A RESOLUTION OF THE BOARD OF SANITARY COMMISSIONERS OF
THE SANITARY DISTRICT OF THE OF THE CITY OF RICHMOND,
INDIANA, REGARDING PROPOSED WORKS OF IMPROVEMENT AND
RELATED MATTERS
WHEREAS, the Board of Sanitary Commissioners (the "Board ") of the Sanitary District (the
"Sanitary District ") of the City of Richmond, Indiana (the "City "), desires to authorize and issue
sewage works revenue bonds payable solely from the net revenues (herein defined as gross revenues
after deduction only for the payment of expenses for Operation and Maintenance (as defined in the
Financial Assistance Agreement to be entered into between the Sanitary District and the State of
Indiana in connection with the issuance of such bonds)) of the sewage works of the Sanitary District,
in an aggregate principal amount not to exceed Two Million Three Hundred Thousand Dollars
($2,300,000) to procure funds, to be applied to the costs of replacing the walls of two existing
anaerobic digesters as part of the sludge handling facilities at the Sanitary District's Treatment Plant
(the "Project "), together with all expenses necessarily incurred in connection with the proceedings
relating thereto. including all expenses permitted by Indiana Code 36- 9 -25 -27 and all expenses
incurred in connection with the issuance of the bonds therefor; and.
WHEREAS, upon investigation it has been determined that the East Fork of the Whitewater
River and certain tributaries thereof in the City are being polluted by the discharge of sewage,
drainage and other harmful matter from the sewage and drainage systems of the Sanitary District;
and
%'WHEREAS, the Project is necessary for the public health and welfare of the citizens of the
Sanitary District: and
WHEREAS, the acquisition, construction and installation of the Project will be of public
utility and benefit to prevent the pollution heretofore mentioned; and
WHEREAS, plans and specifications for the Project, together with a plat showing the general
scope of the Project and the location and bounds of real property which will be affected by the
Project, and the engineer's estimate of the costs thereof, are on file in the office of the Secretary of
the Board located at 2380 Liberty Avenue, Richmond, Indiana, which plans, specifications and cost
estimates can be inspected by any interested person; and
WHEREAS, the Board finds that it will be necessary and in the best interest of the Sanitary
District to issue one or more series of sewage works revenue bonds of the Sanitary District which
shall be payable solely from the net revenues of the sewage works of the Sanitary District in an
aggregate principal amount not to exceed Two Million Three Hundred Thousand Dollars
($2,300,000), to procure funds which will be applied to the costs of the Project, together with all
expenses necessarily incurred in connection with the proceedings relating thereto, including all
expenses permitted by Indiana Code 36- 9 -25 -27 and all expenses incurred in connection with the
issuance of the bonds therefor;
NOW, THEREFORE, BE IT RESOLVED by the Board of Sanitary Commissioners of the
Sanitary District of the City of Richmond, Indiana, as follows:
Section 1 . The Board proposes to issue and sell negotiable sewage works revenue bonds of
the Sanitary District payable solely from the net revenues of the sewage works of the Sanitary
District in an aggre <�ate principal amount not to exceed Two Million Three Hundred Thousand
Dollars ($2,300,000), to procure funds which will be applied to the costs of the Project, together with
all expenses necessarily incurred in connection with the proceedings relating thereto, including all

expenses permitted by Indiana Code 36- 9 -25 -27 and all expenses incurred in connection with the
issuance of the bonds therefor.
Section 2 . The Board finds, upon investigation. that the East Fork of the Whitewater River
and certain tributaries thereof in the City are being polluted by the discharge of sewage, drainage and
other harmful matter from the sewage and drainage systems of the Sanitary District.
Section 3 . The Board finds, upon investigation, that the Project will be of public utility and
benefit to all of the citizens of the Sanitary District and that it is necessary for the public health and
welfare to acquire, construct, install and equip the Project.
Section 4 . The plans, maps, specifications and drawings prepared in connection with the
Project, together with the estimated cost of acquiring, constructing, and installing the same, are
hereby adopted.
Section 5 . The Secretary of the Board is hereby authorized and directed to schedule a public
hearing on the adoption of this Resolution at which the Board will receive and hear remonstrances
of persons affected by such procedure and determine the necessity, public health, utility and benefit
of the Project and take final action ratifying and confirming or rescinding this Resolution. The
hearing shall be held at a meeting of the Board, and the Secretary of the Board is further authorized
and directed to publish notice of such hearing at the time and in the manner provided by law, all in
accordance with the provisions of Indiana Code 36- 9- 25- 18(c).
Section 6 . This Resolution shall be made available for inspection during normal business
hours by all persons interested in or affected by the Project at the offices of the Board at 2380 Liberty
Avenue, Richmond, Indiana.
