(g) . VITAMIN .FORTIFIED MILK*. Vitamin fortified milk is milk, the vitamin content of which has been increased by a,method and in an amount approved by the Indiana` State Board -of Health.. (h) CREAM, SWEET CREAM. Cream, sweet cream is that.portion of milk, -rich in milk fat, which rises to the surface of milk on standing or is separated from it by. centrifugal, force. It is fresh and clean, and, j. contains not less., than'..:18 percent of milk -fat and not more than 0.2 J percent of acid -reacting, substances,, calculated in terms of lactic.. acid. (i) WHIPPING CREAM. Whipping cream pis, cream which contains not less than 35 percent of milk rat. (j) SOUR` CREAM.' Sour cream is cream, the„ acidity of which 'is more than 0.2.perc,ent,, expressed as lactic acid" (k) SKIMMED,MILK. Skimmed `milk is , milk from which substantially all of the milk fat has . been. removed,. and has a s.pec ific ' gracvity at 66 degrees Fahrenheit from 1.032 to 1.037 inclusive. 3•,.' (m) BUTTERMILK. Buttermilk is the product, that remains -*hen fat, is removed from pasteurized milk or pasteurized cream', -•sweet or sour, : in :the process- :of-' churning :and �contai ns not .le-ss - than 8.5 per- cent of milk-solids-notfat.. (n) .CULTURED 'HJTTERMILK.' Cultured Buttermilk - is the product obtained by souring pasteurized skimmed, - or partially 'skimmed, milk by means of, a -suitable culture of bacteria and contains -not less, than 9.5 pereent..of milk-solids-not_fat. (o) COTTAGE- CHEESE. Cottage .cheese - is the produo t . obtained, by culturing, with or` without the, use of . an approved. coagulant, pasteuriz- ed skimmed or -approved skim milk powder from which , eubstantially all of :the 'free whey has • been removed:: (p) CEREAL•MILK.. Cereal milk id milk which contains not less than• S percent butter -fat. (q) MILK PRODUCTS. ,.Milk. products shall be. taken -to mean and in- clude chocolate milk, skimmed milk b:ever.ages homogenized milk;- viscoliz- ed milk, vIi.tamin fortified milk, cream,. whipping::cream,., cereal milk, sour cream, skimmed, milk, goat milk, buttermilk;-cultured•buttermilk _ and cottage chees, as def fined-• herein.., _ (r); PERSON.,- -The 'word. (s) DAIRY FARM. -A dairy farm is any, place. �-or,premise:where one or more -'.cows are kept and a part or all- of the milk or milk products are sold or offered..for sale. (t) MILK PLANT. ..A- milk plant i:s'• . any place, premise' or • establtish- ment where milk or milk. -products are received Por,processing, or are. processed,' pasteurized, -bottled and/or prepared for distribution. (u) ADULTERATED MILK AND IJIILK PRODUCTS. --Any milk••or milk products -defined, 'in this .Ord.inance.-which does not,• conform • to the,, defini- tions, .standards or ;requirements as � set forth herein or- if. sold under another -name.,, or- if' made:;.to -appear ;be_tter than it is, or ' if : misre presented, shall'be deemed'to be adulterated and misbranded.. 40 ; DAIRY FARM STANDARDS SECTION 3: Milk - and milk products producefor, or to be sold d in the -City of Rehmond,'shall be produced.'on dairy 'farms that con -- form to the following standards or requirements, and no person shall, sell, expose or offer -for sale, any milk or milk.products which have not been produced and handled' in -aecorda.bbe with the following requirements: (a) HEALTH OF. ANIMALS (1) TUBERCULOSIS.AND BRUCELLOSIS.- ..Milk shall come - from cows that 'are` located 'in herds under Federal"and'State .supervision for the eradication of tuberculosis. Within two years after .the adop- tion of this Ordinance, all 'cows. shall be free from Bang',s disease.' as shown by bloodserum tests fo.r ,agglutinins'. against; 'Brucella:.abor.tus made in a laboratory approved' by the .'City Milk :Inspector. All such cows shall. be..retested.at -least .every 12 months and all -reactors removed from the -herd. A :certif icate , identifying each :animal by ; number, and signed , by- the laboratory making the test, shall be ' evidence .of .the above test: (2) MASTITIS. When any recognized test or examination of a dairy herd indicates that any cows" are infected with mastitis; such cows shall- be excluded from ,;the milking heard and -their .milk or.. any products of such milk shall not be sold or offered "for sale.. (3) OTHER DISEASES.. Milk 'that is bloody, stringy or