AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD,
CALIFORNIA AMENDING SECTION 2 -1.4 OF THE LYNWOOD MUNICIPAL CODE
TO INCREASE CITY COUNCIL COMPENSATION PURSUANT TO GOVERNMENT
CODE SECTION 36516
WHEREAS, on February, 5, 2008, the City Council adjusted Council
compensation to conform to the California State Attorney General calculation method
for general law cities, bringing City Council compensation to a base level of $780 per
month; and
WHEREAS, Government Code Section 36516 outlines the amount of total
compensation City Council Members may receive based upon a city's population and
also allows for annual adjustments to the base salary of 5% each year; and
WHEREAS, per Government Code Section 36516, as interpreted by the
California Attorney General's Opinion at 06 -504 adjustment cannot be compounded,
and is based upon the date the salary was last adjusted; and
WHEREAS, compensation adjustment may only take place when a new term of
office begins, which would be in December 2013; and
WHEREAS, the City Council wishes to amend the provisions of Section 2 -1.4,
Subsection a. to increase Council compensation to the maximum allowable by law to
address the fact that such compensation has not been increased since 2008; and
WHEREAS, the City Council now desires to codify these changes to the
Lynwood Municipal Code.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD,
CALIFORNIA, DOES ORDAIN AS FOLLOWS:
Section 1. Section 2 -1.4, "Compensation of City Council Members," of the
Lynwood Municipal Code is hereby amended, as to Subsection a. only to read as
follows,- which amendment, consistent with Government Code Section 36516, shall be
effective (as to all Council Members) following the beginning of. the new term of office
for the newly elected or re- elected Council Members in December 2013, with all
provisions of Subsection 2 -1.4 b remaining unmodified and in full force and effect:
2 -1.4 Compensation of City Council Members:
a. In accordance with section 36516 of the California Government Code, each
member of the City Council will receive as salary the sum of nine hundred
seventy -five dollars ($975.00) per month.
Section 2. Except as expressly r modified pursuant to this Ordinance, all
provisions of the Lynwood Municipal Code shall- remain unmodified and in full force and
effect.
Section This Ordinance shall take 'effect as tor all ._Council Members'
compensation following the beginning of the new term of office for the 'newly elected ;'or
re- elected Council Members in December 2013.
Section 4. The City Clerk shall certify to, the adoption.. of ,this. Ordinance ;and
cause it to be posted as required by law, and hereby designated forlhat'purpose.
First read at a regular meeting of the City Council held on.the 18th day of December,
2012 and adopted and ordered published at a.regular meeting of said Council on the
15th day of January, 2013.
