ADOPTED BY THE VILLAGE OF PLAINFIELD ON NOVEMBER 18, 2002 PUBLISHED IN PAMPHLET' FORM BY THE AUTHORITY OF THE PRESEINT ~ AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, WILL ~ COUNTY, ILLINOIS, THIS 25TH DAY OF NOVEMBER, 2002. (~S~ ,. ,. ~, ORDINANCE NO. 2172 AN ORDINANCE AUTHORIZING THE ISSUANCE OF A SPECIAL USE PERMIT TO ALLOW FOR RETAIL SALES FOR PROPERTY LOCATED AT 407 DIVISION STREET, PLAINFIELD, ILLINOIS WHEREAS, the Village of Plainfield Plan Commission has recommended that the application for a special use permit to allow for retail sales for property located at 4Q7 Division Street be granted and has made certain findings based on the evidence presented to it in said case that: a. The establishment, maintenance or operation of the special use will not be detrimental to, or endanger the public health, safety and general welfare; and b. The special use will not be injurious to the use and enjoyment of other property in the immediate area for the purposes already permitted, nor substantially diminish and impair property values within the neighborhood; and c. The establishment of the special use will not impede the normal and orderly development and improvement of the adjacent property for uses permitted within the district. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, WILL COUNTY, ILLINOIS AS FOLLOWS: Section 1. The President and Board of Trustees of the Village of Plainfield hereby adapt and incorporate as their own, the above findings made by the Plan Commission. Section 2. That the President and Board of Trustees of the Village of Plainfield hereby approve the application by the owner far a special use permit to allow for retail sales far the following tract of land to wit: LOT 2 IN BLOCK 3 OF ELIHU CORBIN'S ADDITION TO PLAINFIELD, IN THE NORTHWEST'/~ OF SECTION 15, TOWNSHIP 36 NORTH, RANGE 9 EAST OF THE THIRD PRINCIPAL MERIDIAN, IN WILL COUNTY, ILLINOIS, ACCORDING TO THE PLAT THEREOF RECORDED JANUARY 20 1853, IN BOOK "Z", PAGE 554, AS DOCUMENT NO. 15Q58, IN WILL COUNTY, ILLINOIS. ~ l-~ ~ D(~ ~b3 - lSv lnS~ Uol -oboo Section 3. That said special use permit shall be subject to the following conditions: 1. Limit retail to only retail for drapery, window treatments, accessories and floral design sales. 2. Any outdoor lighting of the site shall be operated during normal business hours only. - ~ ~ ,, r 3. A dry well shall be installed in the location shown on attached Exhibit "A" and constructed in compliance with the requirements recommended by the Village Engineer in a letter of November 5, 2002 4. Landscaping is to be completed in compliance with the site plan attached hereto and made a part hereof as Exhibit "A" Section 4. This Ordinance shall be numbered as Ordinance No. 2172. This Ordinance shall be in full force and effect from and after its passage, approval, and publication as required by law. PASSED THIS 18 DAY OF November, 2002. Lockport Street Plainfield, IL b0544 Dear Mayor Rock: November 12, 2002 Thank you for letting me read a statement at the last Village Board meeting in relation to the rezoning and special use of 407 Division Street. I would like to clarify one statement I made and also request the Board address an issue, which wasn't presented to the public at the meeting. 1 indicated that the applicants had made a statement to the Plan Commission that paving the driveway would increase the runoff from the property. This statement was made by Mr. Graham, the applicant's attorney, at the Plan Commission meeting of 10/15/02. A request has been made far the tape of that meeting following standard Village procedures, and I hope the Village will comply with that request. Secondly, I would like full 100% screening from the applicant's parking lot. This option is afforded by the BTD ordinance, and in light of the current parking lots and cars now visible at 501 and S03 Division where there is essentially no screening, granting this request. is fair and reasonable. I have not seen the applicant's application where it is shown that 100%a screening will be achieved, and there was na discussion by the Board that really addressed this issue. I would like to be assured that the property at 407 Division would have complete screening.