other- wise abnormal, or whioh' is produced from diseased cows,, .'qr. any products of such milk, • shall not be sold or offered for sale. (b) COWS -CLEANLINESS, -<MILKING:___ (1) Cleanliness. ; Cogs-shall..b.e kept ; clean." Flanks,: .bellies and tails of milking cows shall be`kept clipped;. also free from visible dirt at the time of :milking. After preparation and cleaning of cows, and ,before milking, udders and teats shall •be: washed, and then dried with bactericidal solutions of strength. approved-:by',the City: Milk Inspector. (`2) Milking. Cows shall 'be milked in a 'sanitary .manner. Wet -handed milking is hereby prohibited. (c)- PERSONNEL CLEANLINESS`. • Persons handling milk 'or milk- prod-ucts shall be clean about their. person and shall: ;we'ar. -clean outer gar- ments. Persons with' soiled hands, or upon' -which there are open sores, shall.. not, milk cows or handle -milk -or milk products:. Milkers. shall, wash their hands . thoroughly immediately before milking.' arid. following any interruption in. milking operation* dashing facilities shall: be' provided in a convenient location for -the washing of milkers' hands:. (d) COSY STABLES. (1).'Cow Stables:. ,Cow Stables or milking parlors shall be provided, in which all milking shall be -done, and such ",cow stables or milking parlors . shall have. at least, 400 'cubic feet of -air, space* per animal. (2) Floor6 and Gutters, Cleanliness.: • Floors.,,and gutters shall beprovided and, shall be-•con'struot.ed of concrete. Barns . con- structed or remodeled after the effective "date of .this Ordinance .re- quiring new floors or gutters shall be provided with gutters having.a• .minimum depth of .eight inches as measured from edges of platforms. Where cows face out,, distances _of at' least 'eight feet ,shall, be' provided between platforms and where.cows face in, distances of -at. least six "feet shall, be provided from edges of ,platforms to back,walls. Floors.. shall be main- tained in good repair, `shall be ,f.re.e from cracks' and low spots and .shall be kept clean. Calves shall .not be tied in . milking parlors ;or• milking • . .M e 1 stables., Quarters housing swine, ehickens or other live. -stock. shall ,be separated from cow sts;bles or milkin • g,parlors.by tight partitions'. _ Feeding or' passing doors from adjacent sections of; _the barn shall be kept closed except when in use.. (3) WALLS,CEILINGS AND PARTITIONS-. Walls, ceilings and partitions shall be of, tightconstruction,..whitewashed .-once ,each year or painted 'white.'once. every two,years, and. 'shall. be; kept- clean. O Lighting. 'Uriobstru'c.ted .window areas' -of at _least 2j square f.eet,.per ,stanchion, shall be provided. Cow. stables. constructed after the effective date .of this; Ordinance, shall 'be provided with -at least four square feet of window 'areas per stanchion,. Adequate artificial lights shall be provided. (5). Ventilation.. Cow, stables shall be ventilated so., as to minimize. odors and condensation.., (e) BARNYARDS .AND MANURE DISPOSAL.. (1) , Barnyards: Barnyards- shall be properly graded and, kept clean. Cow -stable :doors and stock -watering tanks shall have approaches t 6. of at least six feet of concrete, clean gravel, or other suitable materials. Wastes from stables and milk rooms shall not be allowed - to accumulate in,barnyards. (2) Manure Disposal: Manure shall be removed and stored or disposed of in such, manner as will best prevent, the breeding of flies and all manure piles shall be protected .0"prevent cows from having access thereto. (f) TRAMP -SHEDS AND MILKING PARLORS'. (1) Tramp -Sheds. Tramp -sheds. shall . be - well . drained, have adequate -light and ventilation- and all;walls and ceilings.shall be kept clean. Such sheds shall be sufficiently bedded to keep cows clean. No animals except cattle shall be housed in Tramp -Sheds. (2) Milking Parlors,_ Milking parlors . are deemed to be places where cows are milked and, except for the feeding , of concentrates, shall be used. for milking purposes only.... Milking parlors .shall have im- pervious, properly drained floors.,' -,window" areas of at-leas.t four square feet per stanchion, adequate -light and ventilation, .and shall, at all times, be maintained in a clean and sanitary condition. Walls and ceil- ings of milking. parlors shall . be, cbvered