The meeting was called to order at 8:20 o'clock. Roll call: - Present – Trustees Em- minger, Hansen, Rees, Utendorffer and President Knox; absent – none. The minutes of the meetings held on December 8th and 15th, 1919, and of the adjournment for December 1st, 1919, were read and approved as read. The reports of the Clerk, Marshal and Officials' Reports Treasurer for the month of December, 1919, were read and ordered filed. Opera House on some evening in January 1920, under the license provisions of Ordinance No. 89, was received from Raymond Marce of Mission San Jose, Cal. It was ordered placed on file. A letter was received from J. H. Lash- To Demonstrate brooke of San Francisco stating that he would Bi-lateral Fire Hose appear before the Board at the next meeting for the purpose of showing the merits of his company’s "bi-lateral" fire hose, and asking to be informed of the Board's next meeting date. The Clerk was directed to inform him of the date. Adjourned Regular Meeting An adjourned regular meeting of the Board was held at the Town Hall on Monday evening, January 19th, 1920. The meeting was called to order at 8:15 o'clock. Roll call: - Present – Trustees Hansen, Utendorffer and President Knox; absent – Trustees Emminger and Rees – An application was received from Application For Paul Senfleben for a permit to erect Sign Permit a sign not electric, extending over the sidewalk in front of his place of business in the I. O. O. F. building on First street, in accordance with the provisions of Ordinance No. 87; said sign to be about eight feet ling and 16 inches wide and securely fast- ened in place not less than seven feet above the sidewalk surface. The application was referred to the Building Committee, to report at the next meeting. Four application for building permits Applications For were received and granted, as follows: Building Permits Mally & Biggs, for alterations on their building on the south side of First street, at $ an estimated cost of 600; Mrs. A. Grisel for the erection of a residence 20 x 28 feet in size on North M $ street, at an estimated cost of 300; E. D. Dargitz, for the erection of a one- story iron garage, 14 x 26 feet in size, on the L. M. MacDonald place on McLeod street between 4th and 5th, at an estimated cost of $100; B. Peña, for the erection of a private garage 23 x 30 feet in size on his place at the corner of North L and Walnut streets, at an estimated cost of $150. Health Officer Dr. J. K. Warner ap- Health Officer peared before the Board and reported Makes Report that about 100 cases of influenza had de- velped rapidly in the valley in the past week; that he was now quarantining every case, and that for the past two days there had not been so many new cases. He also reported that the disease was not yet in as severe a form as it was last year, and that the situation looked fairly favorable. J. H. Lashbrooke of San Francisco ap- Agent Explains peared before the Board and explained the "Bio-lateral" Hose merits of his company's "bi-lateral" fire hose, showing samples and quoting prices. M. G. Callaghan appeared before the Board Urges Contribution for as a representative of the Livermore Health Center Community Nurse and urged the Board to pay $25 to $50 per month for six months or a year, as a part of $ the total amount of 250 per month that it would cost to maintain a community nurse here. Herbert Lee and M. G. Callaghan as a Urge Establishment committee representing the Livermore Chamber of Automobile Park of Commerce, appeared before the Board and made addresses advocating the establish- ment of a free park for traveling automobile- ists at the McLeod place at Second and Maple streets, stating that the first cost would $ be about 200 and the cost of maintenance practically nothing. The matter was referred to the Com- mittee of the Whole, to report at next meeting. A report was received from Health Health Officer Officer Dr. J. K. A communication was received from Complaint of Blocking the Livermore Fire Brick Works complain- Railroad Crossing ing of the Southern Pacific crossing between their plant and the Pleasanton road being blocked by trains :daily and sometimes two and three times a day of r periods of from 30 minutes to an hour, and asking the Board to take some action to relieve the situation. The Clerk was directed to send a copy of the communication to the Division Super- intendent at Oakland Pier, calling his attention to the matter. On motion of Trustee Rees, seconded Fire Hydrants by Trustee Emminger, and by vote of the Ordered Enlarged. Board, the action of the Fire, Water and Light Committee in ordering five fire hydrants enlarged to four-inch was en- dorsed. Two applications for building permits Two Building were received and granted, as follows; Permits Granted. Mrs. M. S. Worden, for the remodeling of the front of her building on the south side of First street between K and L at an estimated cost of $200; Mrs. A. S. Carlisle for putting a corrugated-iron roof on her building on the north side of First street, at an estimated cost of $100. February 9, 1920 Adjourned Regular Meeting An adjourned regular meeting of the Board was held at the Town Hall on Monday evening, February 9th, 1920, The meeting was called to order at 8:25 o'clock. Roll call: - Present – Trustees Hansen, Rees and President Knox; absent, Trus- tees Emminger and Utendorffer. An application for a building permit Building Permit. was received from W. D. Martin for the erection of a service station at the south- west corner of First and