AN ORDINANCE VACATING A CERTAIN ALLEY
WITHIN THE CITY OF IONA, IDAHO; PARTICULARLY
DESCRIBING THE SAID ALLEY; AUTHORIZING AND
DIRECTING THE MAYOR AND CITY CLERK TO
EXECUTE AND DELIVER ON BEHALF OF THE CITY A
QUITCLAIM DEED CONVEYING A PORTION OF THE
VACATED ALLEY TO THE OWNER OF THE ADJACENT
LAND; PROVIDING FOR EFFECTIVE DATE OF
ORDINANCE.

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY
OF IDAHO FALLS, IDAHO THAT:
Section 1. Vacation of Alley. A portion of a public alley located adjacent to Lot
1, Block 5, according to the original plat of the Denning Addition, Iona, Bonneville County,
Idaho, is not used or needed for public purposes. This alley is particularly described in
Exhibit "A" attached hereto. Pursuant to the provisions of Idaho Code Sections 50-311 and
50-1325, as amended, this alley is hereby vacated in favor of the adjacent landowners named
in Section 2 of this Ordinance.
Section 2. Execution of Quitclaim Deed Authorized. The Mayor and City Clerk
are authorized and directed to execute and deliver a Quitclaim Deed conveying said vacated
alley to the following, namely:

Section 3. Effective Date. This Ordinance shall be in full force and effect from
and after its passage, execution and publication in the manner provided by law.

Beginning at the Southeast comer of Lot 1, Block 5, Denning Addition, recorded in the
Bonneville County, Idaho courthouse, as Instrument No. 318911 and running thence
S.00°14'20"E. 20.00 feet to the Northeast comer of Lot 4, Block 5 of said Denning
Addition; thence S.85°52'20"W. 319.50 feet along the north line of said Lot 4 extended to
the Northwest corner of Lot 3 of said Block 5; thence N.00°14'21 "W. 20.00 feet to the
Southwest comer of Lot 2 of said Block 5; thence N.85°52'20"E. 319.50 feet along the
south line of Lot 2 extended to the point of beginning.

less than the cost of other publication required by law, in particular,
publication in a local newspaper.
3. This Affidavit is made in pursuance of Idaho Code 60-109 A.
