A RESOLUTION APPROVING AN IRRIGATION EASEMENT AGREEMENT BY AND
BETWEEN MOAB 21 LLC AND THE CITY OF MOAB
WHEREAS, the Irrigation Easement Agreement is attached to this Resolution; and
WHEREAS, Moab 21 LLC intends to purchase property (hereafter "Moab 21 LLC's Prospective
Property") described in the legal description shown as Exhibit B of said Irrigation Easement
Agreement; and
WHEREAS, Moab 21 LLC is in negotiation with the current owners of Moab 21 LLC's
Prospective Property to purchase Moab 21 LLC's Prospective Property; and
WHEREAS, upon purchase of Moab 21 LLC's Prospective Property, Moab 21 LLC wishes to
install irrigation improvements on City -owned property described in Exhibit A of said Irrigation
Easement Agreement; and
WHEREAS, said irrigation improvements will not interfere with City of Moab's use of said City
owned property; and
WHEREAS, the Irrigation Easement Agreement provides for the City of Moab to grant a 12-
foot wide easement to Moab 21 LLC for the purpose of installing and maintaining irrigation
improvements.
NOW, THEREFORE, we the Governing Body of the City of Moab do hereby resolve approve
the attached Irrigation Easement Agreement upon receipt of verifiable documentation that Moab
21 LLC has purchased and is the legal owner, holding fee simple title, of land described in
Exhibit B of the Irrigation Easement. We authorize the appropriate parties to execute and deliver
said agreement after receipt in the City Recorder's Office of the aforementioned verifiable
documentation.
Passed and adopted by action of the Governing Body of the City of Moab in open session this
9th day of November, 2010.
