deed by 'Maple Grove Cemetery as grantor, and. the said. City of
Richmond as grantee, said deed being dated. the 8" (lay of
September, 1886, and recorded in Deed Record ,105, page 262,
of the records of the Recorder of Wayne County, Indiana; and

now occupied as a. nublic nark commonly known as a 'part of
Glen Miller Bark, under the control and jurisdiction of the
Board of Park Commissioners of the City of Richmond, Indiana;
and
WHFRrAS) the Board of Park Commissioners of said
City has determined that in the best interest of the City,
its citizens and taxpayers, the use; of said real estate as
a park be terminated, and that the same be used by the School
City as a site for elementary school buildings and grounds,
and that the interest of the.nublic would be best served
and it -would be to the advantage of the citizens, taxpayers
and school patrons of said City to sell. said, real estate to
said. School City for _use as a. site for the construction,
operation and maintenance of an elementary, school to re-
place the present elementary sctiool known as Starr School;
and
WHEREAS, the Roard of Part. Commissioners of said
City wish to sell said hart of the hark lands now owned by
the City of P%ichmond., Indiana, to the School City of Richmond,
Indiana, for use as a school site and by pro'per motion has
nreDared this Ordinance authorizing; such sale and submits the
same -to the Common Council of said City of Richmond; and.

WHEREAS,., the Acts, :of the ',General -Assembly. of the
State of Indiana for the year 1923, being Act3 19239 Ch. 670
Par. �7', page 204, same being -Sec. 48-5608 of -Burns' Indiana
Statutes, 1950.,Re.placement,.authorizes the sale of .such lands
as other lands of the City'are sold;.,
NOW, THEREFORE, BE IT.:ORDAINED by the .Common Council
of the City.of Richmond, Indiana:
Secs. 1., That the City of Richmond, Indiana, sell
-to the'School City'of Richmond, Indiana, as other lands of
the. City -are sold, the following 'described _real est6.te in
Wayne County..' State of, Indiana, . to -wit:
"Being a part of Section . thirty-three-.(33.) , . Town -ship Fourteen

County, State of Indiana,. more particularly described as
follows:

Sec. 2. BE IT FURTHF;R ORDAINED that all Ordinances
or parts of Ordinances of the City of.Richmond, Indiana, in
