BACKGROUND: Over the past three years we have been having discussions with the County of San Mateo for a joint venture construction of a reservoir at the Coyote Point Municipal Golf Course. This would provide retention and distribution of reclaimed water from the San Mateo Sewage Treatment Plant for irrigation purposes. The reservoir would hold 500,000 gallons of water. This 20 -year agreement stipulates that the County would contribute $210,000 towards the construction of the reservoir and pay 1/3 of the City's total yearly cost (currently estimated at $24,000 per year) for maintenance of the water line from the Treatment Plant to the Golf Course. In return the County would be entitled to 250,000 gallons of reclaimed water per day at no cost to the County. DC:pk cc: DPW (2) City Attorney Chief Deputy JOAN HINCKLEY, CITY CLERK AGREEMENT BETWEEN THE CITY OF SAN MATEO AND THE COUNTY OF SAN MATEO FOR PROVISION OF TREATED WASTE WATER FOR IRRIGATION PURPOSES AT THE COYOTE POINT COUNTY RECREATIONAL AREA THIS AGREEMENT is made and entered into as of the 1st day of January, 1980, between the CITY OF SAN MATEO, hereinafter "City", and the COUNTY OF SAN MATEO, hereinafter "County". RECITAL S: 1. Expansion and improvement of City's water quality control plant, hereinafter "the WQCP", will make available approximately 5 million gallons per day of treated waste water generally usable for irrigation purposes. 2. City has constructed an outfall line, hereinafter "the line", to transport treated waste water from the WQCP to a reservoir, hereinaf-ter "the reservoir", to be constructed by City near the eighteenth green of its municipal golf course, which treated waste water, in an amount estimated at not more than 500,000 gallons per day, will be used by City for irrigation of said golf course. • • 3. County owns and operates, as a County facility, the Coyote Point County Recreational Area, which is located contiguous to City's aforementioned golf course, and which would benefit by the provision, for irrigation purposes, of treated waste water transported to the reservoir from City's WQCP. NOW, THEREFORE, it is mutually agreed by and between the parties hereto as follows: 1. PURPOSE. The purpose of this agreement is to provide for City to supply County with treated waste water from City's WQCP for irrigation of -County's Coyote Point County Ara facility, si:ch pro.lisio,n of tr:a.at�d last'' i!1 i:t.. !1�!_r:1C�c. CITY TO SUPPLY TREATED WASTE WATER TO COUNTY. City shall, subject to availability of treated waste water and for the term of this agreement, permit County to withdraw from the reservoir as much as 250,000 gallons of treated waste water per day at no cost to County except as expressly provided for in this agreement. P-CAd-40 1 0 w 3. COUNTY TO CONTRIBUTE TO CAPITAL, OPERATION AND MAINTENANCE COSTS OF PUMPS, LINE AND RESERVOIR. County shall contribute, upon City's award of contract for construction of the reservoir, $210,000 toward the cost of such construction. County shall, within 30 days of the end of each fiscal year (defined as July 1 through June 30), or portion thereof that this agreement remains in effect, contribute 1/3 of City's total yearly cost (currently estimated at $24,000 per year) of: a) labor for: i) pump operation, maintenance, repair and replacement ii) line maintenance and repair iii) laboratory analysis of waste water to be delivered to the reservoir iv) reservoir maintenance; b) Chemicals and energy required for any improvement of the quality of waste water delivered to thezreservoir beyond the minimum quality level described in item 7 of this agreement, but not beyond the quality level required for irrigation of parks and golf course hardy vegetation, if City, at its sole discretion, elects to effect such further improvement; c) Energy to .transport treated waste water to the reservoir; and d) Parts and unit replacements for pumps and line, including line control equipment. 4. OWNERSHIP OF FACILITIES. City shall be the sole owner of the line, reservoir and WQCP pumps. County shall install, own, operate and maintain at its own expense any facilities necessary to pump and transport waste water from the reservoir to the Coyote Point County Recreational Area and a meter to measure the waste. water it withdraws from the reservoir. City shall grant County an easement for installing, operating and maintaining such facilities. Any necessary installation, operation or maintenance of such County -owned tacilities shall be conducted so as to cause the least possible disruption of the operation of City's golf course and shall tully conform to all applicable laws and land use regulations. 6. COMMENCEMENT OF SERVICE. Following execution of this agreement, City shall, subject to funding availability, exercise due diligence in constructing the reservoir,. completing the presently -in -progress expansion and improvement of the WQCP, modifying sewer mains upstream of the WQCP, and commencing pumping of treated waste water to the reservoir. 7. QUALITY OF WATER PROVIDED. County expressly acknowledges and consents that: a) Although City shall, within the limits of economic feasibility, attempt to produce treated waste water suitable for irrigation of hardy vegetation, the quality of the treated waste water delivered to the reservoir may, at City's sole option, be controlled only by City's most efficient operation of the WQCP as perceived by City and by such governmental standards as presently are, or may in the future be, imposed on its waste water discharged into the San Francisco Bay; and b) Such limited quality control will not assure ▪ the suitability of the WQCP's treated waste water tor irrigation purposes or for any other purpose whatsoever. 