Sherbondv Village Auditorium 215 Perviz Avenue Opa-locka, FL 33054 1. CALL TO ORDER: Mayor Myra Taylor called the meeting to order at 7:00 p.m. on Wednesday, October 11, 2017 in the Auditorium at Sherbondy Village, 215 President Barack Obama (Perviz) Avenue, Opa-locka, Florida. 2. ROLL CALL: The following members of the City Commission were present: Mayor Myra L. Taylor, Vice Mayor Joseph L. Kelley, Commissioner Timothy Holmes and Commissioner John Riley. Also in attendance were: Interim City Manager Ed Brown, City Attorney Vincent T. Brown, and City Clerk Joanna Flores. Commissioner Matthew Pigatt was not in attendance. 3. INVOCATION: The invocation was delivered by Vice Mayor Joseph L. Kelley. 4. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was recited in unison. 5. AWARDS/PROCLAMATIONS/ACKNOWLEDGEMENTS: 6. APPROVAL OF CONSENT AGENDA AND PULL LIST (deferrals and deletions): The following items were pulled from the Consent Agenda to be discussed separately under Action Items: 7. APPROVAL OF AGENDA: It was moved by Commissioner Riley, seconded by Vice Mayor Kelley to approve the agenda, consent agenda and pull list. There being no discussion, the motion passed by a 5-0 vote. APPROVAL OF MINUTES: A motion was made to defer the Regular Commission Meeting Minutes of April 26, 2017 It was moved by Commissioner Riley, seconded by Commissioner Holmes to move the approval of the minutes from the Regular Commission Meeting of April 26, 2017. There being no discussion, the motion passed by a 4-0 vote. DISTRICT ONE/DISTRICT TWO - COUNTY COMMISSIONER REPORT: Larry Gardner, Commissioner Barbara Jordan's office, District II, told Commissioner Holmes that he spoke to the traffic controllers from the county regarding the speed signs and they said they will look into it. Cedric Brazil, Commissioner Jean Monestime's Office, District II, said that he does not have anything to announce, but will take any concerns back to Commissioner Monestime. Vice Mayor Kelley and Commissioner Riley agreed that there are areas that fall under Commissioner Monestime's district including industrial areas that need cleaning up from the hurricane. 10. PUBLIC PRESENTATION: 11. CITIZENS' INPUT: Brian Dennis, 3135 NW 135th Street, said that he requested the personnel file for William Greene and documents he knew were supposed to be included in the file was missing and that is not right. The Human Resources Director having children from Dante Starks is not right and if the City is trying to clean itself up, then some of these issues that are ongoing need to be corrected. Former Commissioner Dorothy Johnson, 13724 NW 22nd Place, said that she is concerned about all of the debris that is all over the City. She hopes that there is a timeline for garbage pickup. She is also concerned about what the previous resident said about the City bringing in people with questionable records. The City is always in the media and should be cautious about who it hires. 12. ACTION ITEMS: 13. CONSENT AGENDA: Regular Commission Meeting Minutes—10/11/2017 3 1 (13-1). A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA- LOCKA, FLORIDA, ADOPTING A RESOLUTION PURSUANT TO ARTICLE IV SECTION 4.5(B) OF THE CHARTER OF THE CITY OF OPA-LOCKA, DIRECTING THAT THE AMOUNTS APPROPRIATED FOR CURRENT OPERATIONS FOR THE CURRENT FISCAL YEAR (FY 2016-2017) BE DEEMED ADOPTED FOR THE ENSUING FISCAL YEAR (FY 2017-2018) FOR A PERIOD OF FIFTEEN (15) DAYS AND RENEWED BY RESOLUTION EACH FIFTEEN (15) DAYS THEREAFTER, WITH ALL ITEMS PRORATED ACCORDINGLY, UNTIL SUCH TIME AS THE COMMISSION ADOPTS AN ANNUAL BUDGET FOR THE ENSUING FISCAL YEAR (FISCAL YEAR 2017-2018); PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE. A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA- LOCKA, FLORIDA, DIRECTING THE CITY MANAGER TO TAKE ALL STEPS NECESSARY AND APPROPRIATE TO HAVE POSTED SPEEDING SIGNS INSTALLED ALONG 151ST STREET (ORIENTAL BLVD) FROM 37TH AVENUE TO 17TH AVENUE WITHIN THE CITY; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE. Sponsored by Commissioner Holmes The above resolutions were read by Attorney Brown. City Attorney Brown said that going forward there will be scrivener's errors in each resolution to allow for changes. It was moved by Commissioner Holmes, seconded by Vice Mayor Kelley to pass the resolutions. The motion on the resolutions passed by a 4-0 vote. DISCUSSION/ACTION ITEM ON RECONVENING THE BUDGET HEARING SET FOR OCTOBER 25, 2017 TO ADOPT THE MILLAGE RATE ORDINANCE. City Attorney Brown said that this is an item where the two budget ordinances, the millage rate, and the ad valorem/non ad valorem fire assessment tax were recessed until the 25th. The county is requiring that the millage rate ordinance is approved for the November 1, 2017 deadline. Budget Administrator Ernesto Reyes said that the tax date is November 1, 2017 and not submitting the millage rate by the due date could result in the residents missing out on the discounts for paying their tax bills early. Regular Commission Meeting Minutes—10/11/2017 4 City Attorney Brown said that staff is requesting to convene the meeting to an earlier date so that the commission can vote on the ordinance standing alone. The commission will then recess to allow for time for advertising and then reconvene again. A motion was made to advertise the notice on October 17, 2017 at 6:30 p.m. It was moved by