with"tight, ' smooth, durable materials. (g) MILK HOUSES. (1) Milk Houses. Milk houses or milk rooms shall be pro- vided and such milk .houses and milk rooms., shall be used for- cooling; handling and storing 'milk and milk products, for cleaning, bactericidal treatment and storing of equipment and shall not'be used for any other purposes. Milk houses and milk -rooms .shall not have direct openings into toilets, stables -,'or rooms or quarters used for living. or domestic purposes. (2) Sizes. Milk'houses shall be of sufficient sizes to accommodate the installation of all equipment necessary to comply -with the provisions of this Ordinance. (3) Locations. Milk houses shall be located free from contaminating surroundings and, if connected to or with milking stables or milking parlors, shall,be separated by -'vestibules with self -closing doors. (4) Floors, Walls, Ceilings: Doors and Windows. Milk -house drain. Walls and -ceilings 'shall'be..c-onstructed so as 'to permit ease. of cleaning and shall: be- .painted or! finished in An ' approved. manner: Milk houses shall ' be well lighted. ,and ventilated _and shall have all openings effectively screened or'otherwise protected to prevent the en- trance of flies. All hinged doors shall open outward from the milk house. 'A single, door with 'combination'' doreen and glass. is'-aeceptable,. if it In self -closing. (5) Liquid 'Waste Disposal. ,Waste water from washing eon- tainers,, equipment _and utensils,, and water used for cooling milk and --milk products, ,shall be drained to prevent contamination of water supplies or accumulations -on- ground surface. (6) Cooling Equipment.:' Equipment for: properly cooling and storing',all milk ar4..milk products, handled shall' -'be provided in milk .houses. Cooling ,tanks :shall be constructed of concrete or other impervious materials and shall be '.of such capacities as will' -afford proper cooling and storing of all milk and milk products handled. Accurate thermometers for checking temperatures', of milk shall .:be provided,, (7) Utensil Racks.' Utensil,'racks,, made of metal or. other suitable . materials acceptable by the- City 'Milk Inspector, wood excluded, shall be provided. -within milk'houses''upon'which cleaned -containers, equip- ment, utensils and milking machines shall be stored when not in use. (�) Cleanliness.' Milk'house.s and. immediate surroundings shall be. kept clean and '.free from objectionable- odors, trash and filth. (h) WASHING FACILITIES., (l) , Water=heating Devices; Suitable, facilities- for. heat- ing adequate amounts of. water shall be provided.. Kerosene:heaters.pro- hibited. (2) Wash . Vats. Suitable --double vats' shall be.,.provided f or washing and bactericidal -treatment.,'' and- must be 'large enough 'to hold the largest utensil used. M COO�LING. 'Milk to- be .delivered ' to milkplants. or receiving station's shall be cooled to a temperature of 60 degrees Fahrenheit or - lower immediately, after milking and, -shall be maintained- at. such tempera- tures until delivered." (j) CONTAINERS.: EQUIPMENT AND U-TENSILS • (1)­Construatlon: ;,Containers,, equipment: and, utensils used in the handling, storing and, transporting of milk and milk'products shall 'be made of smooth,, non -absorbent materials, an d 'of such construction as to be easily' cleaned, with all,' joints -and seams finishedsmooth ..and flush. -and zhall,.•.be maintained, in.. good. repairmilking paihs shall .be of small -'mouth designs 'approved 'by the City milk Inspector. (2) . Cleaning .and Bactericidal Treatment* Containers, equip- ment and utensils used in handling, storing and transporting` milk and milk products `shall be thoroughly .cleaned with brushes,- hot _water and. dairy cleansers, immediately after each 'use. After cleaning. and immediately before re -using, all such. containers, 'equipment and .utensils shall'' be. sub- jected to, approved bactericidal' treatment: (3) Storage: Containers, equipment and utensils. Inc luftg milking- machines, . used in. the ' milking-,, handling, . storing -and transporting' of milk .and milk. products,: shall be stored in such a ,manner as to properly drain. anddry as quieklyras'p.os-sible to prevent their contamination., (k): TOILETS. Every dairy farm shall, be provided-with,one or more sanitary toilets 'conveniently