HomeMy Public PortalAboutResolution 06-2209 PC 8841 Las Tunas Drive (B20 Bar and Grill)" RESOLUTION 06 -2209 PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY APPROVING A REQUEST FOR THE EXTENSION OF THE BUSINESS HOURS FOR A RESTAURANT KNOWN AS B20 BAR & GRILL. THE CURRENT BUSINESS HOURS ARE FROM 11:00 A.M. TO 11:00 P.M., AND THE PROPOSED HOURS ARE FROM 11:00 A.M. TO 1:00 A.M., MONDAY THROUGH THURSDAY, AND FROM 11:00 A.M. TO 2:00 A.M. ON FRIDAY, SATURDAY, AND SUNDAY. THE SUBJECT PROPERTY IS LOCATED AT 8841 LAS TUNAS DRIVE AND IS DESIGNATED AS COMMERCIAL BY THE CITY'S GENERAL PLAN LAND USE MAP. CUP 06 -1680 (TZU -TSAU CHAO) The Planning Commission of the City of Temple City does hereby resolve: Section 1. Based upon a public hearing for the above Conditional Use Permit 06 -1680, the Planning Commission finds: 1. That the site for the proposed use is adequate in size, shape, topography and circumstances in that the subject business is located on a site with a combined lot area of 42,120 square feet. The lot is rectangular in shape and level in grade; the 1,316 square foot floor area for the restaurant is sufficient to accommodate the proposed maximum capacity of thirty -five (35) customers and; 2. That the site does have sufficient access to streets, adequate in width and pavement type to carry the quantity and quality of traffic generated by the proposed use in that the site abuts and takes direct access to Las Tunas Drive - a major thoroughfare of the area with a 70 -foot roadway and a 100 -foot wide right -of- way; and two driveways have been provided for ingress and egress and; 3. That the proposed use will not have an adverse effect upon the use, enjoyment or valuation of adjacent or neighboring properties or upon the public welfare in that the restaurant is a long -time establishment that is consistent with its land use designation; and the proposed extended business hours are consistent with the historical use of the property. In addition, conditions of approval have been included in this resolution to ensure the project complies with the City's relevant laws; violations will be subject to revocation proceedings. Section 2. This project should not result in significant effects upon the environment, and a Negative Declaration has been prepared in accordance with the State CEQA Guidelines. The initial statement as prepared indicates there is no potential for adverse impact to the environment as it relates to all wild animals, birds, plants, fish, amphibians, and related ecological communities, including the habitat upon which the wildlife depends for its continued viability. Accordingly, Conditional Use Permit 06 -1680 is approved, subject to the following conditions: 1. The hours of operation for the restaurant use shall be limited to 11:00 a.m. to 1:00 a.m., Monday through Thursday, and 11:00 a.m. to 2:00 a.m. on Friday, Saturday, and Sunday. 2. Maximum building capacity at any given time shall be established by the Los Angeles County Building and Safety Department. 3. No formal or informal entertainment shall be permitted at any time, without a modification of this Conditional Use Permit. 4. No outside dining shall be permitted without a modification of this Conditional Use Permit. 5. The applicant /property owner shall be responsible for controlling loitering and the conduct of individuals on the premises. 6. All activities and functions of the site shall be subject to the City's Noise Ordinance. Any violation of the City's Noise Ordinance as contained in Section 9280- 9282.1 shall be grounds for revocation of this Conditional Use Permit. 7. Building permits shall be obtained for any building improvements or building modifications. Such modifications and /or alterations shall be subject to the review and approval of the Planning /Building Departments of the City of Temple City. 8. The applicant/property owner shall meet all requirements of the National Pollutant Discharge Elimination System (NPDES) related to pollutants, runoff or non -storm water discharges. 9. This Conditional Use Permit shall be subject to review and revocation thereafter by the granting body, if the serving of alcoholic beverages and /or hours of operation appear to contribute to a public nuisance as determined by the Community Development Department. 10. The Conditions of Approval contained in this Resolution may be enforced by the Sheriff's Office as well as City Staff. Any violation of any condition is a misdemeanor and may be processed directly by criminal complaint. 11. This Resolution shall not become valid until such time that the applicant /property owner has signed a copy of the Resolution acknowledging acceptance of the Conditions of Approval. • • • " Resolution 06 -2209 PC Conditional Use Permit 06 -1680 8841 Las Tunas Drive Section 4. The Secretary shall certify to the adoption of this Resolution.
