THRASHER DATE: August 3, 2012 TO: Toam Commission RE: 4001 North Ocean Blvd. West Side of AlA Since the annexation of the County Pocket, the Town has met with the developer and/or his representatives concerning the site development of the west side of 4001 North Ocean Boulevard. Throughout this time several concepts were presented and discussed starting with a 7 unit multi - family complex. During many of these discussions Mayor Koch was very concerned and therefore expressed his opposition to the proposed number of units and the architectural style and quality of design. As a result of his concerns the developer actually started over by selecting a new architect. What you have been provided is a model that Mayor Koch was prepared to support. What is very important to recognize is that this proposal complies with either the County's land use regulations as of the date of annexation or the land use regulations planned for the West parcel by the Town. Recommendation: It is recommended that the Town agree to the stipulation presented for the following reasons: 1. Mayor Koch was in support of the current proposed site plan, architectural design and density. 2. The developer has substantially modified previous plans to conform with the intent of the Town's land use regulations. 3. The location of the garages, except one, have been relocated trying to avoid being viewable from NOB. 4. Because one garage still faces NOB, additional layers of landscaping has been proposed in this current plan. 5. This stipulation agreement, if signed by the Commission, eliminates certain legal action by the applicant. C C STIPULATION 012 -0 This Stipulation is entered into between counsel for OK Seahorse, LLLP and the Town of Gulf Stream, Florida this N Hof July, 2012. WHEREAS, OK Seahorse, LLLP ( "the Owner ") are owners of a 3.49 +/- acre parcel in Palm Beach County, Florida located at 4001 North Ocean Boulevard ( "the Property "); and WHEREAS, on March 15, 2011, the Property was annexed from Palm Beach County ( "County ") into the Town of Gulf Stream ( "Gulf Stream "); and WHEREAS, it is the Owner's position that it has vested entitlements from the County to develop seven units on the Property as of the time of annexation; and WHEREAS, counsel for Gulf Stream and Owner have been in discussions over several months in an effort to avoid litigation with respect to development of the West Parcel that would serve as a compromise; and WHEREAS, counsel, together with representatives of their respective clients, have met to discuss possible ways to amicably resolve the dispute concerning Owner's claim of vested development rights on the West Parcel and Gulf Stream's desire to implement new development regulations on the West Parcel; and WHEREAS, as a result of those meetings and discussions, Owner has prepared proposed revised plans for consideration by Gulf Stream that Owner states comply with either the County's land use regulations as of the date of annexation or the land use regulations planned for the West Parcel by Gulf Stream; NOW, THEREFORE undersigned counsel for the parties hereto stipulate as follows: 1. The above recitals are incorporated herein. 2. As a result of settlement discussions, Owner has prepared a set of revised plans for development of the West Parcel which seek to incorporate many of Gulf Stream's regulations planned for the West Parcel. These plans are attached as Exhibit "A." C C 3. Owner agrees that the plans attached as Exhibit "A" will be submitted to the Town and considered by the Town Commission, at a duly noticed public hearing, for review, and if acceptable to the Town Commission, approval by the Town Commission in connection with a pre -suit settlement. 4. This matter will be presented to the Town Commission at the duly noticed August 10, 2012 public hearing, prior to which time there will be review by the Architectural Review and Planning Board at their July 19, 2012 meeting. 5. Owner is submitting the attached plans and related documents to Gulf Stream in aid of compromise and settlement of a disputed claim and is doing so without waiving any of its rights, claims or defenses in the event that the Town Commission does not approve the attached plans after public hearing and a vote. Likewise, by considering and voting on the attached plans, the Town is not waiving any rights, claims or defenses to contest Owner's assertion of vested rights as to the West Parcel. 6. In the event the Town Commission does not approve the attached plans, the preparation, submittal, consideration and vote on the attached plans, as well as the forbearance of Owner in not submitting an application for development under the County's land use regulations, may not be used adversely against either party in any subsequent proceedings. First Point: While this plot is zoned for multi - family and the Gulf Stream rules permit five (5) residences, we respectfully urge the commission to be cognizant of reasonable space should be provided to protect Polo Ridge residence privacy. Hence, the Polo Ridge Home Owners respectfully propose this project be approved for four (4) residences. The proposed project only allows 16' of space between properties. The consequence of the five unit proposal will literally eliminate the privacy of our four northern residences. This will dramatically impact the privacy Polo Ridge residents deserve while bathing, sleeping and pool area entertainment and relaxation. The Polo Ridge Homeowner's Association formally opposes the site plan for the so-called West Side Villas on the basis that it consumes far too much space on a small lot and is too close to the