RESOLUTION NO. 2023-07-07
A RESOLUTION OF THE FRASER BOARD OF TRUSTEES, ACTING AS THE LOCAL
LIQUOR LICENSING AUTHORITY FOR THE TOWN OF FRASER, APPROVING THE
APPLICATION FOR RENEWAL FRASER TAP ROOM, DBA TIN CUP TAVERN., FOR
TAVERN LIQUOR LICENSE FOR THE PREMISES AT 511 ZEREX STREET, UNIT 103,
FRASER, CO 80442
WHEREAS, Fraser Tap Room dba Tin Cup Tavern., (the "Applicant") filed a renewal
application with the Town of Fraser for a tavern liquor license for the premises located at 511
Zerex Street, Unit 103, Fraser, CO 80442; and
WHEREAS, Town Clerk is aware that the licensee has violated provisions of the
Colorado Liquor or Beer Codes or associated regulations during the preceding year,
therefore, the Town Clerk cannot process the renewal request administratively, the
request must be approved in a public hearing by the Board of Trustees, acting in their
capacity as the local licensing authority.
WHEREAS, a Stipulation, Agreement and Order was signed On December 16,
2021, and as a part of the stipulation the remaining (3) day suspension was held in
abeyance until satisfaction of the following two conditions: (A) No violations of the
Colorado Liquor or Beer Codes for a period of one year and (B) proof of Responsible
Alcohol Vendor Training for all servers with in six months of the order.
WHEREAS, there have been numerous incidents that required Police Department
attention and three liquor license violations since December 16, 2021 and
WHEREAS, a public hearing on said application was held on July 19, 2023, following
due and proper notice, in accordance with the Colorado Liquor Code, C.R.S. 44-3-101 et seq.;
and
WHEREAS, the Board of Trustees, as the Local Liquor Licensing Authority, has carefully
considered said application and the evidence presented at the hearing, and hereby enters the
following decision regarding the application.
THE BOARD OF TRUSTEES, AS THE LOCAL LICENSING AUTHORITY, HEREBY ORDERS
THAT THE APPLICATION OF FRASER TAP ROOM DBA TIN CUP TAVERN FOR A TAVERN
LIQUOR LICENSE FOR THE PREMISES AT 511 ZEREX STREET UNIT 103, FRASER, CO
80442, BE AND IS HEREBY APPROVED WITH THE FOLLOWING CONDITIONS:
1. Approval by the Colorado Department of Revenue of the State liquor license application.
2. Proof of Responsible Alcohol Vendor Training of all employees within three months.
3. Probation period of three months. The licensee will appear before the Liquor Licensing
Authority, in October 2023.
4. Limit hours of operation to close at midnight.
