AN ORDINANCE. RELATING ,TO. TRAFFIC AND ' REGULATING -THE USE OF
MUNICIPAL' PARKING FACILITIES -,FOR- VEHICLES' IN -THE CITY .'OF
RICHMOND; PRESCRIBING REGULATIONS RELATIVE TO THE PARKING;'OF.
VEHICLES`UPON SUCH -MUNICIPAL PARKING FACILITIES; PROVIDING
FOR THE INSTALLATION, OPE-RATION,:MAI'NTENANCE, SUPERVISION,
REGULATION AND CONTROL - OF THE. USE OF''PARKING METER ON .MUNICI-PAL
PARKING FACILITIES; DEFINING AND PROVIDING FOR THE ESTABLISH-
MENT OF PARKING METER ZONES UPON SUCH MUNICIPAL PARKING-
FACIL'ITIE'S; PROVIDING FOR THE PAYMENT THEREOF AND FOR THE
SUPPLY OF PARTS THEREOF (EXCLUSIVELY--FROM-THE RECEIPTS
OBTAINED FROM THE OPERATION -OF PARKI'NG.METERS); PROVIDING
FOR THE.ENFORCEMENT HEREOF''AND PROVIDING PENALTIES FOR THE
VIOLATION HEREOF.
WHEREAS, the free circulation of traffic of all kinds -
through -the streets of the City of Richmond is necessary to
the health, safety and general welfare of the public-, whether -
residing in said city or traveling'to, through or -from said
City; and
WHEREAS, the increased use by the public of motor
vehicles of all kinds has caused.serious traffic congestion
on the streets of said city -;.and the parking of motor,vehicles
on the :streets of said City has contributed to this congestion
to : such an I extent ' as' to interfere serously with the 'primary
use of such streets for the movement of traffic; and - -
WHEREAS., -such parking prevents the.free circulation
of traffic in, through, and from the City, impedes -rapid and
effective fighting of fires and the disposition of police
forces, and endangers the health, safety and. welfare of the
general public;.and
WHEREAS, the establishment, maintenance and operation-'
of sufficient' off-street parking facilities, properly located,
will promote the public safety, convenience -and welfare;
WHEREAS, it "is- the opinion of the -Common Council of
the City of Richmond, that -the best method -by which the.
above mentioned conditions may be 'remedied is by the 'establi'sh-
ment, construction, maintenance,' operation and regulation of -
municipal parking facilities.in.certain areas by providing
for the'use of mechanical -parking -time indicators in con
Junction therewith; by restricting parking in said area to
reasonable'intervals of time and by compelling the operator.'s
of vehicles who enjoy the use of parking space so designated
to .pay- a portion of the cost of' establishing and maintaining
the same;
NOW THEREFORE; BE IT'..ORDAINED,- BY THE, COMMON COUNCIL'
OF THE CITY 'OF RICHMOND:

Section 1. For the purpose of this Ordinance:
A The word 'ivehicle'l.shall mean any -device in, upon
or -by which any person or property.i's or may be transported
upon a highway, except such as'are'propelled exclusively by
human power.
(B) The word "municipal parking facility" shall mean
.,any space either on or off a public, -thoroughfare,- which is
municipally owned and operatedor leased for the purpose of
providing and regulating parking of vehicles, including legally
designated .space along any public' thoroughfare or any .legally
designated'area'easily-accessible from a public thoroughfare
either at ground -level or' multiple ,le -eels or -floors above. or
below ground, including equipment, entrances, exits,,fenceIs,
and all other accessories necessary or desirable for safety
and convenience in the off-street.'arking,o,f,vehicles.
(C) The word "person" , shall mean ,and `include• all
individual, firm, corporation-:, or, `co=partnership. -
(D) The .word, "operator" shall .meanand include every
Individual,.,, who, ,shal'l operate. a -.vehicle as - the-, owner -'thereof
'or as the -`agent.;";employ'ee ;orpermi.tee 'of the owner.