N streets at an estimated cost of $200, and on motion of Trustee Rees, seconded by Trustee Hansen, and by vote of the Board the permit was granted on condition that the provisions of Ordinance No. 70 in regard to the storage of gasoline be complied with. On motion of Trustee Rees, seconded Resolution in re by Trustee Hansen, and by the following Town Advertising called vote, the following resolution was adopted: Ayes – Trustees Hansen, Rees and President Knox; noes – none; absent - Trustees Emminger and Utendorffer: "Resolution No. 338 "Resolved, that the Clerk of the Town of Livermore is hereby instructed to ad- vertise for one week in a newspaper of general circulation in the town of Liver- more, Cal. for bids for the town ad- vertising required by law to be printed and published in a newspaper printed in said town. "The contract for said printing shall continue for one year from the date of letting the contract. "Said bids shall be delivered in a sealed envelope to the Clerk of the Town of Livermore, in person, marked "Bid for Town Advertising" and must be delivered to said Clerk before the hour of 8 p. m. on Monday, March 1st, 1920. "Said bid shall be opened by the Board of Trustees of said Town of Livermore in open session and shall be exam- ined and publicly declared. "Said Board reserves the right to reject any and all bids. "The person receiving the award of the contract for the advertising herein shall within ten days there-after enter into a written contract with said Town for said advertising for a period of one year and shall furnish to said Town a good and sufficient bond in the sum of $200 with two sureties, who shall be acceptable to the Board, for the faithful performance of said contract. "After said bond shall have been approved by the Board, it shall be filed with the Clerk of the Town. "The work performed under the contract shall be paid for monthly in the way provided by law." Lashbrooke Co. of San Francisco through the Valley Hardware Co. as agents, for the sum of $280 complete with connections and delivered f.o.b. Livermore. Town Clerk March 2, 1920 Adjourned Regular Meeting An adjourned regular meeting of the Board was held at the Town Hall on Tuesday evening, March 2d, 1920. The meeting was called to order at 8:20 o'clock. Roll call: - Present – Trustees Em- minger, Hansen, Rees, Utendorffer and President Knox; absent – none. The minutes of the meetings held on February 2d and 9th, 1920, were read and approved as read. The reports of the Clerk, Marshal and Officials Reports Treasurer for the month of February, 1920, were read and ordered filed. A communication was received from Communication in Chief Engineer J. H. Knowles of the Western re Repairing Crossings Pacific Railroad Co. stating that the com- pany's grade crossings on L, M and East First streets were being repaired as re- quested by the Board. It was ordered filed. A communication was received from Communication in Supt. T. J. Rowland of the Southern Pacific re Blocked Crossing Railroad Co. stating that the company had taken action to eliminate further blocking of the crossing at the Livermore Fire Brick Works. The Clerk was directed to file the communication and to send a copy of the same to the Livermore Fire Brick Works. A bid for the town advertising for the Bid Received for ensuing year was received from the Livermore Town Advertising Herald, by M. R. Henry and was opened and read and found to be as follows: For first $00 insertion, 1. per square; for each subsequent insertion, 50 cents per square. No other bid was received. On motion of Trustee Hansen, seconded Bid Accepted. by Trustee Rees, and by vote of the Board, the bid of the Livermore Herald to do the town advertising was accepted in accordance with the provisions of Resolution No. 338, Three applications for building Three Building permits were received and granted as Permits Granted follows: H. B. Varney for the erection of a private garage on his place on I street between 8th street and Palm avenue, at $ an estimated cost of 65. A Goebel, for alterations to the store front of the Central Meat Market $ at an estimated cost of 200; Daniel E. Fuson, for the building of a sleeping place on W. H. Wright's place on the south side of East 1st street, at an estimated cost of $55. On motion of Trustee Utendorffer, Fire Hose Orders seconded by Trustee Hansen, and by vote of the Board, 200 feet of old 2½-inch fire hose was ordered relined as "Bilateral Hose" by the J. H. Lashbrooke Co. of San Francisco at 95 cents per foot, and one 50-foot section of 1-inch hose for the chemical car was ordered purchased form the same company at 60 cents per foot. The matter of establishing a free In re Auto- automobile parking place in town for mobile Park. traveling automobilists as requested by the Livermore Chamber of Commerce, was discussed at length, and the Board decided that it would not be advisable to go to the expense of equipping such a parking place until a suitable site had been leased for the purpose, and the matter was therefore referred back to the Chamber of Commerce with the suggestion that this be done. On motion of Trustee Utendorffer, Resolution in re seconded b Trustee Hansen, and by the Coming Election. following called vote, the following reso- lution was adopted: Ayes – Trustees Emminger, Hansen, Rees, Utendorffer and President Knox, noes – none; absent – none: "Resolution No. 339, "Resolved, by the Board of Trustees of the Town of Livermore that there will be and there is hereby established and fixed one (1) voting precinct for the purpose of holding the General Municipal Election in the Town of Livermore on Monday, the 12th day of April, 1920; and be it "Further resolved, that election precincts No. 1, 2 and 3 of the Town of Livermore, being the regular election precincts established for holding the last general State and County election, be and they are hereby consolidated into one precinct for the purpose of holding said municipal election, to be known as Consolidated Voting Precinct 'A'; and be it "Further resolved that the polls will be open from 7 o'clock a. m. to 7 o'clock p. m. at the place of election; and be it "Further resolved that the voting place of said Consolidated Voting Precinct 'A' be and the same in hereby fixed and selected; to wit, Town Hall, corner First and McLeod streets, Livermore; and be it "Further resolved, that the compensation of the election officers appointed to conduct the General Municipal Election on Monday, the 12th day of April, 1920 be and the same $ is hereby fixed at 5.00 each for his or her services in said election." Bairos of the Pleasanton Board New Highway. of Town Trustees, together with a copy of a resolution, No. 203, adopted by that Board, endorsing the project to have a paved highway built from Livermore to Mission San Jose by way of Pleasanton and Sunol, this connecting the two branches of the Sate highway running through the county. Trustees C. Letham, J. E. Bairos and A. B. Pickard of the Pleasanton Board ad- dressed the Board in regard to the matter, as a committee from the first-mentioned Board. "Whereas, the Highway Commission of the State of California and the County of Alameda have constructed modern highways through out the County of Alameda, connecting many of the important cities therein; and "Whereas, none of these modern highways pass through the center of Pleasanton and Livermore Valleys; and "Whereas, the Livermore and Pleasanton Valleys are the largest agricultural and stock-raising districts within the county; and "Whereas, the highway through Livermore and Pleasanton to Mission San Jose is located in the center of said valleys and is the main highway connecting the Sac- ramento and San Joaquin Valleys with the Canto Clara Valley and the coast territory and is used for all automobile travel; and "Whereas it is to the interest and ben- efit of the State and the great valley, as well as to the surrounding counties, that the main highway leading from Livermore through Pleasanton to Mission San Jose be improved by the construction of a modern highway. "Now , therefore, be it resolved that it is the opinion of the Board of Trustees of the Town of Livermore that the construction of a modern highway from Livermore through Pleasanton to Mission San Jose is of vital necessity to and for the best interests of the State of California and the great valleys surrounding and con- necting with the Livermore and Pleasanton Valleys; and "Be it further resolved, that the Board of Trustees of the Town of Livermore take such action as it deems necessary to place the need of the construction of such highway before the Highway Commission of Cali- fornia and to urge the construction of such highway." A copy of the above resolution was ordered sent to the State Highway Com- mission and another to the Board of Town Trustees of Pleasanton. President Pro Tem. A communication was received Communication from the Seagrave Co., San Francisco, Calif., in re Fire Engine. dated June 22d, 1920, explaining the causes of the delay in the shipment of the fire engine ordered by the Town last November stating that its factory was "still suffering from the effects of the three nation-wide strikes (coal, steel and rail- road)" and that they hoped the Board would have "a little more patience with them. It was ordered filed. The bond of D. W. Durant of Oak- Plumber's Bond land, Calif. as a master plumber, with Accepted. John Gelder and Ella L. Nottingham, both of Oakland, Calif., as sureties in $ the sum of 500, as filed with the Clerk, was on motion of Trustee Rees, seconded by Trustee Emminger, and by vote of the Board, accepted and approved. Ordinance No. 104, "an ordinance licensing, Ordinance Passed for the purpose of revenue and regulation, various kinds of business transacted and carried on in the town of Livermore, also all shows, exhibitions and lawful games carried on therein; also, fixing the rates of license tax, providing for the collection of the same by suit or otherwise, and re- pealing ordinances and parts of ordinances," was given second reading, and, on motion of Trustee Rees, seconded by Trustee Utendorffer, and by the fol- lowing called vote, was adopted and passed: Ayes – Trustees Emminger, Rees, Utendorffer and President Knox; noes - none; absent – Trustee Hansen. Following is a printed copy of said Ordinance No. 104 as published: ORDINANCE NO. 104. ________ AN ORDINANCE LICENSING, FOR THE PURPOSE OF REVENUE AND REGULATION, VARIOUS KINDS OF BUSINESS TRANSACTED AND CARRIED ON IN THE TOWN OF LIVERMORE, ALSO ALL SHOWS, EXHIBITIONS, AND LAWFUL GAMES CARRIED ON THEREIN; ALSO FIXING THE RATES OF LICENSE TAX, PROVIDING FOR THE COLLECTION OF SAME BY SUIT OR OTHERWISE AND REPEALING ORDINANCES AND PARTS OF ORDINANCES. ________ The Board of Trustees of the Town of Livermore do ordain as follows: Section 1. Definitions; Fro the purpose of this ordinance the singular shall include the plural, the masculine shall include the feminine and neuter, and vice versa. The word "merchant" shall include all dealers in general