RESOLUTION REJECTING BIDS FOR BERGEN, HAYWARD
AND HARRISON PUMPING STATION IMPROVEMENTS
WHEREAS, the Borough of Carteret (the "Borough") is undertaking certain repair
and improvements to the Bergen, Hayward and Harrison Pumping Stations (the
"Project"); and
WHEREAS, in connection with the Project the Borough solicited and received bids
on February 18, 1999 from contractors in connection with the Project; and
WHEREAS, Electrical Power, Inc. CEPI") was the lower bidder on the Project; and
WHEREAS, a review of EPI's bid by the Borough Engineer and the Borough
Attorney reveals certain non-waivable defects in the EP! bid, namely that EPI bid
proposal contains an unclear amount for item number 3 and does not include itemized
prices set out in words; the EPI's bid proposal is executed and attested to by the
same person; EPI did not provide a required corporate resolution authorizing the
proported signing party to execute the bid documents; EPI's bid proposal,
Contractor's certification Non-Collusion Affidavit, Certification of Bidder's status,
Equipment Certification and Bidder's check list are not originally executed but contain
a stamped signature; EPI has failed to provide evidence of authority to transact
business in the State of New Jersey; a phone search reveals no listing for EPI at its
stated address; and
WHEREAS, the remaining bids far exceed the Borough Engineer's estimate for the
cost of the project;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the
Borough of Carteret that EPI's bid for the Project is hereby rejected as being non-
responsive.
BE IT FURTHER RESOLVED that all the remaining bids are hereby rejected in
that they greatly exceed the Borough's estimate for the cost of the Project.
BE IT FURTHER RESOLVED that the Purchasing Agent be authorized to rebid
the Project upon review of the bid specifications by the Borough Engineer.
