limit potential of other non-retail employment based sites in the EDD area. Environmental 1. Locate buildings, roadways and parking areas to minimize land disturbance by matching land elevations and preserving natural vegetation. . . . . . ORANGE COUNTY PLANNING STAFF COMMENTS - JUNE, 2001 HAMPTON POINTE MASTER PLAN We have reviewed the revised plans for the Hampton Pointe development, and have the following comments to offer: Impervious Surface: Impervious area is still above the suggested maximum for area. Less square footage and less associated parking will permit more landscaped pervious area. Parking and Circulation: 1. Eliminate perpendicular parking in front of Building 1. 2. Provide internal cross access easements to ensure connectivity between parking lots for Outparcels A through E. 3. Demarcate loading bays at rear of Building 1 and 2 and identify others. 4. Remove parking at main entrance accesses and provide double median and all landscape areas. Landscaping 1. Increase width of main circulation road landscaping. 2. Width of landscape areas adjacent to road is only five-feet wide. It needs to be a minimum of fifteen-feet wide to accommodate landscaping and avoid visibility obstructions. 3. Landscape median needs to prevent left-hand turns into first parking lot entrance. 4. Double the size of interior lot landscape islands. Proposed islands are too narrow to provide adequate planting for healthy root system of trees. 5. Provide landscaping at front of building. 6. Street trees along NC 86 S should be a mix of flower (Dogwood and Kwanzan Cherry) along with hardwoods. 7. Identify and preserve existing trees near old homestead site. 8. Proposed planting of Scarlet Oak is not practical within the ten-foot wide planting island proposed for the interior parking lot area. 9. Proposed street trees and landscape island trees to be a minimum height of twelve feet. Architectural Considerations: 1. Relocate and screen dumpster at Buildings 3 and 4. 2. Facade of Buildings 3 through 6 facing frontage road shall be aesthetically 3. All elevations shall be designed to be architecturally treated so as to avoid long, unarticulated or blank facades. 4. North side of Buildings 3 through 6 shall be designed to appear orientated towards the street. 5. Future outparcels have high visibility and should be de$igned aesthetically on all sides. Railroad Park and Ride: 1. Future rail station and park and ride facility should be located central to the site to provide superior access to road network and pedestrian access to retail centers. 15~