aloeated and, properly construe, ted, operated and maintained, so,"that 'the. waste . is inaccessible to -,flies and does .not pollute the surf"see soil .or --contafiiinate any ' water supply. (1), rater' Supplies... Adequate and safe. water supplies for u'se in milk houses• and' milk rooms'' shall be provided . and' such " water , supplies shall meet ,the 'recommendations of, the Indiana State Board of *Health,; and tested. by. •the eaid Board --note less 'than, once each year. (1) Milk ' Stools • milk- stools 'shall -be, kept- ' clean; and ,stored off floors when not in.use. (m) RFJdOVAL OF MILK, STRAINING AND%bELI.VERY. ('1) Removal of. Milk. . milk shall be promptly ' removed after milking, to milk houses" or milk rooms, before straining. :_Milk shall not 'tie'- strained' in milking :stable ' or " milking parlor 'unless, us'ng , e'quipmnent approved by the..Iridi'ana 'State -Board of Health. (2). Straining.. milk .shall be strdned only through approved sing -le -service strainer pads. Unused strainer pads shall, be stored in a 9• dust-proot� container' so as —,"to' —be pro tected,>fr_,om':eontamination. (3). Delivery. Milk shall be delivered from dairy farms to milk plants and--redeiving stations_ within 24 hours after milking. (n), SAMPLING AND BACTERIOLOGICAL STANDARDS. (1) Sampling. Samples, of.. , raw milk from each and every dairy farm shall be taken. at the milk plants- at intervals of ,( not on the same. day) 'at least 'three times during every. ninety ,_days-, by ;the City Milk Inspector, which said samples , shall be , tested, for bacteriological standards as specified for dairy -farms in this -Ordinance. .. Examinations and testa may include such other chemical .:and physical determination as the City Milk Inspector may._deen necessary, for the detection of 'adulteration. If any sample is not up to..the standards as specified in -this Ordinance, the .City . Milk Inspector shall take another sample within the; next - three days, and if this -sample is not up. -to the. standards .as specified herein, the City Milk Inspector- shall,, with the consent of the Board of Health, revoke the Permit issued under this., Ordinance.* Inspections of the premises_ used for.the production and handl- ing of milk and milk products .on dairy -farms- as defined in this Ordinance shall be, made ,by .the _City Milk Inspector at least .once every ninety days. (2). Bacteriological Standards. -Milk, when delivered from 1 dairy farms .to milk.plants, or receiving stations shall have a'bacterial plate-eount of. not more than 300,000 per milliliter or a.direct micros - .topic count of not more, than .300,000 if ,:clumps are -counted,, .'or .'a direct microscopic count of not' -more, than' 1,000,000 per iilliliter'.if individual organisms are mounted,. or a, methylene .blue' reduction time -of not less than f our hours. - (o) COMMUNICABLE DISEASES. (1), Not`ification of Disease. Producers of . milk and milk 16 products upon whose farms any infectious,. contagious,.,, or oomsunicable human diseases occur.or exist,_shall promptly notify the City*Milk In - spec tor. (2), Procedure When Communicable Diseases are Suspected. Whenever suspicion, arises as to the possibility .or. ,probability.. of trans- mission of infections -from or by persons 'handling milk and .milk products,. the- City bilk Inspector is hereby authorized to require any - or all :of the 10. following: -(A). The' immediate exclusion of such persons'.from.milk- handl- ing; (B) The `.immediate exclusion from salve of milk .supplies, involved; and (0) Adequate; medical and bacteriological examinations, of such persons, there associates, and/or their body discharges.'' (p) COMPLIANCE.' Owners and operators-of.&-iry farms shall be allowed reasonable -periods of time, not-.t.o be extended -after JANUARY 1. 1�50 ,within which to .00mply,w(ith standards ',not previously.. required for such dairy farms. MILK PLANT. STANDARDS Section 4.. Milk plants shall be provided which, conform, to the' following standards and requirements,and.no person -,shall eell,.expose, or offer for sale .any milk or milk products which have .,not been received, . handled, and -processed in -milk plants constructed,, maintained and operated in accordance' with the' following .standards and �regizirementst (a) MILK PLANTS. Milk plants,- asdefined herein, shall be provided with separate rooms for. (1),Re'ceiving and, washing; (2) Processing, cooling and bottling; ;afd *(3) Storing milk,and milk -products. 