HomeMy Public PortalAboutPlanning Commission Resolution 13-2377 PC" " RESOLUTION NO. 13 -2377 PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY DENYING CONDITIONAL USE PERMIT 13 -1828 TO ALLOW THE INSTALLATION OF A NEW CELLULAR ANTENNA FACILITY AT THE TEMPLE CITY HIGH SCHOOL'S ATHLETIC FIELD, LOCATED AT 9501 LEMON AVENUE. THE PROPOSAL IS TO REMOVE AN EXISTING LIGHT POLE AT THE HIGH SCHOOL'S ATHLETIC FIELD AND REPLACE IT WITH A NEW 70 FOOT 9 INCH TALL LIGHT POLE. A TOTAL OF 12 ANTENNAS (IN THREE ARRAYS) WILL BE ATTACHED TO THE LIGHT POLE BENEATH THE LIGHT FIXTURES. THE APPROVAL ALSO INCLUDES AN ENCLOSED EQUIPMENT AREA NEARBY THAT WILL HOUSE A BACKUP GENERATOR AND A 230 SQUARE FOOT PRE - FABRICATED STRUCTURE. SECTION 1. The Planning Commission has considered all of the evidence submitted into the administrative record which includes but is not limited to: 1. Reports and presentations of project related data and analysis prepared by the Community Development Department; and 2. The Temple City Municipal Code, General Plan, and all other applicable regulations and codes; and 3. Public comments, both written and oral, received or submitted prior to the public hearing, supporting or opposing the applicant's request; and 4. Testimony and comments submitted by the applicant and representatives in both written and oral form at or prior to the public hearing; and 5. All other related documents received or submitted prior to the public hearing. SECTION 2. This resolution is made with reference to the following prefacing facts as more fully set forth in'the administrative record: 1. On March 28, 2013, the application was submitted to the City. 2. On April 26, 2013, the application was deemed complete. 3. Notice of the public hearing was mailed on June 13, 2013 to property owners within 500 feet of the subject property. 4. The Planning Commission held a public hearing on June 25, 2013, at which time the project was continued to the July 23, 2013 Planning Commission meeting. " 5. At their July 23, 2013 meeting, the Planning Commission continued the item to Resolution No. 13 -2377 PC Conditional Use Permit 13 -1828 9501 Lemon Avenue the August 13, 2013 Planning Commission Meeting. Page 2 6. The Permit Streamlining Act deadline to make a decision on the project is August 12, 2013. 7. The project was rescheduled to August 12, 2013 and the project was re- noticed to property owners within 500 feet of the subject property and other interested parties. 8. Notice of the public hearing satisfied the noticing requirements set forth in Government Code Sections 65090 and 65091. 9. The project site is zoned R -1, Single Family Residential. 10. The project site is designated Institutional by the General Plan. 11. The project site is currently improved as a high school campus with classrooms, administrative offices and multiple athletic fields. 12. The proposed location (football /soccer athletic field) of the antennas currently has one existing light pole with two wireless carriers and another light pole that is scheduled to be replaced with a slightly thicker light pole and new cellular antennas. 13.The applicant is requesting a Conditional Use Permit to establish a new cellular antenna facility that would be attached to a slightly thicker light pole at the high school's athletic field. SECTION 3. All of the following findings must be made in order for the Planning Commission to approve the Conditional Use Permit. Based on the public hearing for the requested Conditional Use Permit, the Planning Commission finds: 1. That the site for the proposed use is adequate in size, shape, topography and circumstances to sustain the proposed use; The subject lot has a land area of approximately 25 acres consisting of a high school campus with classrooms, administrative offices, a parking lot and five athletic fields. The proposal includes replacing an existing light pole for the high school's football /soccer field that will include 12 new cellular antennas, as well as installing a backup generator and a new 260 square foot pre- fabricated structure that will store associated cellular antenna equipment. The generator and pre- fabricated structure will occupy an empty area west of the ath etic field's bleachers with direct access off of Camino Real Avenue. Therefore, the project meets this finding. • • • " " " Resolution No. 13 -2377 PC Conditional Use Permit 13 -1828 9501 Lemon Avenue Page 3 2. That the site does have sufficient access to streets and highways, adequate in width and pavement type to carry the quantity and quality of traffic generated by the proposed use; The subject site will be primarily accessed off of Camino Real Avenue, which is a local road that is improved with the capacity to handle the traffic that will be generated by the proposed use. Camino Real Avenue has a 60 foot right -of -way and a street width of 38 feet. The subject site is also accessed from Temple City Boulevard, which is a primary road that has an 80 foot right -of -way and a street width of 64 feet. The proposed cellular antenna facility will not increase vehicular traffic, as the facility would be unmanned with periodic maintenance inspections. Therefore, the project meets this finding. 3. That the proposed use will not have an adverse effect upon the use, enjoyment or valuation of adjacent property or upon the public welfare. The proposed use will have an adverse visual impact on surrounding properties and the neighborhood. The project proposes 21 antennas on an existing light pole. The project as proposed attaches the antennas to the existing light pole, creating a triangular structure that the antennas can be mounted to. The applicant made no attempt to reduce the visual impact by providing alternative designs such as a stealth design. In addition, the equipment shelter that is part of this project is immediately adjacent to Camino Real Avenue and no attempt was made to reduce the visual impact of the structure. As currently proposed there is no landscaping to reduce the overall visual impact of the structure and the large blank walls of the structure make it vulnerable to graffiti. For these reasons, the project as proposed would have an adverse effect on the valuation of adjacent properties, effect the visual character of the neighborhood which adversely effects the public welfare, and creates a greater possibility of graffiti, which could increase crime in the neighborhood. For the reasons stated above the project does not meet this finding. SECTION 4. This project is found to have no significant effects upon the environment, and is Categorically Exempt from environmental review per CEQA Guidelines, �15301(Existing Facilities). SECTION 5. In view of all of the evidence and based on the foregoing findings and conclusions, the Planning Commission hereby denies File No. CUP 13 -1828.
