RESOLUTION 1-2000
A RESOLUTION AUTHORIZING THE FILING OF A PETITION WITH THE
INDIANA UTILITY REGULATORY COMMISSION FOR AUTHORITy TO
PROVIDE TELECOMMUNICATION SERVICES
WHEREAS,

WHEREAS,
WHEREAS,
the City of Richmond, Indiana, owns and operates a municipal utility
doing business as Richmond Power & Light, which currently provides
electrical services for the benefit of the City and its customers; and
in recent years the needs of the City and of the Richmond Power & Light
customers have increased to include the need for certain high speed non-
switched telecommunication services, not presently available within the
area of Richmond Power & Light; and
over the years Richmond Power & Light has installed and currently
operates fiber optic cable facilities for the purpose of supporting its
electric utility operations, which on occasion have also been made
available to educational and governmental institutions for use with their
data transmission and other communication related activities; and
Richmond Power & Light desires to expand its fiber optic cable facilities
in order to improve the support for its electric utility and in order to
furnish to its customers high speed, digital voice, video and data
transmission services commonly provided by competitive access
providers; and
WHEREAS,
WHEREAS,
WHEREAS,
Richmond Power & Light has, or can obtain access to, the technical,
operational and managerial experience and capabilities required to provide
the new proposed services; and
the Indiana statutes regarding "Home Rule" might allow the unilateral
expansion of utility services by Richmond Power & Light to provide
telecommunication services, but it is more prudent and appropriate to
request a certificate of territorial authority ("CTA") form the Indiana
Utility Regulatory Commission ("IURC") to allow such services; and
the public interest and public convenience and necessity will be served by
the IURC's issuance of a certificate of territorial authority to provide the
proposed services; and
WHEREAS,
WHEREAS,
WHEREAS,
the type of telecommunication services proposed to be provided by
Richmond Power & Light through the use of its existing fiber optic cable
facilities are not now available within the Wayne County area, and that by
using such facilities for the proposed purposes will make for a more
effective, efficient and economic use of the fiber optic facilities; and
although permission is being sought from the IURC for authority to
provide the telecommunication services, continuing jurisdiction and
regulation by the IURC of such service is not necessary based upon the
fact that prices for such services are generally set within a competitive
market situation; and that in fact, any regulation would be detrimental to
both Richmond Power & Light and the customers as it affects prices,
speed of providing services, and flexibility; and
by State law, Richmond Power & Light may request IURC to decline to
exercise its jurisdiction over the new telecommunication services to be
provided; and
WHEREAS,
it is in the best interest of Richmond Power & Light and its customers to
allow the General Manager of Richmond Power & Light authority to
retain necessary consultants to implement the telecommunication services
requested herein; and
WHEREAS,
a Resolution of the Board of Directors for Richmond Power & Light is
necessary in order to request and allow a Petition to be filed before the
IURC to accomplish the above purposes.
NOW, THEREFORE BE IT RESOLVED by the Board of Directors for
Richmond Power and Light as follows:
1. That Richmond Power & Light be allowed to expand its fiber optic cable
facilities in order to provide to its customers high-speed, digital voice, video and data
transmission services within Wayne County and the surrounding area, which services
shall not include switched access services.
2. That Richmond Power & Light be authorized to file a Petition with the IURC
requesting approval of a CTA to provide the above described telecommunication
services, and to also request within such Petition that the IURC decline to exercise any
jurisdiction it may have over the telecommunication services to be provided by
Richmond Power & Light.
3. That Richmond Power & Light be authorized to request, to the extent
necessary, permission from Wayne County to use any county roads or other property in
order to provide the above services.
4. That the General Manager of Richmond Power & Light be authorized to retain
any consultants necessary to implement the described telecommunication services,
subject to any applicable current budget of Richmond Power & Light approved by the
Board, and to execute any and all other documents necessary to carry out the terms of this
Resolution.
