Home My Public Portal About1849-1961 - Approving an Easement Agreement Made and Entered Through Public Works and Safety and Richmond Water Worksy I :V ORDINANCE NO. 1849-1961' AN ORDINANCE RATIFYING, CONFIRMING AND APPROVING AN EASEMENT AGREE- MENT MADE AND ENTERED INTO ON THE 9th DAY OF MARCH, 1961, BY THE CITY OF R ICHMOND THROUGH ITS BOARD OF PUBLIC WORKS AND SAFETY AND THE R ICHMOND WATER WORKS CORPORATION WHEREAS, heretofore, to -wit: On the 9th day, of March, 1961s the City of Richmond, by and through its Board of Public Works and Safety, entered into the following easement agreement with the Richmond Water Works Corporation, an Indiana utility corporation, with its principal place of business in the City of Richmond, Indiana, namely: EASEMENT AGREEMENT i THIS AGREEMENT, Made by and between the Board of Public Works and Safety of the City of Richmond, in the County of Wayne, State of Indiana, hereinafter designated as "Grantor", and the Richmond Water Works Corporation, an Indiana corporation, with its principal place of business in the City of Richmond, Wayne County, Indiana, hereinafter designated as "Grantee', W I T N E S S E T H: Grantor does hereby grant unto Richmond Water Works Corporation a permanent easement for the installation and operation of.a pipe line, which easement is more particularly described as follows, to - wit: Being a part of the northeast quarter of Section 32, Township l4s north, Range 1, west, in the City of Richmond, Indiana, and being 10 feet in equal width on each side of the following described centerline, to -wit: Beginning at a point in the east line .of the north- east quarter of said Section 32, said point being 366.10 feet south of the northeast corner of said northeast quarter,: and running thence from said be inning point, south 74 degrees and 14 minutes west, 2:9.22 feet to an iron pipe and the end of this de- scription. In addition to the above described twenty (20) foot permanent easement, Grantor transfers and conveys to Grantee_a temporary ease- ment twenty-five (25) feet in equal width on each side of the above described centerline for the purpose of installing said pipe line in said permanent easement, upon completion of said installation, said temporary fifty (50) foot easement shall terminate. Said permanent easement shall be for the purpose of permitting Grantee to lay, install and forever maintain in and along said right- of-way a water pipe for the purpose of conducting water through said pipe in connection with the furnishing of water to the City of Rich- mond, and the surrounding community. Grantee shall have at all times _ j 4 . �. i r i _ , a J 1 }� - 2 - the right to inspect, repair, improve, make additions thereto, re- place and generally maintain said water line, and to do all things necessary and proper to the efficient operation of said line and equipment connected thereto. Said pipe shall be installed and maintained across said ease- ment at the sole expense of Grantee, and as to that portion of said pipe that Grantee shall place below the surface of the earth, Grantee agrees to promptly restore said surface to as good a condition as the same was immediately prior to said work being performed. Grantee agrees to save Grantor harmless from any loss, damage or liability arising during the installation or use of said pipe. The rights herein granted shall be available to Grantee, its successors or assigns, and all terms and conditions affecting the same shall apply to any and all fixtures and appliances properly and necessarily connected thereto or used in connection therewith. McAndrew President Grantee And WHEREAS, said Easement Agreement has been submitted by said Board of Public Works and Safety of the City of Richmond to the Common Council of said City for its consideration and action thereon; THEREFORE, Section 1. Be It Ordained by the Common Council of the City of Richmond, Indiana, that the foregoing Easement Agreement made and entered into on the 9th day of March, 1961, by the City of Richmond, by and through its Board of Public Works and Safety, and the Richmond Water Works Corporation, be and the same is hereby in c f � .. � .,. Section 2. This ordinance shall take effect and be in force from and after its passage.
