HomeMy Public PortalAboutAddendum No. 1 to Contract No. 34-2021 - I&D - TRC Environmental - Environment and Immediation for Council Chamber � f ADDENDUM THIS ADDUM, (Number 1 to Contract No. 34-2021) is made and entered into this i day of ,�f , 2021, by and between Richmond, Indiana, a municipal corporation acting through its Board of Public Works and Safety with its office at 50 North 5th Street, Richmond, Indiana, 47374 (hereinafter referred to as "City"), and TRC Environmental Corporation, 11231 Cornell Park Drive, Cincinnati, Ohio, 45242 (hereinafter referred to as"Contractor"). WHEREAS, City and Contractor entered into Contract No. 34-2021 on March 11, 2021, which Agreement retains Contractor to perform services to conduct an environmental inspection and remediation of potential asbestos-containing materials ("ACM") which may be located in the third-floor Council chambers of the municipal building for the City of Richmond,Indiana; and WHEREAS, The Parties have agreed the Contractor shall also perform fireproofmg replacement following the remediation services to be performed. NOW, THEREFORE, in consideration of the mutual promises and covenants herein contained, including the above stated recitals, City and Contractor hereby agree as follows: 1. The City and Contractor executed and entered into Contract No. 34-2021, on March 11, 2021, which Agreement is incorporated herein by reference. Pursuant to Contract No. 34-2021, Section XI (Miscellaneous), the Parties may alter or amend the Agreement in whole or in part at,any time by filing with the Agreement a written instrument setting forth such changes signed by both Parties. The Parties agree the Contractor shall also perform fireproofmg replacement following the remediation services to be performed in accordance with the scope of said Agreement. Said purchase shall be completed and delivered in a manner consistent with Contract No. 34-2021, which is hereby incorporated by reference and made a part hereof. Compensation paid to Contractor as described in accordance with Section III (Compensation) of said Agreement for said additional services shall be increased by an amount not to exceed Six Thousand Four Hundred Dollars and Zero Cents ($6,400.00) reflected within Contractor's quote, dated March 12, 2021, and attached hereto as Exhibit A to this Addendum, which quote is incorporated herein by reference. The new total amount to be paid to Contractor under the Agreement shall be an amount not to exceed One Hundred Eight Thousand Eight Hundred Fifty Dollars and Zero Cents ($108,850.00). 2. City and Contractor expressly agree that all other terms, conditions, and covenants contained in Contract No. 34-2021, shall be applicable to this Addendum, unless such term, condition or covenant conflicts with this Addendum Number 1, in which case this Addendum Number 1 shall be controlling. Both Parties hereby agree that with the exception of the additional services to include the fireproofing replacement to follow the remediation services to be performed, and with the exception of the corresponding compensation increase, Contract No. 34-2021 shall remain intact and unchanged and in full force and effect. 4. Both Parties agree that any person executing this Contract in a representative capacity hereby warrants that he or she has been duly authorized by his or her principal to execute this Addendum. Cincinnati,OH 45242 TRCoompanies.com March 12, 2021 City of Richmond, Indiana 50 North 5th Street Richmond, IN 47374 Attention: Ms. Beth Fields Director of Infrastructure and Development Reference: Fireproofing Replacement City of Richmond Municipal Building Council Chambers-Third Floor TRC Project No. 433356.0000 Dear Ms. Fields: TRC Environmental Corporation (TRC) is pleased to submit this proposal to the City of Richmond, Indiana (the City) to provide fireproofing replacement following asbestos remediation services at the City Municipal Building located at 50 North 5th Street in Richmond, Indiana. PROJECT UNDERSTANDING The City has initiated renovation activities in the Council Chambers on the 3rd Floor of the City's Municipal Building. During the course of the renovation activities, City representatives identified potentially regulated friable' or non-friable asbestos-containing material2 (ACM) that required abatement prior to continuing renovation activities. Upon discovery of this situation, renovation contractor personnel were issued a stop-work order, the Council Chamber was cordoned off and the City contacted TRC to conduct an ACM inspection of the Council Chamber. On February 25, 2021, Mr. Steve Lipez, a State of Indiana Certified Asbestos Inspector, mobilized to Richmond for the purpose of inspecting the contents of the Council Chamber. Mr. Lipez's visual inspection identified suspect materials within the Council Chamber