HomeMy Public PortalAbout019-2021 - Special - creating new fund - ARP Corona Virus - local fiscal recovery fund COMMON COUNCIL OF THE CITY OF RICHMOND,INDIANA ORDINANCE NO. 19-2021 A SPECIAL ORDINANCE CREATING A NEW FUND(0199)FOR APPROPRIATION TO BE KNOWN AS THE FUND 0199 ARP CORONAVIRUS LOCAL FISCAL RECOVERY WHEREAS, In accordance with directives from the Indiana State Board of Accounts ("SBOA") and Section 9901 of the American Rescue Plan Act of 2021 ("ARP")(hereinafter,collectively, "SBOA mandates"), monies from the funds known as the Coronavirus Local Fiscal Recovery Fund are restricted to certain uses and require that the balances remain in the funds; and WHEREAS, In accordance with said SBOA mandates, monies from said funds may not be transferred to another fund of a municipal unit and the uses of the funds are specified in Section 603(c) of the ARP; and WHEREAS, Said funds must be appropriated by the Common Council of the City as the fiscal body prior to use and all disbursements must be made directly from the ARP grant fund as outlined in the directives;and WHEREAS, With SBOA guidance,the City Controller's office has designated fund 0199,titled"Fund 0199 ARP Coronavirus Local Fiscal Recovery" for the City of Richmond, Indiana, to ensure the monies remain restricted and identifiable in accordance with the ARP and/or the SBOA mandates; and WHEREAS, The City of Richmond desires to establish the new 0199 fund in which to allocate said funds and in which to encompass any additional appropriations which may be authorized in accordance with SBOA mandates. NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that in addition to the above preambles,which are incorporated herein by reference,the following new fund shall be created and established for the appropriation and use of the 0199 ARP Coronavirus Local Fiscal Recovery Funds: 1. ARP Coronavirus Local Fiscal Recovery Funds-Fund Number 0199 NOW, THEREFORE, be it also ordained by the Common Council of the City of Richmond, Indiana, that said funds are restricted as outlined in the SBOA directives and are also restricted in accordance with Section 603(c)of the APR as outlined in said section and summarized in part as follows: 1. Subject to other considerations, a city shall only use the funds provided under a payment made under Section 603 to cover costs incurred by said city by December 31,2024. 2. Funds may be used to respond to the public health emergency with respect to the Coronavirus Disease 2019 (COVID-19) or its negative economic impacts, including assistance to Page 1 of 2 households, small businesses, and nonprofits, or aid to impacted industries such as tourism, travel, and hospitality. 3. Funds may be used to respond to workers performing essential work during the COVID- 19 public health emergency by providing premium pay to eligible workers of a city that is performing such essential work, or by providing grants to eligible employers that have eligible workers who perform essential work. • 4. Funds may be used for the provision of government services to the extent of the reduction in revenue of a city due to the COVID-19 public health emergency relative to revenues collected in the most recent full fiscal year of said city prior to the emergency. 5. Funds may be used to make necessary investments in water, sewer, or broadband infrastructure. NOW, THEREFORE, be it also ordained by the Common Council of the City of Richmond, Indiana, that any funds received for the 0199 ARP Coronavirus Local Fiscal Recovery Funds along with any corresponding matches or any other corresponding grant portions are restricted to the statutory purposes of the 0199 ARP Coronavirus Local Fiscal Recovery Funds. The details for the use of these funds shall be further identified in a plan which has been or will be developed by the Mayor of the City.
