RESOLUTION OPPOSING PROPOSED ASSEMBLY BILL A-1910
AND SENATE BILL S-976
WHEREAS, a legislative proposal known as Assembly Bill A-1910 and Senate Bill
S-976 would drastically modify, the "Time of Decision" rule which allows a
municipality to adjust its zoning in response to a development application pending
before the community's Planning Board or Board of Adjustments; and
WHEREAS, this power is critical to a municipality as a tool to clarify its intention
relative to zoning of properties, as well as functioning as a mechanism to update
zoning in response to uses which may have been unanticipated or non-existent at the
time the Zoning Ordinance was adopted; and
WHEREAS, the New Jersey Supreme Court has upheld the right of a municipality
to exercise this important zoning power; and
WHEREAS, the only group who would be interested in depriving a municipality of
this power would be builders and developers seeking to implement development plans
which when examined in detail by a municipality proved to be detrimental to its
residents; and
WHEREAS, this legislation, if enacted, would continue top chip away at ability of
a municipality to determine local matters in the best interest of its residents.
NOW, THEREFORE, BE 1T RESOLVED by the Mayor and Council of the
Borough of Carteret that it staunchly opposes Assembly Bill A-1910 and Senate Bill
S-976.
BE IT FURTHER RESOLVED that copies of this resolution be sent to the

legislation.