Section 2. I:n order 'to effect the purpose of -this
Ordinance expressed there is, her.eby, :e stabl:i`shed and fixed
certain real estate to- be' kn-own:"- as municipal 'parking facilities
in the City of Richmond described as follows, -to -wit:
(A)- Being a part of Lots No. 28 and 29 of the Original
Plat of the City- of Richmond, .Indiana -laid out by John Smith,
more particularly described as follows:
Beginning at the point of .inters,ection of the
easterly line of South 5th Street with the South line of South
"A" Street, as now constructed; thence east along the -south
line of said South "All Street, One Hundred' Twenty Nine (129)
Feet to a public alley, ten (10) fee-t An width; thence south-
wardly along, the west line ,of said. -Alley, Eighty Four and
Twelve Hundredths (84.12)'feet; thence west, parallel with
the south line of said -South "A'l ' Street, One. Hundred Twenty
Nine (129). fe-et,. to the easterly line of said South 5th Street;
thence northwardly'; along the easterly line of South 5th
Street, Eighty Four.and Twelve Hundredths (82.12) feet, to
the.place. of -beginning.
And' from time to .time hereafter as. traffic conditions.
require, or.such other_ land's as are designated by -Ordinance
of the Common Council for the. -location of such municipal off-
street parking facilities.
In any' of ' the said municipal parking facilities- or -any
parts or portions of said. separately designated- municipal off-'
street parking facilities, . the Board of Public Works ' and Safety

may cause parking meters to be installed at each space in
such municipal off-street parking facilities, in its dis-
cretion, available for parking of vehicle or vehicles, and
shall see that there shall be plainly indicated on each of
such meters the time limitation for parking. Such time
limitation shall be designated by appropriate notice posted
in proximity of said meters.
Section 3. It is further ordained by the Common
Council of the City of Richmond that the time limit for park-
ing in the municipal off-street parking facilities designated
in Section 2. of this Ordinance, and the charge made for the
use of each of such narking spaces, and the money to be
placed in the meter in eacbL particular parking space desig-
nated by the person using such narking space, in such municipal
off-street parking facilities shall be as follows:
(A) 6.hours, one quarter dollar coin of the United
States.
Section 4. The Board of Public Works and Safety is
hereby directed to provide for the installation, regulation,
control, operation and the use of parking meters provided for
in this Ordinance, and to maintain said meters in good, work-
ing condition, and the Board of Public Works and Safety is
hereby vested with power end authority to enter into a
contract after approval of the terms and.condition thereof
by the Mayor of the City of Richmond, Indiana, for the pur-
chase and/or installation of parking meters. The paymentfor
such meters and/or installation is to be provided for solely
from the receipts, funds and revenues obtained from the
operation of said parking meters without in any manner.
obligating the City to pay for the same. from any source. And
the Board of Public Works and.Safe.ty is further authorized and
empowered to enter into a contract or.contracts after approval
of the terms and conditions thereof'by the Mayor of the City
of Richmond, for such protection and -maintenance of said park-
ing meters as may, be necessary.to maintain.the.same in good
operating condition and to pay 'for such parts; protection and
maintenance, exclusively from the receipts; funds:and revenues
received from the operation of said parking meters.
Section 5. Parking meters installed in the.municipal
off-street parking facilities established, as provided in
Section 2. hereof, shall be placed immediately adjacent to
the individual narking places hereinafter described. Each
parking meter shall be placed or set in such a manner as to
show or display by a signal that the parking space adjacent
to such meter is.or is not legally in use. Each parking
meter shall indicate by proper legend the legal parking time
established by the City, and when operated shall indicate by
some appropriate device the duration of the period of legal
parking, and on the expiration of such period, shall indicate
illegal over -parking.

Section 6. The Board of Public Works and Safety shall
have lines or markings painted or placed adjacent to each -park-
ing meter for the purpose of designating the parking space for
which said meter is to be used and each vehicle parked adjacent
or next to any parking meter shall park within the lines or
markings'so established. It shall be unlawful and'a violation
of this Ordinance to park any vehicle across any such line or
marking, or to park said vehicle in such position that the
same shall not be entirely within the area so designated by
such ones or markings.