merchandise, electrical supplies, lumber, grain, flour, groceries, wood and coal, candy, shoes, furnishing foods, jewelery(sic), fruit, vegetables, drugs, dry goods, optical appliances, musical instruments, wagons, farm implements, harness, stationery, furniture, delicatessen stores, undertakers, bakeries, creameries, butcher shops, millinery stores, sign painters, paint shops, restaurants, oyster houses, chop houses, lunch counters, automobile repair shops, printing offices, retail dealers in hay or grain, hardware stores, vulcanizing shops, tailor shops, plumbing supply stores and garages; also any other business not otherwise mentioned in this ordinance, also any combination of two of more of the different kind of business aforementioned, unless otherwise expressly provided for herein. The word "quarter" or "quarterly" shall mean quarter year, and the word "person" shall include company, firm, agent or corporation. The term "established place of business: shall mean and include those who have been conducting a certain kind of business in said town for a fixed period of at least six months continuously next preceding. The term "fixed place of business" shall mean a store, shop or other place where goods, wares of merchandise are displayed to the public for sale and are usually sold and delivered, or where work is actually done, and shall not include a mere store-room,, office or supply depot where goods are temporarily deposited for the purpose of replenishing the stock of a traveling merchant or peddler. Section 2. It shall be unlawful for any person, firm or corporation to transact or carry on any business or conduct any show, exhibition or game in the Town of Livermore without first procuring a license so to do and paying a license tax or fee therefor(sic), as in this ordinance provided. Unless otherwise specified herein a separate license must be procured for each different kind of business, show or game conducted by the same person or corporation, or for the same kind of business when conducted by the same person at different places within the town. Section 3. Every person, firm or corporation carrying on business as a "merchant" in said town and having a fixed place of business therein shall pay a license tax therefor(sic) based on a classification of his average monthly sales, including material, goods, labor and work, for the preceding year, that is to say: (a) Those whose average monthly sales amount to less than $500 shall constitute the first class, and pay a license tax of $12 per annum. (b) Those whose average monthly sales amount to $500 or more and less that $1,000, shall constitute the second class and pay a license tax of $24 per annum. (c) Those whose average monthly sales amount to $1,000 or more and less that $1,500, shall constitute the third class and pay a license tax of $36 per annum. (d) Those whose average monthly sales amount to $2,000, shall constitute the fourth class and pay a license tax of $48 per annum. (e) Those whose average monthly sales amount to $2,000 or more and less that $2,500, shall constitute the sixth class and pay a license tax of $60 per annum. (f) Those whose average monthly sales amount to $2,500 or more and less than $5,000 shall constitute the sixth class and pay a license tax of $72 per annum. (g) Those whose average monthly sales amount to $5,000 or more and less than $7,500, shall constitute the seventh class and pay a license tax of $84 per annum. (h) Those whose average monthly sales amount to $7,500, or more shall constitute the eighth class and pay a license tax of $96 per annum. Anything in this ordinance to the contrarty notwithstanding, a newly started business of the "merchant" class shall be classified as of the first class for the first year. The license tax provided for in this section shall be paid semi-annually in advance. Section 4. For the purpose of ascertaining the proper classification as provided by the foregoing section the town clerk, before issuing a license, shall require each "merchant" top submit yearly a verified statement regarding his average monthly sales for the year preceding, for which purpose the clerk shall prepare printed or typewritten statements substantially in the following form: Town of Livermore, California. ………………………….. 19__, I, the undersigned, hereby state that the average monthly sales, including materials, goods, labor and work, for the business done by me in the ?Town of Livermore during the past year amount to between $............ and $........... Town Clerk Any person failing or refusing to subscribe to the foregoing statement under oath before the clerk, within ten days after being requested so to do. shall be arbitrarily classified as a merchant of the eighth class and be required to pay the maximum license tax imposed on merchants. Section 5. Every person, firm or corporation who runs, or uses for hire or a fee, any dray, job, truck or express wagon, automobile truck or motor delivery automobile, shall pay a license tax as follows: $10 per annum for each motor truck or motor delivery automobile; $8 per annum for each such vehicle if drawn by one animal. Section 6. Every person who conducts a shooting gallery shall pay a license tax of $10 per quarter. Section 7. Every person, who, for pay, conducts any theatrical representation, negro minstrels, opera or other musical entertainment, dancing or ballet, jugglers, necromancers, magicians, carnival, concession, wire or rope walking or a sleight-of-hand performance shall pay a license tax of $5 per day for each show