HomeMy Public PortalAboutResolution 11-2326 PC - 9822 Las Tunas Dr" " " RESOLUTION NO. 11 -2326 PC A CONDITIONAL USE PERMIT TO ALLOW THE INTERIOR SUBDIVISION OF A COMMERCIAL BUILDING INTO TWO COMMERCIAL UNITS AT 9822 LAS TUNAS DRIVE. THE SUBJECT SITE IS IMPROVED WITH A 2,654 SQUARE FOOT SINGLE -STORY COMMERCIAL BUILDING WHICH IS CURRENTLY OCCUPIED BY A MEDICAL OFFICE. THE REQUEST IS TO SUBDIVIDE THE EXISTING BUILDING INTO TWO COMMERCIAL UNITS SO THAT ANOTHER BUSINESS WOULD BE ALLOWED ON THE PREMISES. THE SUBJECT SITE IS IN THE CITY'S EAST COMMERCIAL DISTRICT (EC) OF THE DOWNTOWN SPECIFIC PLAN AND IS DESIGNED AS COMMERCIAL BY THE GENERAL PLAN. (CUP 11 -1780) (PHYLLIS WEINSTEIN) The Planning Commission of the City of Temple City does hereby resolve: SECTION 1. Based upon information provided in the Staff Report and testimony received at the noticed public hearing, the Planning Commission hereby makes the following findings relative to the Conditional Use Permit: 1. That the site for the proposed use is adequate in size, shape, topography and circumstances in that the site contains 6,500 square feet of land area and 2,654 square feet of building area which is considered adequate to accommodate two businesses on the site; and 2. That the site does have sufficient access to streets, adequate in width and pavement type to carry the quantity and quality of the traffic generated by the proposed use in that the site is abutting Las Tunas Drive, a major thoroughfare with a 100 -foot right -of -way and a 70 -foot of roadway; and 3. That the proposed use will not have an adverse effect upon the use, enjoyment or valuation of adjacent or neighboring properties or upon the public welfare in that the proposed project is consistent with the land use policy and development standards prescribed by the Downtown Specific Plan and parking will not be intensified by the proposed use. SECTION 2. This project is found to have no significant effects upon the environment, and is categorically exempt from the environmental review (15301). SECTION 3. Accordingly, Conditional Use Permit 11 -1780 is approved based upon the following conditions: 1. The proposed development shall be in substantial compliance with the submitted plans, date - stamped February 03, 2011, except as modified herein. Resolution No. 11 -2326 PC Conditional Use Permit 11 -1780 9822 Las Tunas Drive Page 2 2. The subject property shall be limited to two (2) commercial units as proposed by the applicant. Any future use is subject to the applicable ordinances of the time and may require review and approval of the Community Development Department. 3. Building Permits shall be required for any future Tenant Improvements and all construction work shall comply with the adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electrical Code, and all other applicable codes. 4. The applicant shall install a barrier to protect the building located on property directly to the east of the project site. Said barrier shall be designed and installed to the satisfaction of the Director of Community Development or his designee. 5. Sign permits shall be obtained for any new signage to be established on the premise. The design of the signage shall comply with all the provisions of the city's sign ordinance and is subject to the review of the Community Development Department. 6. All activities and functions at the site shall be subject to the City's noise Ordinance. Any violation of the City's noise Ordinance as contained in Sections 9280 to 9282.1 shall be grounds for revocation of this Conditional Use Permit. 7. This Conditional Use Permit shall expire 24 months from the date of approval if said approval is not exercised within that time. If the project is not commenced prior to the expiration date, the applicant may apply in writing for an extension of time at least forty (40) days before the expiration date. 8. The conditions of approval contained in this Resolution may be enforced by the Sheriffs Office as well as City staff. Any violation of any condition is a misdemeanor and may be processed directly by criminal complaint. 9. This Resolution shall not become valid until such time that the applicant and property owner has signed a copy of the Resolution acknowledging acceptance of the Conditions of Approval. • • • " " " Resolution No. 11 -2326 PC Conditional Use Permit 11 -1780 9822 Las Tunas Drive Page 3 SECTION 4. The Secretary shall certify to the adoption of this Resolution.
