AUTHORIZING A PROFESSIONAL ENGINEERING SERVICES CONTRACT WITH
CME ASSOCIATES, RE: NJDEP CONSTRUCTION DEWATERING PERMIT
NOE STREET DRAINAGE IMPROVEMENTS
WHEREAS, the Borough of Carteret is in need of specialized engineering services
connection with the NJDEP Construction Dewatering Permit for the Noe Street Drain
Improvements Project; and
WHEREAS, CAME Associates, 1460 Route 9 South, Howell, New Jersey 07731, possesses
requisite experience and expertise to provide said services; and
WHEREAS, CME Associates has submitted a proposal to provide said services at a total t
not to exceed $14,043.00; and
the Mayor and the Council have reviewed said proposal; and
the Chief Financial Officer has certified that funds are or will be available for said
, THEREFORE, BE IT RESOLVED by the Mayor and the Council of the Borough of
et, County of Middlesex, State of New Jersey, as follows:
1. The proposal from CME Associates for engineering services related to the NJDEP
Construction Dewatering Permit for the Noe Street Drainage Improvements
Project at a total cost not to exceed $14,043.00 is hereby approved.
2. This action is approved as an award of a professional services contract pursuant to
N.J.S.A 40A:11- 5(I)(a) in accordance with the Borough's Fair and Open Process
as authorized by law.
3. A copy of this Resolution be forwarded to the Borough's Purchasing Department
and CME Associates.

Dear Mayor Reiman:
CM Associates is pleased to submit for your consideration this Proposal for en gineering
'consulting services to obtain NJDEP permits associated with construction dewatering at the Noe
Street Drainage Improvements project,located in the Borough of Carteret, New Jersey (Site).
The project background, proposed scope of work, related schedule, and estimated costs to
complete the work are discussed below.
BACKGROUND
The Site is located at the southern end of a85 -acre tract, in the northeastern part of a 685 -acre
drainage area,within the Borough of Carteret(Borough), The Site is located within a tidal flood
hazard area, 100 -year flood hazard zone, and is prone to nuisance flooding after even moderate
rainfall events in the neighborhood. The increase in flood eventsis reportedly due to the Site's
low elevation, climate - related sea level rise and inadequate infrastructure, The area in the
vicinity of the Site is currently serviced with three 78" pipes and a tide gate.The Borough is
currently designing the drainage improvements and is planning to bid related construction work
in 2015 and complete part of the construction in the vicinity of the Site in 2016/2017.
CME understands that the drainage improvements in the vicinity of the Site include the
construction of a new detention basin, improvements to the collection system, install /improve the
pump station and a construct a larger main outfall. These construction activities require
dewatering.

NJDEP regulates both the diversion of groundwater and discharge of groundwater to surface
water associated with construction dewatering. Accordingly, pursuant to N.J.A.0 7:19 and
7:14A, a Water Allocation Permit and a Discharge Permit, respectively are required.
SCOPE OF WORK:
To assist the Borough in securing the required permits, CME proposes to complete the following
scope of work:
TASK 1: GROUNDWATER SAMPLING
Groundwater quality data associated with the planned dewatering activities has to be submitted
to the NJDEP as a part of the permit application. CME will collect up to six (6) groundwater
samples to characterize the quality of groundwater that will be pumped and discharged. The
g roundwater samples will be collected from temporary borings /w ells installed utilizin dir ect -
push drilling techniques. The temporary borings will be biased to areas suspected to contain the
greatest levels of contamination (e.g., areas known to contain historic fill, existing CEAs,
existing CKEs, existing Deed Notice areas, etc.) within the zone of influence associated with the
dewatering operations.
CME will complete the proposed scope of work, in accordance with the Technical Requirements
for Site Remediation (N.J.A.C. 7:26E) and NJDEP Field Sampling Procedures Manual, dated
August 2005. All the drilling work will be completed by a NJDEP licensed driller. The
groundwater samples collected will be submitted to a NJDEP certified laboratory for analyses.
Samples will be tracked utilizing standard chain -of- custody procedures. All the groundwater
samples will be analyzed for the TCL/TAL +30. Standard turnaround times for preliminary
results are assumed.
TASK 2: PERMITTING
Water Allocation Permit -B
It isour understanding thatthe more than 100,000 gallons of groundwater will be pumped during
the planned construction activities. Applicable regulations require that a NJDEP permit be
obtained for these activities. At least 30 -days before the construction dewatering activities start,