'Washing, except that of equipment used in processing rooms., shall•:not be .permitted in processing. rooms. -Doors .shall. be-. provided for:= openings into and between-, rooms and ' such doors - shall,,, -be kept closed,.wheh not in use. Milk plant opera- tions shall be located:,.. -to. best prevent.=.aontamina:ti on, of milk. and equipment. (b) FLOORS. Floors, . includi ng .platforms and stairs of; rooms in . which milk And ---milk, products*,are'hand.led,, 'shall .be constructed of concrete or other :impervious material s,, shall be smooth, in 'good repair. and -'graded to adequately trapped. drains discharging- into sani.tary,.dra-ins . New -'floors shall have 'joints,between'walls and floors coved .at least` four, inches 'in height. (.c) WALLS AND CEILINGS. Walls . and ceilings of: milk, plants shall be constructed of impervious materials And,smooth surfaces, or shall.,be treated to provide impervious, smooth..surfaces. Milk plants constructed or remodeled. after, the effective date of .this Ordinance' shall .have,Aoints- between- walls, and floors coved at least four inches in height, and ..window sills set at not, less than 45 degree angles beginning at bases:. (d) LIGHT .AND VENTILATION.. Rooms ..shall be; -,well lighted, heated and ventilated to prevent'condensation.on walls and ceilings. (e) FLY CONTROL. Outside •openin's `shall be. adequately screened and/or other approved means employed -to effectively, control flies. (f) ROOMS. Roams in which milk, milk products, ,cleaned utensils and containers are handled'and stored, shall not have direct opening into toilets or living quarters. (g) C.LEANLINESS Milk Plants,. -including surroundings, shall be kept clean and free' from objectionable odors*,,... (h) EQUIPMENT INSTALLATION.' bilk plantsconstrueted or extensively re -modeled after the effective date of this Ordinance shall have major equipment .installed at least two,feet from walls and three feet from other equipment.. (1) 'Toll eta, Milk-, plants shall-- be provided with convenient-' ly located --sanitary toillets. Such''toilets• shall• be w.ell.,lighted and ventilat- ed and have impervious7noors, smooth, solid walls ' with joints between walls -and floors that 'are coved .at. least four• inches in height: .Toilets shall -be kept olean'and maintained so that wastes therefrom are not accessible to flies. and will, not pollute ground surface or contaminate water supplies. (i) HANDWASHING., ' Process ing rooms and toilet _rooms. -shall have approved .types of -hand-washing Paelli-ties installed in ,such rooms. -Hot and cold running water, soap, and individual towels , shall be supplied at each hand washbowl. Hands shall•not be'washed in vats used for cleaning equip- ment. _ (j) LOCKER ROOMS. Sanitary -locker rooms -shall, be provided in which employees shall be,required to change clothes. ; (k) . WATER SUPPLIES .AND. SEWERS* (1),.Water' Supply._=; .'Milk, plants'- shAl 1 have; water supplies that' are adequate 'and safe .an!d .sanitary. qualtties shall comply with the Indiana State Health' Department.. Oros s.connectaons'between private water supplies and, public. ,water, supplies shall- conform. -with the regulations of the City_Health Department covering such cross connections. (2), Sew Milk plants `shall have properly installed . ..'sewers .00nnected,.to a sewage- d spo.sal,%,system that,will adequately, care for all wastes -.without creating nuisances. (1) .EQUIPMENTS. :,Sanitary pipe. fittings :and equipment shall be con- structed ab as. to be easily ;cleaned. Each piece ofpasteurizing equipment shall be equipped,..with a.� self -recording theraom' eter'with :charts showing a 1-degree Fahrenheit graduation and a f m ratatx tine, du atioxo�.. 12. ..Charts shall be placed..in the recorder, before the pasteurization operation begins a rd left- there until the' pasteurization operation 'is completed and no chart shall be used for more. than one day,'s. operation. Milk and milk-,produc.ts, received, for pa-steurizing shall be,.000led, immediately in approved .equipment. to temperatures.of . 