WHEREAS,, an Jan43ary 8, 1958, one Merl F. Mills, the own.er of certain territory tory within the 2 mile akea zone of , Richmond, waayne County, Indiana, Ti Ad a petition requesting the rezoni.nj of said territory from "Suburbah" to ofLimi.ted Industrial"; thereafter the same was referred to the City Plan Cokamisaion by the Common Council of the City o2 Ricbnond, Indiana. WHEREAS, thereafter the City. Plan Cowmission gave notice of a public hearing tb be held on February 25, 1958 to consider the pro- posed amendment changing the use of the bereinbel.ow described territory from "Si burban" to "'Limited industrial" and said notice was advertised in `be Richmond Palladium -Item on Yebruary 13, 1958, and the same contained the following descri.p•�ion of the, territory under consideration, to­�;its "A part of Southeast Quarter of Section 35, To ,Yg ahip 14 North, Ranee 1 West, described as follmyss Beginning 495 feet east ®f west line of said Quarter Section, said west line being in Reservoir Road, aTid 405.9 .feet anonth -of center line of "Old National Road," thence north 509.03 feet to south line of a Ro&d formerly 'knov7a -as U. S. Hi.gb ay Mo. 40, thence eastwardly, along said south lint of Road 158.62 f,3et, thence southeast- wardly, along easterly boundary of land now or formaerl.y oumed by Merl F. Mills and harm N. Mills, 509.70 feet (more or less) -to sou tbeas t corner of land now or formerly w4ned by Karl F Mills and harry N. Mills,, thence vest 184.62 feet to place of beginning." Mills -spoke on his own be- half and George Rel.ler, attorney, spoke an.behalf of certain remotnm strantsa that subsequently, on the llth day of March., 1958, the City Plan .Commission voted 71 - ®', �o 'reconaexnd to douncil- that the petition be denied. WHEREAS, on the\ l8tb day of March, 1958, the City Council of Richmond, Indiana passed. Ordinance Woo 1.661-1958, over the adverse recomriendation of the City Plan Gowint ission by a vote of 7 m 0, the same being three -fourths of the members elect of the said Coawon Council; however, -the description of, Atbe territory to be reP-oned as contained in said Ordinance inadvertently and throu b a clerical'error, failed to include the f'ul.l description as set forth in the petition and as advertised, considered and voted on by the City Plan Commission.
