HomeMy Public PortalAboutOrdinance #148 TOWN OF FRASERJ//U ORDINANCE NO. j~__ AN ORDINANCE TO REZONE ALL LOTS IN BLOCK 4, TOWN OF FRASER, FROM "R-2 RESIDENTIAL (MEDIUM DENSITY)" TO "B BUSINESS" AND AMENDING THE OFFICIAL ZONING MAP ACCORDINGLY. WHEREAS, the owners of all lots in Block 4, Town of Fraser, requested all of said property to be rezoned to "B - Business"; and WHEREAS, said property is currently zoned as "R-2, Medium Density Residential"; and WHEREAS, a public hearing was held by both the Commission and the Board of Trustees of the TDwn of Fraser, to notice and of all other requirements of the Ordinances of of Fraser and Statutes of the State of Colorado; and Planning pursuant the Town WHEREAS, at the Board of Trustees hearings held on June 4, 1986 and July 2,1986, the Board heard and received evidence pre- sented by the applicant and others in favor of the rezoning; and heard and received evidence presented by persons opposed to the said rezoning application; and WHEREAS, the Planning Commission has made its recommenda- tion that the entire rezoning request be approved; and WHEREAS, the Board of Trustees hereby finds and determines as follows: 1. That applicants' written request for rezoning, from applicants, and Petition and copy of published notice, to adjoining property owners, and attached return receipts, the Town's file, are admitted into evidence; letters Notices all in 2. That all Ordinances Statutes of the State of Colorado have been complied with; and Resolutions relative to this of the Town and rezoning request 3. Business"; That Block 4 is contiguous to, property zoned "B 4. That there was no mistake or error, nor did the evi- dence presented by applicants indicate any mistake or error, in the existing zoning classification described above when initially zoned; 5. That such rezoning would not be contrary to the Fraser Community Plan (Master Plan); 6. That there have been changed circumstances regarding said Lots in Block 4 in that traffic has increased; residential uses for the property appear to be limited (although still allowed in "B - Business"); rezoning would encourage redevelopment; and there are more nightly rentals in the subject area. 7 . spot-zoning; To rezone Block 4 to "B Business" would not be a 8. That the property rezoning to "B - Business" is in the best interests of the public health, safety and general welfare of the citizens, residents and taxpayers of the Town of Fraser. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF FRASER, COLORADO, AS FOLLOWS: ýÿ Section 1: That the following property located in the Town of Fraser, Colorado, shall be and is hereby zoned from "R-2 - Medium Density Residential" to "B - Business": All Lots in Block 4, Town of Fraser Section 2: That the Official Zoning Map of the Town of Fraser shall be and hereby is amended by the rezoning described in Section 1 above. The Town Clerk is hereby directed to perform this amendment on the Map as soon as possible. DULY MOVED, SECONDED, ADOPTED AND ORDERED PUBLISHED THIS 2ND OF JULY, 1986.
