HomeMy Public PortalAboutResolution 11-22 Election Canvass RESOLUTION NO. 11-22 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF McCALL, VALLEY COUNTY, IDAHO, CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE MUNICIPAL ELECTION HELD ON NOVEMBER 8, 2011, FOR THE PURPOSE OF FILLING FOUR YEAR TERMS FOR TWO OPEN CITY COUNCIL SEATS FROM THREE CANDIDATES: JACKIE TURNIPSEED-AYMON, BALLARD SMITH OR NICOLAS SWANSON; AND FOR THE PURPOSE OF FILLING A TWO YEAR TERM FOR ONE OPEN CITY COUNCIL SEAT FROM TWO CANDIDATES: DONALD BAILEY, OR ROBERT LYONS, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a municipal election was duly held on November 8, 2011, for the purpose of filling four year terms for two open City Council seats from three candidates for the City of McCall; and for the purpose of filling a two year term for one open City Council seat from two candidates for the City of McCall; and WHEREAS, the judges and clerks of the election have conducted the election and made their return in the manner provided by law; and WHEREAS, the City Council now desires to ratify the County's canvass of the votes and to declare the results of the election. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF McCALL, VALLEY COUNTY, IDAHO, as follows: Section 1: ELECTION The municipal election of November 8, 2011, was duly and regularly called, noticed, held, and conducted, the votes cast, received and canvassed, and the returns thereof made in the time, form, and manner required by law and by the ordinances, resolutions, and proceedings taken by the City. Section 2: NOTICE OF ELECTION Notice of the municipal election was duly and legally given prior to said election by the publication of appropriate notice in the official newspaper of the City prior to the election, the first publication being not less than twelve (12) days prior to the election, followed by additional notice being published at not less than five (5) days prior to the date of the election. Section 3: POLLS The polls of the municipal election were opened at 8:00 o'clock A.M. on November 8, 2011, and remained open continuously until closed at the hour of 8:00 o'clock P.M., at the polling place designated by the County Clerk. Section 4: QUALIFIED ELECTORS Only persons who were, on November 8, 2011, qualified electors of the City, within the meaning of Article 6, Section 2, Idaho Constitution, and Section 50-413, Idaho Code, eighteen (18) years of age or older, citizens of the United States and of the State of Idaho and Page 1 of 4 Resolution 11-22 Election Canvass November 17,2011 who had been bona fide residents of the City for at least thirty (30) days preceding the election, duly registered to vote therein, were permitted to vote at the municipal election, and no person qualified to vote at said election was refused the right to vote. Section 5: BALLOTS The ballots used at the municipal election were in the form prescribed by law. A Sample Ballot was duly and legally printed twenty-nine (29) days prior to said election. A Sample Ballot was duly and legally published in the official newspaper of the City prior to the election, the first publication being not less than twelve (12) days prior to the election, followed by additional Sample Ballot being published at not less than five (5) days prior to the date of the election. Section 6: CANVASS After the polls were closed, the election officials immediately proceeded to count the ballots cast at the election. The counting continued without adjournment until completed and the result declared. The election judge and clerks thereupon certified the returns of the election to the County Clerk, who presented the results to the County Commissioners. The Council met following the election at the meeting place of the City Council, at High School Annex, 401 North Mission Street, McCall, Idaho, for the purpose of canvassing the results of the election. Thereupon, the results were entered in the minutes of the Council and proclaimed as final. The City Council has examined the returns of the municipal election and hereby canvasses the returns of the election. For a two year term for one open City Council seat: The total number of votes cast at said election for Donald Bailey: Total votes cast 475 For Donald Bailey 248 52.2% The total number of votes cast at said election for: Robert Lyons Total votes cast 475 For Robert Lyons 227 47.8% For the four year terms for two open City Council seats: The total number of votes cast at said election for Jackie Turnipseed-Aymon: Total votes cast: 888 For Jackie Turnipseed-Aymon 298 33.6% Page 2 of 4 Resolution 11-22 Election Canvass November 17,2011 The total number of votes cast at said election for Ballard Smith: Total votes cast 888 For Ballard Smith 201 22.6% The total number of votes cast at said election for Nicolas Swanson: Total votes cast 888 For Nicolas Swanson 389 43.8% Section 7: DECLARATION OF RESULTS Upon canvass, it is found that the results for two year term for one open City Council seat are: Donald Bailey Elected Robert Lyons Not Elected Upon canvass, it is found that the results for the four year terms for two open City Council seats are: Jackie Turnipseed-Aymon Elected Ballard Smith Not Elected Nicolas Swanson Elected In accordance with the provisions of Idaho State Law, said Donald Bailey is hereby declared to be Elected to the position of City Council Member in accordance with Idaho State Law. In accordance with the provisions of Idaho State Law, said Robert Lyons is hereby declared to be Not Elected to the position of City Council Member in accordance with Idaho State Law. In accordance with the provisions of Idaho State Law, said Jackie Turnipseed-Aymon is hereby declared to be Elected to the position of City Council Member in accordance with Idaho State Law. In accordance with the provisions of Idaho State Law, said Ballard Smith is hereby declared to be Not Elected to the position of City Council Member in accordance with Idaho State Law. In accordance with the provisions of Idaho State Law, said Nicolas Swanson is hereby declared to be Elected to the position of City Council Member in accordance with Idaho State Law. Page 3 of 4 Resolution 11-22 Election Canvass November 17,2011 Section 8: OFFICERS AUTHORIZED The officers of the City are hereby authorized and directed to take all action necessary or appropriate to effectuate the provisions of this Resolution. Section 9: RATIFICATION All actions heretofore taken, not inconsistent with the provisions of this Resolution, by the Mayor and Council directed toward the holding of the election called for herein, are hereby ratified, approved, and confirmed.
