Sherbondy Village Auditorium 215 Perviz Avenue Opa-locka, FL 33054 1. CALL TO ORDER: Mayor Myra L. Taylor called the meeting to order at 6:00 p.m. on Wednesday, August 02, 2017 in the Auditorium at Sherbondy Village, 215 President Barack Obama (Perviz) Avenue, C)pa- locka, Florida. 2. ROLL CALL: The following members of the City Commission were present: Mayor Myra L. Taylor, Vice Mayor Joseph L. Kelley, Commissioner Timothy Holmes and Commissioner John B. Riley. Also in attendance were: Interim City Manager Ed Brown, City Attorney Vincent T. Brown, and City Clerk Joanna Flores. Commissioner Matthew A. Pigatt was not in attendance. 3. INVOCATION: The invocation was delivered by Commissioner John Riley. 4. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was recited in unison. 5. SECOND READING ORDINANCE/PUBLIC HEARING: a. AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF OPA- LOCKA, FLORIDA, AMENDING THE OPA-LOCKA CODE OF ORDINANCES, CHAPTER 2 — ADMINISTRATION, ARTICLE 1 — IN GENERAL; ESTABLISHING SECTION 3 — NATIONAL CRIMINAL HISTORY SCREENING FOR CITY MANAGER; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR ADOPTION OF ARTICLE; PROVIDING FOR AUTHORITY; PROVIDING FOR CODIFICATION; PROVIDING FOR SCRIVENER'S ERRORS; PROVIDING FOR CONFLICT; PROVIDING FOR LIBERAL CONSTRUCTION; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. (first reading/public hearing held on July 17, 2017). Sponsored by City Commission The above ordinance was read by Attorney Brown. It was moved by Commissioner Riley, seconded by Commissioner Holmes for discussion. Mayor Taylor asked the attorney why the sections in the resolution are not in sequence. Special Commission Meeting Minutes—8/02/2017 1 City Attorney Brown said that those were scrivener's errors and has been revised to reflect the changes. The clerk has the official item for execution. There being no further discussion, the motion on the ordinance passed by a 4-0 vote. Vice Mayor Kelley Yes Commissioner Pigatt Not Present Commissioner Riley Yes Commissioner Holmes Yes Mayor Taylor Yes Commissioner Riley said that he would like to hold an executive session to be updated about the costs of all of the current litigation with the City. Mayor Taylor asked the commissioner if he had a specific time in mind for the executive session. City Attorney Brown said that this is a special call meeting and the only action that can be taken tonight is on the agenda item only; this is based on the City's code. Commissioner Riley said that is fine, but his action has to be taken at a public meeting and this is one. Mayor Taylor said that she is under the impression that only the attorney can make that announcement at a public meeting. City Attorney Brown said that is correct, however that announcement is not on the agenda as other announcements have been at previous meeting; this has been the practice of the commission. He has no issue sitting down with Commissioner Riley to discuss the litigation and that cannot be shared, but if the commission desires to have an executive session then that is fine. 9.