as potential ACM and that the ceiling had been damaged during renovation activities. Mr. Lipez also observed laminated fireproofing material above the ceiling as potential ACM. As a result of these observations, Mr. Lipez collected 21 bulk samples of suspect materials, including the ceiling and the fireproofing material.The laboratory analytical results indicated that the ceiling and the laminated fireproofing material is ACM. As a result, TRC, along with our subcontract partner, Central Insulation Systems, Inc. of Cincinnati, Ohio (CIS), have been contracted by the City to undertake abatement of ACM containing ceiling and fireproofing material in the Council Chamber. A 10-day notification of these activities has been submitted to the Indiana Department of Environmental Management (IDEM) and abatement and remediation activities are scheduled to begin on March 22, 2021. The purpose of this cost estimate is to present a scope of work and fee to provide post abatement installation of new fireproofing material in the 3rd Floor Council Chamber. 1 Material that,when dry,can be crumbled,pulverized,or reduced to powder by hand pressure(40 CFR Part 61.141). 2 The U.S.EPA and OSHA define asbestos-containing material as material that contains more than 1%asbestos by weight. F°` t`" • Ms. Beth Fields, Director of Infrastructure and Development The City of Richmond, Indiana Project No. 433356.0000 March 12, 2021 Page 2 SCOPE OF WORK CIS will provide labor, material and equipment necessary to spray Cafco Blaze Shield II fireproofing onto the steel beams and deck where asbestos fireproofing will be removed from above the ceiling in the Council Chambers. This application will match thickness of existing fireproofing to provide a one-hour rating. Items included in this Scope of Work are as follows: 1. One mobilization. 2. Straight Time Rates. 6. Work Hours—Monday through Friday 7:00 am—3:30 pm. Items not included in this Scope of Work include: 1. Prevailing Wage or Davis Bacon Rates. 2. Overtime and Weekends Work. It is assumed that the City will provide water and a 110-volt electric source for CIS equipment to complete the fireproofing application. It is also assumed that the City Building Inspector will be responsible for installation observation and approval of the fireproofing application. Since the fireproofing application is construction and not an ACM abatement activity, TRC is not required to be onsite during CIS fireproofing application. At the request of the City, TRC will provide fulltime oversite of CIS's fireproofing application activities. The activities to be provided by TRC would include: 1. Full-time contractor oversite for two (2), 8-hour work days. 2. Coordination with the City and CIS regarding the fireproofing application. 3. Providing written documentation of the fireproofing activities on behalf of the City. SCHEDULE • Upon authorization, CIS will initiate fireproofing activities within 14 days of notice to proceed. If approval is granted by the City prior to initiation of ACM abatement activities on March 22, 2021, CIS will be able to complete the fireproofing application immediately following completion of ACM abatement on or about April 12, 2021. COST INFORMATION TRC proposes to perform the Scope of Work as described above for the estimated fees included in the Table below. We are prepared to begin work on this scope of work once we receive a Purchase Order(PO)from the City referencing the attached TRC Terms and Conditions. LEXHIBIT,_„&..,PAGE a OF Li 433356.0000/sap 4! TlrR C Ms. Beth Fields, Director of Infrastructure and Development The City of Richmond, Indiana Project No. 433356.0000 March 12, 2021 Page 3 City of Richmond ESTIMATED ACM Services—3rd Floor Council Chambers COST Task 1 —Fireproofing Application $6,400 Task 2—TRC Fireproofing Oversite (Optional) $4,200 Assumptions • Task 1 is CIS cost only and does not include TRC Oversite • Task 2 includes only TRC oversite.This fee will not apply if TRC is not present during onsite fireproofing application activities. • Task 2 includes providing written documentation of fireproofing application activities. Documentation will not be provided if the City inspects and approves the fireproofing application. • These costs do not include any air monitoring, sampling or analysis costs. • These costs assume that the fireproofing application will be completed in 2, 8-hour work days. Invoices for the services presented above will be issued to the City at the completion of the project. Payment is due within 30 days following the date of the invoice. CLOSING If the Scope of Services and Costs presented in this transmittal are acceptable, please issue a PO for the requested amount reflected in the Cost Table above. Please forward the PO to us as our authorization to proceed with the fireproofing work tasks.
