MICHAEL PEIRCE, Vice Chairman ZBA@Hopkintonma.gov MARGARET SHAW, Clerk Minutes of the Board of Appeals Minutes: March 13, 2019 Called to Order: 7:05 PM Town Hall, 2nd Floor Adjourned: 7:30 PM Members Present: Mark Hyman, Chairman; Michael Peirce, Vice Chairman; Michael DiMascio; Rory Warren; Peggy Shaw, Clerk; Jerry Tuite; Walter Garland Members Absent: John Savignano Others Present: Elaine Lazarus, Director of Land Use, Planning and Permitting Jerry Tuite stepped down as he is an abutter and sat in the audience. 7:05 PM Application for Special Permit 8 Price Street - Bianchi Members Sitting: Mr. Hyman, Mr. Peirce, Mr. Warren, Mr. DiMascio, Ms. Shaw Others Members: Mr. Garland Benet Bianchi – Applicant Patricia Bianchi – Applicant Thomas Nealon – Attorney Atty. Nealon stated the applicants bought the property about 18 months ago. He stated the lot is a single family wood structure occupied by the applicants. He stated the lot was created in 1952 and was never owned in common ownership. He stated when the home was built around 1955 the house was located to the front of the lot about 27 feet from Price Street. He stated the applicants are proposing an addition to the home. He stated the front stoop which is being proposed is going to move the non-conformity from 27 feet to 21.2 feet from the front. He stated a mudroom is proposed where the 3 season porch is which would move it closer to Price Street by 3.5 feet. He stated the requested relief is a special permit to allow the construction to go forward 6.5 feet for the stoop and the 3.5 feet for the left hand side. He stated there will be no new non-conformities. He stated the proposed will not be substantially more detrimental to the neighborhood than the existing. Mr. Garland asked if they have spoken to their neighbors. Atty. Nealon submitted two abutter letters which are both in favor of the proposed. Mr. DiMascio Board of Appeals March 13, 2019 Page 2 of 2 stated the homes on the other side of Price Street are significantly closer to the street than this one. Mr. Peirce asked if the new front area would be enclosed and Mr. Bianchi stated no. Mr. Hyman asked if there were any public comments. Jerry Tuite, 4 Price Street stated he supports the proposal. Marlo & Debbie Pohl, 7 Price Street stated they are in favor of anything the applicants want to do. Joe & Anne Roberts, 9 Price Street stated they support the applicants wholeheartedly. Mr. Peirce moved to close the public hearing. The motion was seconded by Mr. Warren and passed unanimously. Mr. Peirce moved to find the proposed change to the house will not be substantially more detrimental the neighborhood than the existing non-conformity and that Price Street is very unusual whereas the older houses are very close to the street. The motion was seconded by Mr. Warren and passed unanimously. Mr. Peirce moved to grant a special permit for 19 feet of front setback relief to allow the proposed porch and that it be consistent with the plans submitted. The motion was seconded by Mr. Warren and passed unanimously. Mr. Warren moved to close the public hearing. The motion was seconded by Mr. Peirce and passed unanimously. Documents Used: Uniform Application for Special Permit/Petition for Variance with supporting documents Mr. Warren moved to adjourn the meeting. The motion was seconded and passed unanimously.