8. INTERRUPTIONS IN PROVISION OF TREATED WASTE WATER. County expressly acknowledges and consents that City's provision of treated waste water as herein required is subject to the availability of such water at City's WQCP and that interruptions in the normal operation of the WQCP may necessarily result in the temporary non -availability of treated waste water at the reservoir, for which non -availability City shall not become liable to County in any way. 3 P-CAd-42 10. TERM. The term of this agreement shall, unless sooner terminated pursuant to Item 12 or Item 16, be 20 years. 11. PROVISION OF TREATED WASTE WATER AFTER THE TERM OF THIS AGREEMENT. At the end of the term of this agreement, County shall have a. ten year option to continue its withdrawal of treated waste water from the reservoir subject to all of the terns and conditions herein stated except that County shall not be required to make any further capital, operation or maintenance costs contribution to City but shall, in lieu thereof, pay City .for water withdrawn from the reservoir at a unit rate to be negotiated in good faith by the parties. Said option shall lapse and become null and void if not exercised within 60 days of the end of the term of this agreement or if County's purchase of treated waste water shall cease for a continuous period of one year. • • 12. LEGAL RESTRICTIONS ON USE OF TREATED WASTE WATER. In the event that use of treated waste water meeting the quality standards set out in Item 7 of this agreement shall be prohibited by law for irrigation of either the Coyote Point County Recreational Area or City's Municipal Golf Course, City's obligation to make treated waste water available to County shall terminate for so long as such prohibition shall remain effective, and City shall not become liable in any way to County for such termination. 13. MUTUAL INDEMNIFICATION. It is agreed that City shall defend, hold harmless and. indemnify County, its officers and employees from any and all claims for injuries or damages to persons and/or property which arise out of the terms and conditions of this agreement and which result from the negligent acts of omissions of City, its officers and/or employees. In the event of concurrent negligence of City, its officers and/or employees and County, its officers and/or employees, then the liability for any and all claims for injuries or damages to persons and/or property which arise out of the terms and conditions of this agreement shall be apportioned under the California theory -of comparative negligence as presently established or as may be hereafter modified. P-CAd-43 4 14. ACCOUNTING. City shall maintain complete records of its costs in operating and maintaining the line, pumps and reservoir and any facilities which, at City's solr2 discretion, may be employed to improve the quality of water delivered to the reservoir beyond that level described in item 7. County shall have the right at any reasonable tirne to inspect said records. County shall provide City with a monthly report of the quantity of waste water it withdraws from the reservoir. 15. NOTICE. All notices required or given pursuant to this agreement shall be deemed sufficiently given if in writing and it either personally served upon or mailed by first class mail, postage prepaid, to the Clerk of the governing body of either party. 16. TERMINATION. County may terminate this agreement and recover from City all monies paid hereunder immediately upon the occurrence of either of the following events: a) City's contractor tails to commence construction ot the reservoir within 12 months ot the award of contract therefor and such tailure is not the result of a legal or administrative proceeding brought by a person not a party to this agreement. b) City's contractor fails to complete construction of the reservoir within a reasonable time after the award of contract therefor, not to exceed two years, and such tailure is not the result ot a legal or administrative. proceeding brought by a person not a party to the agreement. In all other cases, County may terminate this agreement upon giving City 3 months notice, but shall not recover any monies paid to City prior to the effective date of such termination. 17. I have reviewed your request and plans submitted to this office. As a matter of review, the County of San Mateo Parks and Recreation Department has provided the City of San Mateo with the necessary land to run a drainage ditch which services the sub -divisions on the westerly side of the Bayshore whose water is diverted into the Parks and Re- creation Department land. This ditch runs the water to a drainage pond adjacent to the Animal Shelter Building. Your request is that we provide $5000.00 to help you to- ward fulfilling this project, mainly to erect a building for a pump. I feel that this department is unable to contribute money toward this project as the main drainage problem is that of the City of San Mateo. Actually, the County is taking care of their drainage water by granting an easement for a canal and drainage pond. I'do not have money budgeted for this project, and what money I do have in this year's budget will have to go for turfing and sprinkling systems. Actual- ly, we have a great deal of work to do with the funds bud- geted. I feel that this is a local problem and that you should take care of the expenses for the reasons mentioned above. