HomeMy Public PortalAbout2012.239 (12-18-12) RESOLUTION NO. 2012.239 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ADOPTING THE BULKY ITEM ILLICT DUMPING POLICY AND PROCEDURES AND AUTHORIZING STAFF TO IMMEDIATELY IMPLEMENT SAID POLICY : AND PROCEDURES WHEREAS, discarded bulky items placed within public places, especially parkway area, create a nuisance and public health concern; and WHEREAS, the City has noticed an increase in discarded items being placed • within the parkway areas and street areas; and WHEREAS, the City's waste hauling contract includes bulky item pick-up • .procedures that are managed through the franchised waste hauler; and WHEREAS, for public safety reasons the City needs to address illicit bulk items discarded within parkway areas, sidewalk areas and street areas. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, PROCLAIM, ORDER, AND RESOLVE AS FOLLOWS: Section 1. The City Council adopts the City of Lynwood "Illicit Dumping Policy, Guidelines and Procedures", attached hereto as Exhibit "A". Section 2. The City Council authorizes staff to commence enforcement of the "Illicit Dumping Policy, Guidelines and Procedures". Section 3. This Resolution shall take effect immediately upon its adoption. Maria Quinonez, City Clerk • `�a"�a CITY OF LYNWOOD � ) ILLICIT DUMPING POLICY GUIDELINES I '" AND PROCEDURES 1 1 PURPOSE In response to complaints of illicit dumping within public places, the Public Works Department has developed a formal procedure to effectively handle and address such concerns. The I primary purpose for developing and adopting these procedures is to address, reduce and discourage the negative effects caused by illicit dumping. BACKGROUND Over the last several years the City of Lynwood has noticed a significant increase in illicit dumping notably on parkways which has become a major problem for the City. Individuals leave trash and other discarded items on parkways, streets, alleys, and other public places. This not only looks bad but, it poses a community health and safety problem. In addition, it places an undue economic burden on the City and diverts limited resources that can be better I utilized on other maintenance and repairs of street, parks and other facilities. IAs part of their contract, the City's Franchise waste hauler provides weekly bulky items pick-up II services for residential and commercial (apartment complex of four units or more). In addition 1 to these services, the City, in cooperation with the Franchise waste hauler, provides two annual bulky item pick-up events for all residents of Lynwood at no charge. With this level of bulk item pick-up service, there is no reason for the City to have the level of illicit dumping occurring in C' 1 public places, especially in residential parkway areas. BULKY ITEM PICK-UP PROCEDURES I, I 1 The bulky pick-up procedures for residential and commercial are outlined below: For residential bulky items pick-up services; which include single family units, duplexes, and tri- plexes services are provided free of charge. The procedure is as follows: i 1. The resident must call the City's Franchise waste hauler at 1-800-298-4898 to schedule j a bulky pick-up. 2. The bulky items (limit 5 items per week) must be placed on the curb in front of the residence no later than 6:00 AM on the scheduled pick-up day and no earlier than 6:00 PM the day before scheduled pick-up day. 1 For commercial bulky item pick-up services which are residential apartments of four units and up, there is a service fee for bulky item pick-up as indicated below. The procedure is as follows: I 1. The owner of the complex must call the City's franchise waste hauler at 1-800-298- 4898 to schedule a bulky pick-up. i { 2. Bulky items (limit 5 items) must be placed on the curb in front of the complex no later than 6:00 AM on the scheduled pick-up day and no earlier than 6:00 PM the day before the scheduled pick-up day. It Commercial Bulky Item Service fees (subject to change):i I 1-2 items: $25 3-5 items: $50 j 6-10 items: $100 fi 11-20 items: $200 3. Businesses need to contact the City's franchise waste hauler at 1-800-298-4898 to arrange for bulky item services and costs. i. ILLICIT DUMPING ON PARKWAY AREA POLICY Chapter 13-5 of the Lynwood Municipal Code addresses items being left in the public right-of- way. As such, consistent with this section of the Lynwood Municipal Code, no person shall leave bulky items or merchandise within the parkway, sidewalk or street areas fronting Y g th i r `their property. The property owner, renter, property manager or person occupying the property shall t, cause the removal of item upon receiving a Notice of Violation and Order to Abate issued by j, the City of Lynwood. No item shall be allowed to remain in these public ways for more than 48 if hours. Additionally, no item shall be placed in any public way in a manner that violates this t ilpolicy. If items are not removed from the public way the City may issue citations consistent with ° chapter 20 of the Lynwood Municipal Code. f. f. 11%3 Administrative Citations are as follows: I lS` Offense $100.00 1 2nd Offense f. $200.00 j 3rd & Subsequent Offenses $500.00. I City staff certified to issue citations shall be responsible for enforcement of this policy as 1 follows: 1. il • The Code Enforcement Division shall be responsible for enforcement and issuance of r Notices of Violation, and citations in all residential areas. if , • The Business License Division shall be responsible for enforcement and issuance of i.Notices of Violation, and citations in all business areas. • For residential areas on the third day of violation, the Code Enforcement Division shall { issue citations. The Code Enforcement Division shall also notify the Public Works Engineering Division that a citation has been issued and provide the address where the illicitly dumped material is located. ii • For business areas on the third day of violation, the Business License Division shall issue citations. The Business License Division shall also notify the'Public Works Engineering Division that a citation has been issued and provide the address where the i illicitly dumped material is located. • Public Works will be responsible for removal of the items after the third day and upon confirmation that a citation was issued. The cost incurred by the City will be assessed upon the property owner and shall become a lien against the property until paid. ' • The City at its discretion may pursue any and all legal and equitable remedies for the collection ] of unpaid fines, interest and penalties, as prescribed by Lynwood Municipal Cede Section 20- i 12. i'.
