COMMON COUNCIL OF THE
CITY OF RICHMOND,INDIANA
ORDINANCE NO. 1-2021
A SPECIAL ORDINANCE EXTENDING UNUSED LEAVE TIME PERMITTED BY THE
FEDERAL EMERGENCY PAID SICK LEAVE ACT
WHEREAS, The United States Congress passed the Families First Coronavirus Response Act in
connection with the COVID-19 outbreak,which Act includes provisions known as the
Emergency Paid Sick Leave Act("EPSLA")for purposes of providing paid sick leave
to employees, and which provisions were to run through December 31, 2020; and
WHEREAS, Any unused paid sick leave provided to employees under EPSLA may be voluntarily
extended by employers until the end of the first quarter of 2021, and the City of
Richmond administration would opt to permit said extension with the support of the
Common Council of the City of Richmond,Indiana,as the fiscal body of the City;and
WHEREAS, It is in the best interest of the City that the City voluntarily opt to carry over any
unexhausted paid sick leave time which may remain available for individual City
employees who have not fully used the allowed number of COVID-19 related sick days
permitted to be taken pursuant to EPSLA.
NOW THEREFORE BE IT ORDAINED,by the Common Council of the City of Richmond,
Indiana,that the Common Council hereby approves and agrees with the extension of the provisions of
the Emergency Paid Sick Leave Act to allow City employees to have access to each employee's
respective unused carry over paid COVID-19 related sick days from the 2020 calendar year that are
available pursuant to said Act,where an individual employee meets applicable criteria set forth in said
Act, where said individual employee meets all other criteria or conditions outlined in the City's
Employment Policy or applicable Collective Bargaining Agreement,and with said approved extension
to expire on March 31, 2021.
