HomeMy Public PortalAboutOrdinance 1014x CHAPT~;R 8 ARTICLE 8 ARTICLE 8: VARIATIONS TO ZONING ORDINANCE NO. 674, GRANTED BY ACTION OF THE VILLAGE OF PLAINFIELD BOARD OF TRUSTEES Sec. $-10: Variation of Minimum Size of Plot Requirement for 400 Des Plaines Street WHEREAS, a public hearing was duly advertised and held on a proposed variation to the minimum size of plot requirement of said Chapter 8, Article 5, Section 6-10 (Ordinance #674) of said Village of Plainfield as hereinafter set forth, and WHEREAS, the Zoning Board of Appeals of the Village of Plain- field has heretofore filed a report of its acts and doings in the premises and its recommendation that the petition requesting a variance for the real estate hereinafter described from the minimum size of plat requirement under said Chapter 8, Article 6, Section 6-~l through G-35, entitled "An Ordinance Requiring Permits far Buildings, Structures, and Uses, Dividing the Village into Districts, Specifying Minimum Lot Sizes, Set Backs, and Side Yards, Regulating the Bulk of Buildings, Providing for Appeals and Imposing Penalties", be granted, and WHEREAS, we believe that the minimum size of plot require- ment of said Chapter 8, Article 6, Section 6.10 places an undue hardship upon the owner of said real estate, and WHEREAS, no written objections to the granting of said variance for said premises were filed and no one appeared in person to object to the granting of said variance for said real estate, and WHEREAS, a final plat must be submitted for review and consideration by the Plan Commission and the President and Board of Trustees of the Village of Plainfield prior to subdiv- ision of the property hereinafter described, and WHEREAS, it is the opinion of the President and Board of Trustees of the Village of Plainfield that the petition requesting a variance from the minimum size of plot requirement of said Chapter 8, Article 6, Section 6-10 for the real estate hereinafter des- '' cribed should be granted. NOW, THEREFORE, BE IT ORDAINED BY TFiE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF FLAINFIELD, AS FOLLOWS: Y .,~ Sec. 8-10-1: Territory Described. That the following tract of land, to wit: ~~ The South half of Lots 1 and 2, in Block 3, in Shreffler's Addition to Plainfield, according to the plat thereof recorded June 20, 1851 in Book 5, Page 13 as Document No. 11684, in Will County, 111inois, Commonly known as 400 Des Plaines Street. which said tract of land is now subject to the minimum size of plot requirements as established in Section 6-10 of said Chapter 8, Article 6 (Ordinance #674} of the Village of Plainfield, be and the same is hereby exempted from the re- quirement that the minimum size of a plot shall be 8,500 square feet in area, and the same is hereby granted a variance to said minimum size of plot requirement and is hereby permittedinstead a minimum .size of 5,840 square feet for each of two lots thereon. Sec. 8-10-2: If Part Invalid. The invalidity of any part or section hereof shall not. effect the validity of the re- mainder hereof.