50 degrees- Fahrenheit or lower and :shall ,be maintained 'at such temperatures .until pasteurized,, except when ,such milk, and milk'_produets..are pasteurized within , two hours after being ,received. Milk and milk *products, after being pasteurized, if not immediately bottl-ed. 'or packaged, ' shall be promptly cool- ed to temperatures of 50'.de:grees Fahrenheit or lower. -and shall be stored at such temperatures. (2) Recontamination:. Pasteurized milk and pasteurized milk products shall not be permi-tted to contact.equipment.with which unpasteuriz- . eded milk products- have -been in contact, (3) Material 'Storage. Bottle, caps, cap stock, parchment. paper for -milk. cans .and single -service, contai ners '. shall be purchased sd kept in ,sanitary tubes and cartons and such tubes and cartons shall be stored in .clean, ' dry ,places... Paraffin, paste and other, materials used. for containers shall be, handled and stored in an approved sanitary -manner. (+).Testing. Milk Plants shall make.at least one per month such ,qualitytests 'of.'milk. and milk. products, as may be required .by the City Milk, �'In spec tor. .(5) . Bott` ling; Approved mechanical 'equipment shall be used for .bottling and .packaging milk and milk products -and suchbottling and packaging shall be done immediately after pasteurizing in milk plants where such milk and -milk products are pasteurized. (6).'Capping. Capping of.milk.an d milk products, container capacities of which are less than, one(1) gallon, shall be done by approv- ed mechanical equipment. Hand capping is prohibited. Cap, cover.cap, or hood shall cover the pouring lip to at least its largest diameter. Larger capacities shad have .clean parchment papers placed under cover. . _ (7) ,Overflow Milk. Milk and milk, products which have over- flowed, drained or leaked from equipment shall not be sold for human con- sumption. (o) PERSONNEL. (1) Health. Owners and operators of milk plants and establish- ments where milk and,milk products are handled shall employ only healthy persons and only healthy persons. shall work -in ­ milk .plants 'or such establish- ments. The City Milk Inspector shall require persons employed in such plants and establishments to submit to physical examinations by. .a...licensed physician, and such employee or person shall obtain from said physician, a certificate showing•that said person is or is not free from infections, diseases in communicable form, which said certificate shall be available for inspection by the City,Milk Inspector at all times, once each year, or.whenever the City Milk'.Inspector has reason to believe .that such employees have infectious diseases in communicable forms'orthat they.have been exposed to, or are carriers of, such diseases. Such persons found to have -infectious diseases in communicable„forma shall immediately discontinue working in milk plants or places where -milk and milk products are handled, and such persona shall not be permitted to resume work in such plants and establishments until -such employment is, approved by the City Milk, Inspector. (2) Cleanliness.. Persons. having contact .with milk,= milk, pro- ducts, containers or.equipment shall wear clean, washable outer garments, keep hands clean and wear head coverings. The use of tobacco in any form is prohibited in receiving and proe.essing rooms of milk plants. MILK HAULING AND�DELIVERY VEHICLES. Section,5. (a) HAULING VEHICLES. Milk hauling vehicles shad be -.provided for the hauling of. milk and milk products from ,dairy farms to milk plants and such vehicles shall comply with the -f ollowing AT)'Vehicles shall have completely. erielosed bodies. (2) . Bodies,, on veiiiches shall be .insulated on ceilings and sides at - least . one inch of c'elote'x or :its equivalent.,-. (4) Pas'senger,°cans 'shall not -`be -used to ,haul milk except when milk is placed in closed -trunk 'aompartment.. (5) Vehicles. shall _-be maintained In.' good'.repair and kept clean and sanitary,, and• such 'vehicles shall.,not be: used. to haul bulk fertilizer, garbage,;or any.offens ve materiala: (6) Owners.'or operators of such vehicles shall -abtain licenses _as -hereinafter required. (b.) DELIVERY VEHICLES.