and each concession, when not held in a regular licensed theater or concert hall; provided, however, that this provision shall not apply to any exhibition or entertainment given for the benefit of any church, school or any other charitable purpose by any amateur dramatic association or other amateur society or company of the Town of Livermore. Section 8. Every person, who, for pay, exhibits any caravan, menagerie, collection of animas, circus or other acrobatic performance shall pay a license tax as follows: When the general admission fee for adults to the whole performance amounts to $1 or more, $100 per day; when the admission fee for adults to the whole performance amounts to 50 cents or more, and less than $1, $75 per day; when the admission fee for adults to the whole performance amounts to 25 cents or more, and less than 50 cents, $40 per day; when the admission fee for adults to the whole performance is 25 cents or less, $20 per day. Section 9. Every traveling merchant, hawker or peddler who vends goods, wares or merchandise, other than the product of manufacture of his own stock, dairy, poultry, fruit, vegetable, hay or grain farm, shall pay a license tax of $5 per month; provided, that every traveling merchant , hawker, peddler or street fakir, who advertises goods, wares or merchandise of any kind by music, singing, dancing, jugglery, tricks, sleight-of-hand, buffoonery, gymnastics or any spectacular display, show of performance upon or along the street or in any public hall, shall pay a license tax of $50 per month or $5 per day. Section 10. Every person who at a fixed place of business, keeps horses for hire, shall pay a license tax of $4 per quarter. Section 11. Every person conducting a warehouse business for storing of hay for hire shall pay a license tax, at the end of each quarter, in accordance with the largest amount of hay on storage at any time during the quarter, as follows: For 1000 tons or less $4 per quarter. For more that 1000 tons and less than 2,000 tons, $8 per quarter. For more than 2,000 tons and less than 3,000 tons, $12 per quarter. For more than 3,000 tons and less than 4,000 tons, $15 per quarter. For more than 4,000 tons and less than 5,000 tons, $20 per quarter. For more than 5,000 tons and over $24 per quarter. Section 12. Every person who at a fixed place of business, sells goods, wares or merchandise on commission, or stores grain for hire, shall pay a license tax of $10 per quarter; provided, however, that this section shall include all those who store grain for hire and sell sacks or twine as an adjunct thereto. or who buys or sell grain at wholesale or on commission. Section 13. Every person carrying on a laundry business or wash-house, or who acts as agent for any laundry or wash-house, shall pay a license tax of $25 per year. Section 14. Every person doing business as an auctioneer shall pay a license tax of $5 per day. Section 15. Every person, association of club who conducts or exhibits any boxing, sparring or wrestling match as authorized by law shall pay a license tax of $10 for each and every exhibition; provided a permit is first granted by the Board of Trustees. Section 16. Every person who, from house to house, sells or solicits for the sale of any goods, wares or merchandise for future delivery, shall pay a license tax of $25 per month, unless otherwise provided in this ordinance. However, this section shall not apply to solicitors or drummers of wholesale houses soliciting orders from business houses in said town, nor to any person otherwise maintaining and carrying on an "established place of business" therein and paying a license therefore(sic) nor to the bona fide agents of business houses located in other States. Section 17. Every person who, for pay or hire, exhibits or operates any merry-go-round, or hobby horses or ferris(sic) wheel shall pay a license tax of $15 per day. June 28, 1920 Section 18. Every person who conducts a theatre regularly showing moving pictures, with or without other entertainment, shall pay a license tax of $25 per quarter. The lessee or owner of any other theatre or hall shall pay a license tax of $2 for each theatrical performance, entertainment, dance, hall, public game or political meeting, said license tax to be paid at the end of each calendar month; provided, that no license tax shall be collected in any case wherein it is shown to the satisfaction of the Marshal that a reduction of the regular rent of such theatre or hall amounting to $2 or more per day, has been made to the lodge, church, school or charitable organization, or to a person giving an entertainment or dance for charitable purposes. Section 19. Every person engaged in the business of peddling or selling to the trade or others, by means of a vehicle, malt beverages, or any admix- ture thereof, syrup, non-intoxication beverages, soda or other products of petroleum, other than those having a fixed place of business in the town, shall pay a license tax of $30 semi-annually in advance. Section 20. Every person engaged in the business of peddling wholesale, or selling or delivering to the trade and others, by means of any kind of a vehicle, any candy, crackers, chewing gum, flour, meals, grains, or any article of merchandise, other than those mentioned in Section 19 of this ordinance, except those persons having a fixed place of business in the town, shall pay a license tax of $5 per quarter. Section 21. Every astrologer, seer, fortune teller, clairvoyant, spiritualist, or spiritual medium who demands a fee