Council members present were Mayor pro tem Doyle, Charlie Brewer, Barry Brown and Paul Wolff. Councilmen Eddie Crone and Dick Smith were absent due to illness. Also present were City Attorney Bubba Hughes, City Manager Diane Schleicher and Zoning Administrator Jonathan Lynn. Mayor Buelterman listed the following items on the Consent Agenda: City Council Minutes for 11/12/2009. Automatic Lease Renewal by the Tybee Island Marine Science Center per the Lease agreement dated December 11, 2008. Proposal for Coastal Engineering Services-RFP#2009-613-Olsen Associates, Inc. for an estimated cost of $38,500 budget line item #100-6125-54-1402. Budget Adjustment to replace totaled electrical truck with a street legal four-seater Mule style vehicle. Add $14,000 to expense account #100-4210-54-2200. Change order #3-Fort Screven Water Improvements-Over Runs and Under Runs of Line item Quantities-deduct $53,614-final project cost $1,156,784.00 budget line item #505-4410-54-2100 WWTP Effluent Line Extension-Contract with BRW Construction Company for $6,800. Price includes labor, equipment and material to install two wood piling with signage per plans furnished by HGBD. Budget Line #505-4310-54-1402. Change Order #2-14th Street Drainage Project-Moved Headwall away from Marsh Line. Budget adjustment: add $68,706.40 to account #100-4250-2102 and deduct %68,706.40 from contingency account #100-9000-61-1000. City has received a letter of permission from DNR. Contingency balance after this adjustment will be $8,082. Special Event Application-Critz Tybee Run 5K & Half Marathon-Saturday, February 6, 2010 8am. Applicant requesting Tybrisa Street Closure from 4am -12pm; portion of streets blocked for 5K start, front of lighthouse; strand parking lot used for post party; police detail. Special event beer wine license-Critz Tybee Run 5K & half marathon-Saturday February 6, 2010- 16th Street Parking lot Special Event Application-New Years Day Concert-January 1, 2010 12:30-6:30pm with live music beginning at 1:00pm. Applicant: Tybee Tourism Council requesting the city to waive the special event application fee of $100. Special event beer and wine license application- February 7, 2010-Memorial Park-Applicant: St. Michael’s Men’s club Request for waiver of alcohol beverage license-Jim Boyle American Legion. The vote was unanimous. A Motion by Councilman Brewer to end Executive Session was seconded by Mayor pro tem Doyle. The vote was unanimous. Mayor Buelterman called the regular meeting of the City Council to order at 7:00pm. Those present during the Consent Agenda were still in attendance. Consent Agenda: A Motion by Councilman Wolff to approve the Consent Agenda was seconded by Mayor pro tem Doyle. The vote was unanimous. Public Hearings: 1. Variance Request-For setback encroachment of external stairs(Sec 5-090) Address: 1-B Eleventh St. (aka 1101-B Strand), Zone R-2 Petitioner: Pioneer Construction for Graham Cooper, Planning Commission recommends approval (3-2). A Motion to approve by Mayor pro tem Doyle was seconded by Councilman Brewer. The vote was Doyle and Brewer in favor and Brown and Wolff opposed. Mayor Buelterman broke the tie in favor of the petition. 2. Site Plan Review-For new Single Family Residential (Sec 4-050 (E)(2)) Address: 8 Seventeenth St. Zone C-1, PIN 4-0008-06-035, Petitioner: Haywood Frye A Motion to approve by Councilman Brown was seconded by Councilman Wolff. The vote was unanimous. 3. Variance Request – For the expansion of a Single Family Non-conforming Use (Sec 3-020) Address: 1705 Chatham Avenue, Zone R-2, PIN 4-0010-05-002 Petitioner: Tybee Ventures, LLC. The vote was Doyle, Brewer and Brown in favor and Wolff opposed. City Managers Report-Diane Schleicher Adoption of 2010 Capital Improvement Plan. A Motion to approve with amendments was made by Councilman Wolff and seconded by Mayor pro tem Doyle. The vote was unanimous. Approval of Beer/Wine/Liquor, Sunday Sales and Entertainment License and Waiver of Alcohol fees for Tybee Supper Club, Michael Scarbrough-35 Meddin Dr. and American Legion Post 154 George Walker-10 Veterans Dr. A Motion by Councilman Brown to approve was seconded by Councilman Wolff. The vote was unanimous. Northbeach Grill Alcohol License for Beer/Wine/Liquor, Sunday Sales and Entertainment: George Spriggs, Jr. 41 A Meddin Dr. A Motion by Councilman Brown to approve contingent on them coming into compliance was seconded by Mayor pro tem Doyle. The vote was unanimous. Tybee Times Alcohol License with Sunday Sales Steven Kellam/1603 Strand Ave. A Motion by Councilman Brown to approve contingent on Sunday Sales Affidavit being filed, was seconded by Councilman Wolff. The vote was unanimous. Adjournment: A Motion by Councilman Wolff to adjourn was seconded by Councilman Brown. The vote was unanimous.
