PROFESSIONAL SERVICE CONTRACT FOR
PLANNING SERVICES
;VHEREAS, there exists a need fbr professional se~5'ices for planning services to
obtain from Superior Court. of the Borough's updated Housing Element and Fair
Share Plan; and
~'HEREAS, planning services are a a professional setwice exempt from the
requirement of public bidding pursuant to NJSA. 40A:l I-5 (1) (a): and
~'HEREAS, the Local Finance OIl]cer has certified that funds are available
NO~}, THEREFORE, BE IT RESOLVED that the Mayor and Council of the
Borough of Carteret does hereby' approve the appointment of Art Bernard, Planner
al a maxin~utn cost not to exceed $$,000.00 billable as pet' attached rate schedule
BE IT FURTHER RESOLVED that the Mayor and Borough Clerk are hereby
authorized to execute said contract
It IS FURTHER RESOLVED that the contract is awarded without competitive
bids in accordance x,dth NJ.SA 40A:I I-5 (1) (a) due to the specialized and
professional nature of the services provided
IT IS FURTHER RESOLVED that a notice of this action shall be published in the
Home News Tribune on March 16, 1999