for his or her services shall pay a license tax of $10 per week or $25 per month. Section 22. Every person engaged in the business of vending or peddling sewing machines, excepting those having a fixed place of business in said town, shall pay a license tax of $10 per quarter. Section 23. Every person engaged in the business of selling ice shall pay a license tax of $10 per annum Section 24. Every person engaged in the hotel or lodging house business shall pay a license tax of 50 cents per room per year. A hotel or lodging house, for the purpose of this section, is a building or part thereof intended, designed or used for supplying shelter for hire to human beings and containing more than five guest rooms. Section 25. Every person, firm or corporation engaged tin the business of carrying on or maintaining a winery, also agents representing wineries and retailing wines in quantities of one quart of more, shall pay a license tax of $15 per quarter. Section 26. Every person who, at a fixed place of business, manufactures soda water or mineral waters and who sells the same at wholesale shall pay a license tax of $10 per year. Section 27. Every person engaged in conducting or maintaining a malt or cereal beverage plant or malt, or cereal beverage depot, either as principal or agent, or who sells malt, ceeal(sic) or other beverages at wholesale and has a fixed place of business in the town, shall pay a license tax of $12.50 per quarter. Section 28. Every book agent, canvasser or book peddler shall pay a license tax of $10 per quarter. Section 29. Every person conducting or operating the business of carrying or operating the business of carrying passengers for hire by means of automobiles, except as pro vided in Section 49 of this ordinance, shall pay a license tax of $4 per quarter, which license shall be additional to any license tax which may be charged such person for conducting a garage or other business. Section 30. Every person, not having a fixed place of business, acting in the capacity of an agent for an automobile manufacturer, including those who solicit for the sale of automobiles, shall pay a license tax of $10 per quarter. Section 31. Every person who conducts a bullied or pool parlor, or both, shall pay a license tax of $1 per table per quarter. Section 32. Every person who conducts a cigar store or cigar stand or who makes a specialty of dealing in cigars and tobaccos, shall pay a license tax of $25 per quarter. Section 33. Every person who conducts a bowling alley shall pay a license tax of $2 per quarter. Section 34. Every person selling goods, wares or merchandise at auction, or the goods, wares or merchandise of a bankrupt, or goods, wares or merchandise alleged to be damaged as the result of a fire or other catastrophe, or where such goods, wares or merchandise are advertised for sale at less than the original cost, shall pay a license tax of $50 per quarter; provided that this section shall not apply to the selling of any goods, wares or merchandise of merchants having an established place of business in said town who are already paying a license tax; provided further, however, that it shall apply to all cases where a stock of auction, damaged or second-hand goods, wares or merchandise are imported to said town expressly for such sale. Section 35. Every person conducting business as a barber shall pay a license tax of $1 per quarter for each barber chair therein. Section 36. Every person conducting business as a bill poster or distributor of hand bills, shall pay a license tax of $10 per quarter. Section 37. Every person conducting business as a junk dealer shall pay a license tax of $25 per year. Section 38. Every person engaged in the business of selling water to the town or its inhabitants shall pay a license tax of $10 per quarter. Section 39. Every person carrying on a blacksmith shop shall be classified in accordance with the average number of employees hired and pay a license tax of $1 per quarter, together with 50 cents extra per quarter for each additional person employed on the average. Section 40. Every person transacting any dyeing or cleaning business, or both, and not maintaining a fixed place of business in said town shall pay a license tax of $25 per annum. Every person engaged in the dyeing and cleaning business, or both, and having a fixed place of business in said town shall pay a license tax of $10 per annum. Section 41. Every person conducting a shoe-repairing shop which is not connected with a shoestore(sic) shall pay a license tax of $12 per year. Section 42. Every person transacting business as a messenger or purchasing agent shall pay a license tax of $6 per year. Section 43. Every person engaged in business as a physician, surgeon, osteopath, chiropractor or Christian Science practitioner shall pay a license tax of $5 per quarter. Section 44. Every person engaged in business as a real estate agent, dentist, attorney or counselor a t law, shall pay a license tax of $3 per quarter. Section 45. Every person conducting a carpenter shop shall pay a license tax of $6 per year. Section 46. Every person carrying on business as a manicurist shall pay a license tax of $10 per year. Section 47. Every person engaged in the business of selling at retail malt of cereal beverages, with or without dealing on other non-intoxicating drinks of beverages, shall pay a license tax of $25 per quarter. Section 48. Every person engaged in the business of conducting a soda fountain, ice cream parlor, or place where any nonintoxicating(sic) beverage, mineral