HomeMy Public PortalAboutOrdinance 1886 AN ORDINANCE VACATING A PORTION OF A CERTAIN STREET IN THE VILLAGE OF PLAINFIELD WHEREAS, the President and Board of Trustees of the Village of Plainfield, after due investigation and consideration, have determined that the nature and extent of the public use and public interest in a portion of a certain street as described below warrant the vacation of said described street; and WHEREAS, a public hearing has been held on said proposed vacation and at said hearing there were no objections to said proposed vacation; and WHEREAS, an ordinance of vacation shall be adopted by the affirmative vote of at least three-quarters (3/4) of the trustees then holding office; NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, WILL COUNTY, ILLINOIS AS FOLLOWS: Section 1. That the tract of land bounded and described as below is hereby vacated, subject to the reservation of a certain easement as set forth in Section 2 below. Section 3. The vacation of the street as herein provided, shall not become effective until the following occurs: 1. The vacation of said street as herein provided, shall not become effective until all engineering, surveying and legal fees incurred by the Village of Plainfield as a result of said vacation have been paid by the applicants. 2. That the owners of Lots 15 and 16 are responsible for landscape maintenance until such time as the stub road is constructed. 3. That the drive on Lot 16 that extends beyond the house toward Hawthorne Circle be removed and that the drive connected to the stub road once the road is constructed. This provision shall be recorded against the property by the applicants prior to the issuance of a building permit: Section 4. The Village President and Village Clerk are hereby authorized to execute all documents necessary to effectuate the vacation herein contemplated. Section 5. If Part Invalid. The invalidity of any part or section hereof shall not effect the validity of the remainder hereof. Section 6. This Ordinance shall be numbered as Ordinance No. 1886 r- .
