PROFESSIONAL SERVICE CONTRACT FOR
LEGAL SERVICES
~VHEREAS, there exists a need for professional set-cices for legal services to obtain
approval fi'om Superior Court. of the Borough's updated Housing Element and Fair
Share Plan: and
WHEREAS, legal seiMces are a a profbssional sep,'ice exempt fforn the requirement
of public bidding pursuant to N J S A 40A: 11-5 ( I ) (a): and
WHEREAS, the Local Finance Officer has certified that funds are available.
NOB:, THEREFORE, BE IT RESOLVED that the Mayor and Council of the
Borough of Carteret does hereby approve the appointment of James Clarkin, Esq.
at a maximum cost not to exceed $4,000.00 billable at $12000 per hour
BE IT FURTHER RESOLVED that the Mayor and Borough Clerk are hereby
authorized to execute said contract
IT IS FURTHER RESOLVED that the contract is awarded without competitive
bids in accordance ;~ith NJ.SA 40A:11-5 (1) (a) due to lhe specialized and
professional nature of the se~Mces provided.
IT IS FURTHER RESOLVED that a notice of this action shall be published in the
Home News Tribune on March 16, 1999

and certified as a true copy of the original
on March 12, 1999
