HomeMy Public PortalAbout1639-1957 - Amending An Ordinance Approving a Contract by The BOW & Indiana Railroad ORDINANCE NO. 109 - 1957 AN ORDINAeOE AMIDITG MI ORDINANCE APPROVM A CONTRACT BY TEE BOARD OF PUBLIC WORM OP RICHMOND, IATIANA AND THE RECEIVER OP THE INDIANA RAILROAD FOR USE OF PUBLIC STREETS BY MOTOR BUSES IN THE CITY OF RICEMOOpIEDIANA, APPROVED Jai-mare- le ; 1938 BE IT ORDAINED BY COMMON COUNCIL OF TMT CI OF RECD500p IATIANAs SECTION Is Whereas, because of various faollities affecting public bus trememortationl over which the Richmend City Lines, Imo., aseignees of the franehise granted is OrdinsUaerna.-1937 has no control, its revenue has been substantially reduced and its servicee censequently curtailed, ands Whereas, it is believed that the elimization of the license fee agreed to be paid to the City of Richmond; Indiana will assist said Richmond City Lime, Inc. in continuing its public motor bus service and thus be im the interest end welfare of the citizens of Richmond, an Whoreasp by agreement dated August A , 1957 by the Board of Public Works and Safety of the City of Richmond, Iana, the paid Board has consented to the elimination of the provision in said ordinance re- • quiring a -payment of a license fee for the right to operate otor buses in the City of Richmond. • Whereas, said Board recelemeended to the said Common Council of the City of Richmond that said ordinanos be =ended, eliminating said license fee. SECTION II It is hereby ordained that Section 6 of (kdiaance 0.161-1937 be amended by striking out that pert of Section 6 thereof which reads as follows, to-wits "6. It is further understood ana weed that In consideration of the grant of the franchise as herein set out, the said Railroad shall pay to said City, annually ie advance, the sum of One Hundred Dollars ($100.00) for each regularly soheduled bus operated by said. Railroad pyrouant to the terms of this franchise ama that the prompt payaeut of said annual license fees to said City by said. Railroad stall be necessary to keep this franchise in force and effect for the purposes herein maned. nIt is understood and agreed that such license fees shall be based upoa the number of buses regularly required to maintain the schedules and routes covered by this franehlee and that no fee shall be required for extra or tripper buses which may be necessary to neet transportation requirements beyoeid such regular schedules." SECTIOik! III It is further orifialmed that the said. Cemmon Council hereby approves in all respects, the agreement acending the motor bus con- tract executed by and between Richmond City Lines, Ito. and the Board of Public Works aad Safety of Richmond, Indiana, aud dated the 9th day of August, 1957. SECTION IV This ordinance shall be in Tull force and effect from and after its passage and approval of the Mayor.