northern property line of our Town House complex. Polo Ridge homeowners will be exposed to almost wall -to -wall viewing into private swimming pools, bedrooms, and other areas which deserve privacy. From our point of view, the West Side Villa proposal is flawed and inconsistent with the existing character of Gulf Stream. Given the shape of the property (narrower on the north than south) I suspect that flipping the two buildings as currently designed is an impractical solution, but there is no reason not to suggest it. I was unable to decifer some of the handwritten notes on the pdf, but I understand that you feel the southern building is too close to your property line. Given my unique circumstance of being a reviewer, recommender, and possibly approver of this project, I hope that you and other affected neighbors understand that I must keep an open mind and deal only with the facts. The ARPB was most concerned with lot coverage, which in tum relates to setbacks, massing, open space and the like. The developer heard our concerns and hopefully will adjust his current plan accordingly, before presenting to the Commission. We'll know in three days. I remind you that the ARPB was presented with a Stipulation Agreement prior to reviewing the plans which state that the Owner believes that the site plan complies with "either the County's land use regulations as of the date of annexation or the land use regulations planned for the West Parcel by Gulf Stream ". The former is undeniable, as the County would have allowed more mass and density. The latter can only be achieved through compromise, as there are elements of the proposed plan that are both outside and within the Multi Family zoning codes pertaining to the Annexed area. The developer believes (apparently) that minor physical differences can be mitigated by lush landscaping, privacy walls and the like. It is up to him to prove his case. It took almost two hours to hear and discuss the developer's presentation, and we had all the drawings and blueprints in front of us. The neighbors are at a clear disadvantage in trying to understand how their privacy, quality of life, and property value might be affected by this development. I think it is wonderful that you can be hooked into the Commission meeting via telephone, but it would be a lot better if we had camera capability in the Chambers. But that's another matter. Mrs. Taylor indicated that the current plans place the larger structure (of the two, with three of the five units) adjacent to US. The larger structure she said is the taller structure, and will be 351" tall (30'8" excluding roof.) Both these numbers exclude any dirt mound that will be underneath as it's by the ocean. They are requesting to place the structure at at least some point sixteen feet closer to the property line than the law would otherwise allow. The structures have 6% more roofed area than the zoning allows. The structures are "two stories" with the roof of course expect it to be a three story view blockage. In addition to the two car garage each unit will have, they will additionally be placing four outdoor parking spots, two of which will be readily visible from the street (almost on it). The five units the developer is building will have access to the pool facilities of the seahorse across the street. Father you asked if I think we should be alarmed, maybe. As there is little to nothing we can probably do about it maybe we could settle with their zoning variances in exchange for otherwise unpaid deeded access to their pool and beach facilities. (It's not like it would cost him anything and we're probably the only real potential impediment to his plans approval.) P.S. Mrs. Taylor (Gulfstream town hall) says that for deeded easements, like the Ballantine Easement (North side of seahorse complex ?), Florida law doesn't allow for the public to use it. The latter application began its life several years ago, when the property was located in the Unincorporated County Pocket. Minor, AICP DATE: July 20, 2012 RE: WEST SIDE VILLAS - 4001 NORTH OCEAN BOULEVARD ■ REVIEW MEMORANDUM k I da STUDIOS Urban Planning and Design Landscape Architecture Communication Graphics The following is a zoning analysis of the proposed West Side Villas project, located on the west side of 4001 North Ocean Boulevard. Request The applicant is seeking Level 3 Architectural Site Plan Approval for a triplex and duplex (five total units) on 0.97 acres on the west side of North Ocean Boulevard. The proposed two -story units range in size from 4,343 square feet to 4,930 square feet. Background On July 14, 2010, the Palm Beach County Development Review Officer approved a site plan for 4001 North Ocean Boulevard, which was also known as the Seahorse property. The approved site plan was split into two phases. The first phase was approved for a six - story, 34 unit, multi - family building on 3.49 acres on the east side of North Ocean Boulevard. This building is currently under construction. No development program was approved with the site plan's Phase II, which is located on the 0.97 acres of the subject site. This land is currently being used as the construction staging area for the Phase I construction. In March 2011, the Town annexed 16.6 acres of land, including the subject site, by referendum. Prior to the current construction activities, the subject site was used for tennis courts and parking. Land Use & Zoning When the subject 0.97 acres were annexed into the Town, the property had a Palm Beach County Future Land Use designation of HR -12 (Residential High —12 dwelling units per acre) and a zoning designation of RM (Residential Medium). After the annexation, the Comprehensive Plan, Zoning Map and Zoning Code were amended to include these parcels. The subject site has a Town Future Land Use designation of Multi - Family, which allows up to 5.7 dwelling units per acre. The site also has a RM -West zoning designation. For the 0.97 acre site, the property can have up to five dwelling units on site under 477 S. Architecture The southern triplex has an Anglo- Caribbean architectural style with exposed rafter tails and hipped and gable roofs. The building is proposed to have a stucco walls, painted shutters and flat concrete roof tiles. The buildings' eave heights are consistent with Town standards. The slope of the proposed roof appears to be consistent with the preferred slope of 6:12. The architectural elevations should be revised to label the proposed slope of the roofs. Window panes proposed range in size from 2 to 5 square feet in size. The Town's multi- family design regulations call window panes 2 square feet or less as preferred and those larger than 2 square feet are discouraged. There are no window panes larger than 16 square feet, which is prohibited by the Town's design standards. There are several items within the proposed buildings which may be inconsistent with the Multi - Family Residential Design Guidelines (Section 71 -7). These items are: 1. The two buildings feature numerous setbacks within the building facades. There are two fa4ade lengths proposed which exceed the preferred distances of the Town's design regulations. The northern elevation of the southern building, facing the interior motor court, is approximately 45 feet in length. Flat facades more than 50 feet in length are prohibited. The rear, western elevation of the northern building has a 54 foot long fagade which is shared by both units. 2. Having more than 40 percent of an elevation as window openings is prohibited in the Multi - Family Design Guidelines. It appears that the western (rear), first -floor elevation for the triplex and duplex exceed this standard. The elevations should be revised to address this standard. 3. Elevations for the proposed vehicular gates on site should be provided for review. 4. Details of the entry doorways should be provided for review. Landscaping Requirements The applicant is proposing an informal, tropical landscape plan for the two buildings, with more than 125 trees and palms to be located on the 0.97 acre site. The plan provides for a 10 -foot wide buffer along North Ocean Boulevard and five -foot wide buffers adjacent to the single family homes to the west and multi - family homes to the north and south. The landscape plan has several issues which will need to be addressed by the applicant. These issues are: 1. The applicant is proposing Australian Pines along North Ocean Boulevard right - of -way. The Town's Comprehensive Plan and zoning regulations do not allow Australian Pines outside of the North Ocean Boulevard corridor between Pelican Lane and Sea Road. The subject site is outside of this corridor. As the Australian Pines are not permitted by the Comprehensive Plan, a variance request for the trees is not an option. The pines should be removed from the landscape plan. 2. Section 66- 397(c) of the Town's Code of Ordinances requires a specific landscape buffer between multi - family and single - family homes. The Town Code requires a hedge to be located at least seven feet from the joint property line. The hedge is required to be maintained at seven (7) feet in height. The subject site is adjacent to single family homes on its western boundary. The applicant is proposing a four -foot high wall with a variety of trees, palms and shrubs within a five -foot wide buffer. The proposed buffer is inconsistent with the code provisions. The applicant should either request a variance and provide justification for the proposed buffer or revise the plan to include the required hedge. 3. The applicant shall indicate the amount of landscaped open space and the pervious and impervious areas on the revised plans. The plans should also indicate light pole locations, drainage facilities and utility lines /easements so conflicts with landscaping can be avoided. Mr. William Thrasher West Side Villas Review Variances July 20, 2012 Page 6 The submitted application includes numerous inconsistencies with the Town's Code of Ordinances. The applicant should either conform with the Town's regulations or seek a variance while providing justification for the change. These code inconsistencies, as outlined above, are: 1. Front setback for detached garages; 2. Side setback for primary buildings and detached garages; 3. Maximum building length for triplex and duplex buildings; 4. Maximum facade length without a jog or reduction of stories; 5. Lot coverage; 6. Percentage of window openings on elevation for western elevations; and 7. Landscape buffer between multi - family and single - family homes. Analysis It is recognized that development of an infill parcel, such as this one, is difficult as the surrounding built environment impacts the design and construction on the parcel. This difficulty is compounded when the surrounding development was approved and constructed based on a different set of development regulations. It is recommended that the applicant provide the additional information requested in this memorandum for review by the Town. In addition, the applicant should review the above list of possible variances to Town Code to see if any revisions can be made to be code compliant. Any variance requests will need to feature justification statements for the review of the Town.
