REDEVELOPMENT AREA INVESTIGATION FOR BLOCK 2703,
LOT 1 (FORMERLY BLOCK 50.2, LOT 2) ON THE TAX MAP OF
THE BOROUGH OF CARTERET
WHEREAS, the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A -1, et seq.,
as amended (the "Redevelopment Law "), authorizes municipalities to determine whether
certain parcels of land constitute areas in need of redevelopment; and
WHEREAS, the Borough Council (the "Borough Council ") of the Borough of Carteret
(the "Borough "), previously designated the properties formerly known as Block 49.03,
Lot 1, Block 50.01, Lots 10 -17, 27 -30 and 32.04, Block 50.02, Lots 1.01, 1.02 and 2 -4 on
the Borough's tax map, along with portions of surrounding rights -of -way (collectively,
the "West Carteret Minue Street Redevelopment area, Phase II ") as an area in need
of redevelopment under the Redevelopment Law; and
WHEREAS, the Borough desires to conduct a supplemental investigation to determine
whether the parcel designated as Block 2703, Lot 1 (the "Study Area ", formerly known
as Block 50.2, Lot 2) meets the criteria currently set forth in the Redevelopment Law for
designation as an area in need of redevelopment and should continue to be so designated;
and
WHEREAS, if tike Study Area is determined to meet the criteria for designation as an
area in need of redevelopment and tike Borough determines that the Study Area will
continue to be so designated, then the Borough shall be authorized to use all the powers
provided under the Redevelopment Law for use in a redevelopment area, including the
power of eminent domain.
NOW THEREFORE, BE IT RESOLVED BY THE MUNICH'AL COUNCIL OF
THE BOROUGH OF CARTERET, NEW JERSEY AS FOLLOWS:
Section 1. The foregoing recitals are incorporated herein as if set forth in full.
Section 2. The Planning Board is hereby authorized and directed to undertake
a preliminary investigation to determine whether the Study Area is in need of
redevelopment under the Redevelopment Law and, thereafter, to make a recommendation
to the governing body of the Borough as to whether the Study Area should or should not
continue to be designated by the governing body as an area in need of redevelopment.
Section 3. In the event the governing body determines that the Study Area
meets the criteria for designation as a redevelopment area and should continue to be so
designated, the Borough shall be authorized to use all the powers provided under the
Redevelopment Law for use in a redevelopment area, including the power of eminent
domain.