-' Milk delivery vehicles. shall be provided for --the delivery -,of . milk, or milk 'produots in final `containers, and such vehicles shall comply with 'the lolloiWing: (1)- .Such vehicles shall have permanenttops and permanent or movable sides: 'and backs., provided 'however' that" openings.' in sides and backs may be --provided,. to permit -the passage -of 'personnel for loading and unloading : purpos.ea. (2) Such vehicle`s shall be :maintained in %good, repair . and kept clean and_ sanitary and shall no.t be used .to haul any. offensive materials. (3) .Such vehiclesshall have the names of licensed milk plants whose products.are..delivered therein, permanently'di,splayed on the two outer aides: (4) _ Owners`: or operators: "of .such vehicles shall obtain .license's as hereinafter :required. CONTAINERS, STORAGE, : ETC: Section 6. (a) CONTAINERS:. milk -and milk produe'.ts shall be placed in final delivery -containers in milk plants where such'products'have been -sta.ndard- ized and pasteurized. • Milk, and milk products in­quantitles of less than -one ' (1) gallon shall be delivered 'in -'standard milk bottles of glass.,, paper or other. materials' approved by the City- Milk Inspector. Milk,, cream and chocolate milk shall be, sold" and served..in original 'conta Piers, provided 16. that cream `consumed on the'.premises' may be served from .the. dispensers approved for such service: (b) LABELING AND BRANDI`NG:, . Bottle:s, cans,- anal other containers, containing milk or milk products defined in - this Ordinance .shall be plainly labeled or marked with:. (1) Names of convents as defined in this Ordinance. (2) The;_word,"Pasteurized", together with the words "Homogen- ized", '"Chocolate Milk", "Vitamin,Fortified", ete.,-' in accordance with the contents thereof. (3) Names and addresses or telephone numbers of licensed milk plants processing and packaging such products for sale. O Labels ,on Vitamin Fortified milk ,stating the amounts of vitamins contained therein: (.5) :Per cent of butter fat. (c) DESIGNS -ON CAPS. -.Designs used on caps, cover caps, hoods, tags, or -'.containers shall first be submitted to, and approved by the City Milk Inspector. (d) CONTAINERS FROM . QU_ARENTINED PREMISES. Milk " or milk products and containers, therefor shall no.t-be delivered .to., or collected from,- resi- -deri es where communicable .diseases exist, except in compliance with rules and regulations established by the City Health Officer.. (e) CONTAINER -WASHING. Persons to .,whom milk .and milk products are delivered, shall -wash and rinse containers. therefor before returning such containers. Containers -used in handling, storing,'processing and .transport- ing milk and milk producta.• shall not . -be used for other -purposes. (f) RETAIL COOLING. Milk and milk products shall be stored and sold at temperatures-of•50 degrees Fahrenheit or lower; byany person, persons, firm, association,.or -corporation, which includes stores,, -hotels., soda fount- ains, restaurants and any other establishment or:organizations. (a) All sources of milk supply offered for sale for human consump- tion in the City of Richmond, Indiana, shall_ be approved by the City Milk Inspector. SALE PROM BI TED Section 10. (a) No person shall sell, expose, offer for•sale, deliver, or have in his possession with intent•to sell in the City of Richmond, Indiana, milk and milk products which are, or have been, produced, stored, handled, processed or transported in any unclean or unsanitary manner, or any manner not complying with the definitions, standards or requirements as set forth herein; or milk or milk products which have been watered or adulterated or misbranded, or which contain any preservatives or unhealthful ingredients, constituents or substances; or milk or milk products from cows that have been kept or stalled under unhealthful conditions; or milk or milk products which have been produced, processed, stored, handled or transported in viola- tion of the laws of the State of Indiana or.rules and regulations pertaining herein. (b) GOATS MILK. No person shall sell, offer for sale, deliver or have -in his possession with intent to sell in the City of Richmond, Indiana,. any milk or cream derived from milk produced by.'goats,'ewes,•or other animals which is'not produced, handled, stored, processed, transported and kept in accordance with the standards. for milk and cream as set forth in this Ordinance. (a) SALE OF PASTEURIZED MILK. No person shall sell, expose, offer for sale, -deliver, or