Commissioner Holmes, seconded by Commissioner Riley to pass the motion. AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF OPA- LOCKA, FLORIDA, AMENDING ORDINANCE 15-31; ESTABLISHING PERMITTED USES AND DEVELOPMENT STANDARDS FOR COMMUNITY GARDENS, URBAN GARDENS AND URBAN FARMS; CREATING DEFINITIONS AND ESTABLISHING A PERMIT AND APPLICATION PROCESS FOR THESE USES; PROVIDING FOR REPEALER; SEVERABILITY; CODIFICATION; AND AN EFFECTIVE DATE. Sponsored by City Manager The above ordinance was read by Attorney Brown. Mayor Taylor opened the floor for a public hearing. Former Commissioner Dorothy Johnson, 13724 NW 22nd Place, asked if the ordinance can be explained. Interim City Manager Ed Brown asked Planning and Community Development Director Gregory gay to come and explain. Mr. Gay said that urban farms are vacant areas that are used for temporary purposes as a gardening place for the planting of fruits and vegetables by the community. There being no further persons to speak on the public hearing, the public hearing was closed. Regular Commission Meeting Minutes—10/11/2017 5 It was moved by Commissioner Holmes, seconded by Commissioner Riley for discussion. Commissioner Riley asked what the timeline was for the item. Vice Mayor Kelley said that he was not going to support the item at this time because the City is already challenged with what it has currently; he is not even sure where the item came from and he is not comfortable. Commissioner Riley withdrew his second. The motion died for a lack of a second. 2. AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF OPA- LOCKA, FLORIDA, AMENDING CHAPTER 13 OF THE CITY CODE OF ORDINANCE AND CREATE ARTICLE XV, "TEMPORARY USES AND OCCUPANCIES", ESTABLISHING A PERMIT APPLICATION PROCESS AND HEARING NOTICE STANDARDS FOR TEMPORARY USES AND OCCUPANCIES IN WHICH A PERMIT IS REQUIRED; AMENDING ORDINANCE 15-31, CHAPTER IV, ENTITLED "TEMPORARY USES AND OCCUPANCIES" TO ESTABLISH THE ZONING DISTRICTS TEMPORARY USES AND OCCUPANCIES WILL BE PERMITTED; PROVIDING FOR REPEALER; SEVERABILITY; CODIFICATION; AND AN EFFECTIVE DATE. Sponsored by City Manager The above ordinance was read by Attorney Brown. Mayor Taylor opened the floor for a public hearing. (Name inaudible), Opa-locka CDC, 490 Ali-Baba Avenue, said they are working on a project that involves items 16(1) and 16(2). They have done the gardens in several other cities and have been successful. They would be the ones maintaining the space that is used for the gardens. Former Commissioner Dorothy Johnson, 13724 NW 22nd Place said that there are already spaces on the east and the west that have community gardens and the City does not need any more; it should maintain what it already has. There being no further persons to speak on the public hearing, the public hearing was closed. It was moved by Vice Mayor Kelley. The motion died for a lack of a second. 3. AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF OPA- LOCKA, FLORIDA, AMENDING CHAPTER 13 OF THE CITY CODE OF ORDINANCES ENTITLED "LICENSES AND BUSINESS REGULATIONS" TO DEFINE THE FOLLOWING PRODUCT, LOW-THC CANNABIS, AND RELATED DEFINITIONS; AMENDING ORDINANCE 15-31, CHAPTER VI, ENTITLED "OFF- STREET PARKING," ESTABLISHING A MINIMUM PARKING REQUIREMENTS FOR "MEDICAL CANNABIS DISPENSARIES"; AMENDING CHAPTER 13 OF THE CITY CODE OF ORDINANCES, SECTION XX, ENTITLED "ZONING DISTRICTS AND REGULATIONS" BY CREATING SECTION 13-XX, ENTITLED "CANNABIS Regular Commission Meeting Minutes—10/11/2017 6 REGULATIONS AND USE" AND AMENDING SECTION 13-24-1 TO SECTION 13-24- 5, RELATING TO APPLICABILITY, DEFINING MEDICAL USE OF CANNABIS, DESIGNATING AREAS FOR THE USE, ZONING REQUIREMENTS RELATING TO THE USE, AND PROHIBITING CULTIVATION, PRODUCTION OR POSSESSION OF CANNABIS PLANTS; PROVIDING FOR REPEALER; SEVERABILITY; CODIFICATION; AND AN EFFECTIVE DATE. Former Commissioner Dorothy Johnson, 13724 NW 22n1 Place said that she hopes that the City will make the public aware of everything that is going on with this item. Milanda Arias and Nancy Diaz, 2650 Ali-Baba Avenue, said that they need help with the issues they have been having with inspectors. There being no further persons to speak on the public hearing, the public hearing was closed. It was moved by Vice Mayor Kelley. The motion died for a lack of a second. B. SECOND READING ORDINANCE(S)/PUBLIC HEARING: C. RESOLUTIONS: 17. CITY MANAGER'S REPORT: Interim City Manager Brown said that he has provided a report to the commission and is available to answer any questions they may have. Vice Mayor Kelley asked the manager if an RFP was sent out for the five (5) year financial recovery plan. Interim City Manager Brown said that the selection will come back to the commission for approval in the near future. Vice Mayor Kelley said that he will e-mail the manager his issues and concerns. Commissioner Holmes informed the manager that the lights on the field at Sherbondy Park need to be fixed and the road near the pump station at the park is still cracking and is in need of repair. 18. OFFICIAL BOARD REPORTS: No reports at this time. 19. MAYOR/COMMISSION REPORT: Vice Mayor Kelley announced that the Clergy Luncheon will be held on October 19, 2017 at Regular Commission Meeting Minutes—10/11/2017 7 11:30 a.m. The Mock Commission for Florida City Government Week will be held next week and the commission is invited to attend. 20.
