HomeMy Public PortalAbout009-2000 - recognizing AFSCME as bargaining unit for Sanitary District EmployeesBOARD OF SANITARY COMMISSIONERS RICHMOND SANITARY DISTRICT RESOLUTION _ 2000 A RESOLUTION REGARDING THE RECOGNITION OF AFSCME AS THE BARGAINING AGENT FOR SANITATION DEPARTMENT EMPLOYEES WHEREAS, the Board of Sanitary Commissioners for the Richmond Sanitary District has been presented a Petition by the employees of the Sanitation DepartmenSD) requesting the recognition of the American Federation of State, County & Municipal employees (AFSCME) as their bargaining agent for all employee matters; and WHEREAS, WHEREAS, WHEREAS, by Indiana law and Richmond Code, RSD must make a decision regarding whet her to accept or not accept the recognition of AFSCME as the bargaining agent; and RSD acknowledges there are legitimate concerns by employees of the Sanitation Department, which many employees believe can only be resolved with the involvement of a third party bargaining representative; and although RSD respects the views of the Sanitation Department employees, the Board believes there are more direct and satisfactory methods by which to deal with the employee concerns which will lead to the same, if not better, results as are expected with union representation; and WHEREAS, RSD recognizes that the concerns of the employees must be dealt with immediately and to the satisfaction of the employees in order to justify RSD's action regarding the question of union recognition and must include specific ste s some of which are described herein; and p WHEREAS, the concerns of the employees include, but are not limited to, communication management; a fair grievance procedure; job responsibilities; job security and with basic employee respect and recognition; and WHEREAS, as currently presented, the Petition for AFSCME recognition also includes representation for a number of employees RSD believes are more app opriately defined as supervisory and/or managerial employ and inion ees who should have not been included within the Petition, many of which employees agree with such o; , WHEREAS, the inclusion of supervisory and managerial employees in union representation could adversely affect necessary employment practices and procedures. NOW, THEREFORE, BE IT RESOLVED BY THE RSD BOARD AS FOLLOWS: 1. At this time, RSD declines to recognize AFSCME as the bargaining agent for the Sanitation Department employees. 2. The entire concept of private /public management through an organization such as EA -2 must be revisited in order to ascertain whether proper employee relationships can continue with the use of such private management. 3. Necessary RSD funds must be appropriated to create a new human resources position, as part of the City's Human Resource Department, who will serve on site with RSD in order to deal directly and immediately with all Sanitation Department concerns. 4. RSD shall immediately consider whether any employee job security can be increased through the use of RSD Resolutions or Ordinances in order to protect employees through the change of any future administrations. 5. RSD shall participate in any new, separate, independent job grievance committee which is anticipated to be implemented by the City Administration for all employees as part of the Human Resources Department. 6. This Resolution should not be construed as a permanent opposition to union representation at all times, but should solely be viewed as an indication by RSD and hope thereby to resolve employee concerns directly, without the need for third party representation.