have in'his possession with the intent to sell in the City of Richmond, Indiana, or its police jurisdiction, pasteurized milk which has not been standardized to contain at least 3.8 per cent butter fat. PERMITS., CERTIFICATES, AND LICENSES_ Section 11. (a) PERMITS. Owner or operator of a dal ry,farm, before shipping or resuming the shipment of milk or milk products -to the City of Richmond, Indiana,,shall first obtain permit therefor. Application for such permit, � t V 19. shall be made to the City Milk Inspector on forms provided by the City Milk Inspector and shall include information as may be required. The City Milk Inspector shall issue permit to said owner or operator of dairy farm when such owner or'operator has complied with the standards and requirements as set forth herein;. The City milk Inspector, with the consent of the Board of Health, shall revoke the said permit of any owner or operator of a dairy'farm'who violates any of the *rovisions of this Ordinance. Provided,.in an emergency, the duration thereof to be determined by the City Board of Health, the City.Milk Inspector shall have the right to grant any milk plant licensed under this Ordinance, temporary authority, to, purchase raw milk from sources outside the -dairy farms furnishing the normal supply of raw milk to said City, but all such milk so purchased,.during the period of emergency, shall be past- eurized within the limits specified in this Ordinance. (b) CERTIFICATES: Owner'or operator of milk plant, before ship- ment, selling, exposing, offering for sale or distribution of milk or milk products in the City of Richmond, Indiana., . any- owner or operator of vehicle, before using such vehicle to deliver.or haul milk or milk pro- ducts in the City of Richmond, -Indiana, shall make application for cer- tificate to the City Milk Inspector. Application for such certificate shall be made to the City Milk Inspector and shall include such infor mation as may be required. The.City Milk Inspector shall issue Such oer- tifloat6 to such owner or operator of milk plant and such.owner or op- erator of such delivery or hauling vehicle, when inspections or invest- igations indicate that such plant or delivery or hauling vehicle have complied with the standards and requirements as set forth herein. (c) LICENSES. No person' persons, firm, dealer, association or corporation shall engage in the prooessing,.bottling, distrbuting or selling (including stores, hotels, soda fountains, restaurants, and any other establishment or organization) of milk or milk products, in the City of Richmond, Indiana without first obtaining `a license therefor from "A the City Controller;.No person, persons, firm, dealer, association.or oorporation shall engage in hauling or delivering, as Aefined in Section Five (5) of this Ordinance, of milk' or milk products in the City of 20 . , -Richmond, Indiana without first having obtained a,,._Heebibe from -the -City Controller for each vehicle operated or used therefor. Before such license - ­ a certificate or licenses are -issued by the City Controller, applicant- shall furnish / from .the , City Milk Inspector approving . the issuance of such license .'or licenses, and when. iisued,,such, licensee., shall be conclusive evidence of ownership and shall not be sold, assigned'•or transferred. -All such liv- enses issued under this section shall expire .one year ,frosi..date of is- suance. The City -Controller shall revoke., at the request of the City Milk Inspector, with the consent of the Board,of Health, .such license .ensee violating; any of the provisions or.regulations of this Ordinance. Fees--for.such licenses shall be charged in the following amounts: For processor,,.bottler or distributor---=- .-------; 10.00 For each. delivery' and- hauling vehicle-----=-------- `1.00­ For--all,others-------------------- ----- 1.00 PENALTIES, . Section 12.., Any person, persons, firms, association or -corporation or organ- ization violating any of,the provisions. -'of -this Ordinance shall upon eon- . viction be, fined not more than $100.00, to which- may be added imprison- .ment in-the,Wayne County Jail for.,not less than 5 days nor more than 90 days. Each and every violation of. the -provisions of" this'- Ordinance shall constitute a separate offense. REPEALING CLAUSE Section 1.3..