water, charged or carbonated water or any syrup or soft drink, other than malt or cereal beverages, is sold or dispensed, with or without dealing in candies, nuts, sweetmeats, ice cream, pastries, cake, bread, fruits or vegetables, shall pay a license tax of $10 per quarter. Section 49. Every person, firm or corporation conducting, managing or carrying on the business of running, driving or operating any automobile or motor-propelled vehicle for the transportation of passengers for hire over a defined route, between any points one terminus, depot or station of which is within the Town of Livermore and the other terminus, depot or station is one or more points within or without the Town of Livermore, when the route followed takes the said vehicle outside the limits of said Town at any place, and which vehicle does not receive or disharge(sic) passengers along said route except at definite points, and which vehicle does not do a local business as a jitney bus, or sight-seeing bus, shall pay a license tax as follows: For each such vehicle having a seating capacity of from 4 to 7 persons, $1 per month. For each such vehicle having a seating capacity of more that 7 persons, $2 per month. In determining the seating capacity of any such vehicle the driver or operator thereof shall be included. Every driver or operator of any vehicle mentioned in this section shall upon each and every arrival at the terminus in Livermore, sign his name and enter the license number of said vehicle and seating capacity of such vehicle in a book or books, furnished by the Twon of Livermore, at the terminus, depot or station of the person, firm or corporation, conducting, managing or carring on the business mentioned in this section, in the Town of Livermore. Section 50. Except as otherwise provided in this ordinance, all licenses shall be paid for in advance for the period mentioned, and the same amount shall be paid for a fraction of the period mentioned. Section 51. Every person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and be punishable by a fine or penalty of not exceeding fifty dollars, or by imprisonment in the Town Jail not exceeding thirty days, or by both such fine and imprisonment. Said fine or penalty to be recoverable by a civil action in the Recorder's Court. Section 52. Following is a printed copy of said Ordinance No. 105 as published: ORDINANCE NO. 105 ________ AN ORDINANCE FOR THE SUPPRESSION OF PUBLIC GAMBLING AND BETTING AND PROVIDING A PENALTY FOR VIOLATING OF PROVISIONS OF SAID ORDINANCE. ________ Be it ordained by the Board of Trustees of the Town of Livermore, as follows: Section 1. It shall be unlawful for any person in any public place within the Town of Livermore to gamble at cards, dice or any other game, device or contrivance. Section 2. It shall be unlawful for any person in any public place within the Town of Livermore to bet money upon the result of any game or upon the occurring of a future contingency. Section 3. It shall be unlawful for any person within the Town of Livermore to knowingly visit any public place where gambling or betting, as defined herein, is being carried on or conducted. Section 4. It shall be unlawful for any person, firm or corporation in the Town of Livermore to knowingly keep or maintain or conduct or contribute to the support of any public place where gambling or betting, as defined herein, is being habitually carried on or conducted, or to knowingly let or underlet or transfer the possession of any house or premises for use for said purposes. Section 5. It shall be unlawful for any person who has knowledge of the character of the place to invite, entice or persuade any person or persons to visit any public place where gambling or betting is being carried on or conducted. Section 6. It shall be unlawful for any person in any public place within the Town of Livermore to buy or sell anything of value won in any game or as the result of any bet or as a result of the determination of any uncertain event. Section 7. Subdivision 1: The terms gamble and gambling as used in this ordinance are defined to mean the playing at a game, device or contrivance in which the element of chance is the controlling factor for stakes, or the betting on the result of any game, device or contrivance, whether it be one of skill or chance. Subdivision 2: The terms bet and betting as used in this ordinance are defined to mean an agreement, express or implied, between two or more persons that money in contributing which all agreeing take part, shall become the property of one or some of them on the happening or not happening in the future of an event which at the time is an uncertainty, or upon the ascertainment of a fact in dispute. Subdivision 3: The term stake as used in this ordinance is defined to mean a fund contributed by two or more persons on an understanding, express or implied, that each one so contributing is to have a chance to gain a portion or all of such fund, dependent on the happening or not happening of some uncertain event. Subdivision 4: The term public place as used in this ordinance is defined to mean any premises or place except a bona fide private dwelling or an apartment, suite or room, which is used in good faith as the residence or one or more persons, in an apartment house, lodging house, hotel or other institution of similar character. Section 8. Every person who shall violate any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not to exceed three hundred (300) dollars, or by imprisonment in the