Section 7. When a vehicle shall be parked in any space
adjacent to which a parking meter is located in accordance
with the provision of this Ordinance, the operator• of said
vehicle shall, upon entering the same barking space, immedi-
ately deposit or cause to be deposited a coin of the United
States in such parking meter, and failure to. -,deposit such
coin shall constitute a breach of this Ordinance and shall
subject such person to the penalty provided for in Section
13 hereof. Upon the deposit of such coin'and placing said
meter in operation, the parking space may be lawfully occupied
by the vehicle during the period of parking time which has-been
prescribed .for. the part of the -municipal off-street 'parking
facilities .in Which- said.,parkingspace is .located. -If said
vehicle shall.rema.in parked in any such parking space beyond
the parking time limit for such parking space, the parking
meter shall by its dial and pointer indicate such illegal
parking, and.in the ev.ent., such vehicle shall, be considered
as parked over time and beyond the period of legal parking
time, and the parking of such a vehicle overtime or beyond
the period of legal parking time in any such part of.a municipal
d'
off-street parking facility where any such meter is located
shall be violation of this Ordinance and punished as hereafter
set out.
Section 8. It shall be unlawful and a violation of
the provisions of this Ordinance for any person to cause,
allow, permit or suffer any vehicle registered in the name of,
or operated by such person, to be parked overtime, or beyond -
the period of legal parking time established. for any municipal
off-street parking facility as herein described, at any time,
except on Sundays and/or legal holidays when it shall be a
violation;.
Section 9. It shall be unlawful and a violation of
the provisions of this Ordinance for any person to -permit a
vehicle to remain in any parking space adjacent to any parking
meter while said meter is displaying a signal indicating that
the vehicle occupying such parking space has already been
parked beyond the period of time prescribed. for such --parking
space.
Section 10. It shall be unlawful and a violation of
the provisions of this Ordinance to deposit or cause to be
deposit in any parking meter any slug, device or.metalic
substitute, or any other substitute, for a coin of the United
States.

Section 11. It shall be unlawful and a violation of
the provisions of this Ordinance for any person to deface,
injure, tamper with, open or wilfully break, destroy, or
impair the usefulness of any parking meter installed under the
provisions of this Ordinance.
Section 12. It shall be the duty of the police officers
of the City of Richmond acting in accordance with instructions
issued by the Board of Public Works and Safety to report:
(a) The number of each parking meter which in-
dicated that the vehicle occupying the parking space adjacent
to such parking meter is or has been parked in violation
of any of the rovisions of this Ordinance.
(b� - The State license number of such vehicle.
(c) The.length of time during which.'such vehicle
is parked in violation of any of.the provisions of this
Ordinance.
(d) Any other facts, a knowledge of which is
necessary to a thorough understanding of the circumstanees
attending such violation.
Each such police officer shall also attach
to such vehicle a notice to the owner or operator thereof
that such vehicle has been parked in violation of a pro-
vision of this Ordinance and instructing such owner or operator
to report at the office of the City Clerk of the Oity of
Richmond in regard to such violation. Each such owner or
operator may, within forty-eight (48) hours of the time when
such notice was attached to such -vehicle, pay to the City
Clerk as a penalty for and in full satisfaction of such
violation, the sum of ONE DOLLAR, The failure of such
owner or operator to make such payment within said forty-
eight (48) hours shall render such owner or operator subject
to the penalties hereinafter provided. for violation of the
provisions of this Ordinance.
Section 13. Any person who shall violate any of the
provisions of this Ordinance, and any person who aids, abets
or assist therein, shall, upon conviction thereof, be sub-
ect to a fine of any amount, not exceeding Fifty Dollars
$50.00) for each offense or violation, or be imprisioned for
a term not exceeding fifteen days in the county jail, or
in any place provided by the municipality for the detention
of prisoners, or both.
Section 14. The coin and/or license fees required
to be deposited in parking meters as provided herein, when
collected from such parking meters, shall be deposited with
the City Treasurer to the credit of the City, in a special
fund, which said special fund shall be disbursed and paid out
only under the orders and directions of the Board of Public
Works and Safety of the City and for the following purposes
only:
(a) For the acquisition and preparation of
lands for parking facilities, the construction and recon-
struction of parking facilities.
(b) The purchase and installation of such
mechanical devices as are necessary to effect the collection
of charges for the use of legally approved parking facilities