CME will prepare and submit the Short Term Water Use Permit -by -rule, Form BWA -003, to the
NJDEP Bureau of Water Allocation & Well Permitting,
The Short Term Water Use Permit -by -rule allows for diversion of 100,000 gallons of water per
day or more, only for a period of less than 31 days annually. If the dewatering activities exceed
30 -days a Water allocation Permit must be obtained,
CME will also assist the Borough with limited notification requirements associated with the
permit -by -rule. Specifically, CME will notify the local Health Department and well owners
within the estimated zone of influence associated with the construction dewatering activities.
General Permit to Manage Clean Groundwater:
If the above discussed sampling indicates that groundwater associated the construction
dewatering activities is "clean, "A Construction Dewatering General Permit (137) Request for
Authorization (RFA) Certification Form will be submitted to the NJDEP. The RFA form will be
submitted- 14 -days before the - construction dewatering activities - start. This will result in an
authorization for short term discharge of "clean" water to receiving waters (except waters
classified as FWI, FW2- Categoryl, Pinelands and certain Shellfish waters). "Clean," refers to
groundwater that meets thte limitations outlined in Appendix A ( "... accordance with the
remediation standards at N.J.A.C. 7.14A -12, Appendix B except for MTBE, which is in
accordance with N.J.A. C. 7:0 -1.14 et seq.... ') of the permit.
General Permit to Manage Impacted Groundwater:
If the groundwater sampling discussed in Task 1 indicates that groundwater is impacted, at
concentrations that exceed the limitations in Appendix A as referenced above, CME will prepare
a RFA for either a General Petroleum Product Clean-Up (13413) or General Groundwater
Remediation Clean-Up (BGR) permit. A 13413 permit will be obtained to manage groundwater
impacted with petroleum products. A BGR permit will be obtained to manage groundwater
impacted with non - petroleum products.
The sampling data will indicate the appropriate option. CME will prepare a RFA for the correct
General Surface Water Permit and any supplementary forms required by the NJDEP. This option
would require the completion of NJDEP Treatment Works Approval (TWA) Forms. It is
assumed that the contractor would submit these form and the associated costs have not been
included in this proposal.

SCHEDULE:
Upon issuance of Notice to Proceed by the Borough, CMEwill complete the groundwater
sampling and submit the required RFA within two (2)months of authorization.
COST:
The total cost estimate for completion of the proposed Scope of Services is $14,043. The budget
includes approximately $7,145 in subcontracted costs (e.g., equipment rentals, laboratory
analysis, Geoprobe, etc.).

The cost estimate contained in this proposal is CMS's best estimate of the effort required to
complete the work as outlined in the Scope of Work. Borough will be billed for the actual effort
expended to implement the proposed scope of work in accordance with the attached our hourly
billing rates and other expenses associated with the project. CME will not exceed the approved
budget without obtaining prior approval from the Borough.

LIMITATIONS
• More than six (6) groundwater samples may be required to characterize the groundwater
within the construction dewatering zone of influence. Costs associated with collecting
more than six (6) groundwater samples are not included in this proposal.
• This proposal does not include activities/cost associated with investigating any
complaints of interference, related reporting, repairing/replacing wells adversely affected
by the construction dewatering operations.
• Upon completion of the dewatering activities, a Short Tenn Water Use Report, Form
BWA -004, will be submitted to the NJDEP by others (e.g., contractor).
• It is assumed that others (e.g., contractor) will obtain the required Treatments Works
Approval (TWA).