Town Jail for not more than three months, or by both such fine and imprisonment. Section 9. This ordinance shall take effect at the time provided by law. Section 10. This ordinance shall be published in the "Livermore Herald." It is hereby declared to be unlawful for any person, firm or corporation to conduct, carry on, operate or maintain in the Town of Livermore any pubic pool or billiard room or rooms without written permit therefore(sic) granted by the Board of Trustees of the Town of Livermore; and such permit shall be required in addition to the license required by Ordinance No. 104 of the Town of Livermore. Such permit shall be granted or refused by the Board of Trustees, in its discretion, upon formal application therefor(sic) by the person, firm or corporation, and such application shall specify the name of the person, firm or corporation applying for such permit, the location of the premises where it is proposed to conduct such pool or billiard room or rooms and that the applicant or applicants is or are the only person or persons to be in any manner connected with the management and control of such pool or billiard room or rooms. Section 2. It is hereby declared to be unlawful for any person, firm or corporation conducting any public pool or billiard room in the Town of Livermore, or any servant or employe(sic) of such person, firm or corporation, to permit, suffer or allow any minor under the age of eighteen years to enter, visit or remain in any public pool or billiard room conducted by or in charge of such person, firm or corporation, or any servant or employe(sic) thereof. Section 3. It is hereby declared to be unlawful for any minor under the age of eighteen years to enter or remaining any public pool or billiard room or rooms in the Town of Livermore. Section 4. It is hereby declared to be unlawful for any minor under the age of eighteen years, for the purpose of gaining entrance to any such public pool or billiard room in the Town of Livermore in violation of the provisions of this ordinance, to represent to the person firm or corporation conducting such pool or billiard room, or to any servant or employe(sic) of such person, firm or corporation, that such minor is eighteen years of age or upwards, and the making of such representation for such purpose shall be deemed a violation of the provisions of this ordinance. Section 5. It is hereby declared to be unlawful for any person, firm or corporation conducting any such pool or billiard room in the Town of Livermore, or for any servant or employe(sic) of such person, firm or corporation, to have or maintain in connection with such pool or billiard room or rooms, any private room or rooms, excepting rooms used exclusively as toilets or lavatories; and for the purposes of this ordinance private rooms shall be deemed to be those rooms the entire interiors of which are not exposed to view from the main entrance to such pool or billiard room, of from one of the main rooms regularly and habitually used by the general public for the playing of pool or billiards. Section 6. It is hereby declared to be unlawful for any person, firm or corporation conducting any public pool or billiard room in the Town of Livermore, or for any servant or emplolye(sic) of such person, firm or corporation, to permit, suffer or allow the playing of any game or games of chance or skill, played with cards, dice or other device or devices and on the outcome of which the loss or gain of money, merchandise or other thing of value is hazarded, in or about any such public pool or billiard room or rooms. Section 7. A copy of this ordinance furnished by the Clerk of the Board of Trustees of the Town of Livermore shall be conspicuously posted and at all times kept posted in each room of every such pool or billiard establishment in the Town of Livermore by the person, firm or corporation conducting the same; and the failure to post and keep posted such copy of said ordinance shall be deemed a violation of this ordinance by such person, firm or corporation; and printed copies of said ordinance shall be furnished every such person, firm or corporation by said Clerk, upon application. Section 8. The Board of Trustees may, at any time, for such cause as they or a majority of them, upon investigation, deem sufficient, revoke any permit granted under the provisions of this ordinance, and it is especially ordained and declared that all such permits are held at the pleasure of the Board of Trustees. Section 9. Any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not more that one hundred dollars, or by imprisonment in the Town Jail of the Town of Livermore for a period of not to exceed fifty days, or by both such fine and imprisonment; provided that the conviction and punishment of any person, firm of corporation conducting any such pool or billiard room in the Town of Livermore for violation of any of the provisions of this ordinance shall in no manner affect the power of the Board of Trustees to revoke any permit granted by said Board of Trustees to such person, firm or corporation under the provisions of this ordinance. Section 10. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 11. This ordinance shall take effect at the time provided by law. Section 12. McKown one year, and that the regular meeting night was fixed as the last Monday of each month at 8 p.m. and the Library as the meeting place, and requesting that the Board of Library Trustees be informed in regard to the insurance carried on the Library building and contents.
