HomeMy Public PortalAboutOrd. 1654ORDINANCE NO. 1654 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ADDING A NEW SECTION 7 -29 TO CHAPTER 7 OF THE LYNWOOD MUNICIPAL CODE ADOPTING SECTION 22511.3 OF THE CALIFORNIA VEHICLE CODE RELATING TO EXEMPTING MILITARY VETERANS FROM PAYING METERED PARKING FEES WHEREAS, on November 7, 2012, the Los Angeles County Board of Supervisors adopted a motion to encourage cities and town councils throughout the County to adopt an ordinance that exempts military veterans with special license plates from paying metered parking; and WHEREAS, AB 190 was authored by Assembly Member Karen Bass to honor the sacrifice and commitment of the many thousands of men and women who have served in our nation's military; and WHEREAS, the measure allows local authorities, including cities and town councils, to adopt an ordinance to exempt military veterans with the following special license plates from paying for metered parking: Pearl Harbor Survivor, Legion of Valor, Former American Prisoner of War (POW), Congressional Medal of Honor, and Purple Heart. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY ORDAIN AS FOLLOWS: Section 1. The Lynwood Municipal Code is hereby amended by adding a new Section 7 -29 to Chapter 7, Vehicles and Traffic, which shall read as follows: Section 7 -29 Vehicles and Traffic Section 7 -29 is added to the Municipal Code to read: (a) A veteran displaying special license plates issued under Section 5101.3. 5101.4, 5101.5, 5101.6, or 5101.8 may park his or her vehicle, weighing not more than 6,000 pounds gross weight, without charge, in a metered parking space. (b) Nothing in this section restricts the rights of a person displaying either a special identification license plate issued pursuant to Section 5007 or a distinguishing placard pursuant to Section 22511.55 or 22511.59. (c) (1) This section does not exempt a vehicle displaying special license plates issued under Section 5101.3, 5101.4, 5101.5, 5101.6, or 5101.8 from compliance with any other state law or ordinance, including, but not limited to, vehicle height restrictions, zones that prohibit stopping, parking, or standing of all vehicles, parking time limitations, street sweeping, restrictions of the parking space to a particular type of vehicle, or the parking of a vehicle that is involved in the operation of a street vending business. (2) This section does not authorize a, vehicle displaying,special,)icense plates; issued under Section 5101.3, 5101.4, 5101.6, or 5101,:8 to park ih a state parking facility that is designated only for state employeesi' (3) This section does not authorize a vehicle displaying special license. plates issued under Section 5101.3, 5104.4, 5101 :5; 5101.6, 'or .5101.8 to park during time periods other than the normal business hours of, or the maximum time allotted by, a state or local authority parking facility. (4) This section does not require the 'state or a local . authority t& designate specific parking spaces for vehicles displaying special.license plates issued under Section 5101.3, 5101.4, 5101.5, 5101.6, or 5101.8. (d) A local authority's compliance with subdivision (a) is 'solely contingent upon the approval of its governing body. ' Section 2. Except as expressly modified . pursuant to this - Ordinance, all, provisions of the Lynwood Municipal Code shall remain unmodified and in full -force and effect. Section 3. If any section, subsection, clause or. phrase of this ordinance is for any reason, held to be unconstitutional, or otherwise invalid, such decision shall not affect the validity of the remaining sections of this ordinance. The`Council hereby declares that it would have passed this ordinance and each;'section, subsection, sentence, clause and phrase thereof irrespective of the fact that: any one or more other sections, subsections, sentences, clauses or phrases be declared unconstitutional. Section 4. This Ordinance shall take effect 30 days after its final passage, and within fifteen (15) days after its passage, the City Clerk shall cause' it to' be` posted as required by law, and hereby designated for.that purpose. First read at a regular meeting of the City Council held on the 18th day,of %December, 2012, and adopted and ordered published .at a regular meeting of said Council on the 15th day of January, 2013.
