HomeMy Public PortalAboutOrdinance 2131 Ordinance No. 2131 AN ORDINANCE AUTHORIZING THE EXECUTION OF AN INTERGOVERNMENTAL AGREEMENT REGARDING APPURTENANCES WITHIN THE COUNTY OF WILL'S RIGHT-OF-WAY NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, AS FOLLOWS: 1: The Village President is hereby authorized to execute the Agreement attached hereto and made a part hereof as Exhibit "A" which provides for the maintenance of appurtenances within Will County's right-of-way. That all ordinances or parts thereof in conflict herewith are hereby repealed. This Ordinance shall be in full force and effect from and after its passage and approval as required by law. This Ordinance shall be numbered as Ordinance No. 2131 PASSED THIS 3rd DAY OF June , 2002. AYES: O'Connell, Thomson, Cherry, Calabrese, Collins, Swalwell. VILLAGE PRESIDENT ;ATTEST: ~_ ,. ~ _ .- ~ .~~~~ ~ - ..VILLAGE CLE , ' Resolution 02-372 Page 2 Public Works Committee Resolution - INTERGOVERNMENTAL AGREEMENT BETWEEN THE COUNTY OF WILL AND VILLAGE OF PLAINFIELD This Intergovernmental Agreezz~ent is made and entered into this 15th day of August ._ _~ 20;.02 by and between the COUNTY OF WILL, a unit of local Government Thereinafter referred to as the "COUNTY") and VILLAGE OF PLAINFIELD. WITNESSETH: WHEREAS, The VILLAGE OF PLAINFIELD plans to construct _ a urtenazlce work within the Count ri ht of wa includin but not limited to sidewalk streetli hts crosswalks etc. for the purpose of romotin ublic safet located at various locations___along, the County Highway System within-the Village of Plainfield municipal limits-; and WHEREAS, it is necessary that portions of the a urtenance work be located on Will Couzlty roads and / ar right of ways; and WHERAS, the COUNTY and the VILLAGE OF PLAINFIELD have elected to cooperate with each other and determine the rights and responsibilities of each party regarding the location., construction and maintenance of the above _ said appuz-tenance work ;and ,` WHEREAS, this agreement is entered into pursuant to the Intergovernmental Cooperation Act (5 ILCS 220/1 et seq.). ~... NOW TI-~ER~FORE, in consideration of the mutual promises, obligations and undertakings set forth herein -the parties agree as follows: 1.. The COUNTY shat permit portions of said a urtenance work to be located on COUNTY roads and right of ways. 2 I`ve- - -VILLAGE OF PLAINFIELD shall be responsible for payment. of all expenses for the constrtzctron and maintenance of said- appurtenance work 3. The VILLAGE OF PLAINFIELD agrees to indemnify and hold hazxnless the COUNTY from any liability, action, claim, judgement or award arising from this agreement or the construction, maintenance ar use. of said a urtenance work Public Works Committee Resalution'02-372 RESOLUTION RE: A RESOLUTON AUTHORIZING AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE COUNTY OF WILL AND THE VILLAGE OF PLAINFIELD FOR CONSTRUCTION OF SIDEWALKS, STREETLIGHTS, AND CROSSWALKS WHEREAS, the Village of Plainfield plans to construct appurtenance work within the County right of way including but not limited to sidewalk, streetlights, crosswalks, etc. For the purpose of promoting public safety located along various County Highways within the Village of Plainfield municipal limits: and WHEREAS, the Village of Plainfield will be responsible for payment of all expenses for the construction and maintenance of the sidewalks, streetlights, crosswalks etc.; and WHEREAS, it is necessary that the sidewalks, streetlights, crosswalks, etc. be located on Will County roads and / ar right of way; and WHEREAS, it is desirable that the County and the Village of Plainfield cooperate with each. other and determine the rights and responsibilities of each party regarding the location, construction, and maintenance of said sidewalks, streetlights, crosswalks, etc; and WHEREAS, the Intergovernmental Cooperation Act (S ILCS 220/1 et seq.) provides statutory authority for the County and the Village of Plainfield enter into an intergovernmental. agreement as described above. NOW THEREFORE, BE IT RESOLVED, that the Will County Board hereby authorizes the execution of an intergovernmental agreement between the County of Will and the Village of Plainfield pertaining to the construction of sidewalks, streetlights, crosswalks, etc. located on various locations along the County Highway System in the Village of Plainfield municipal limits.
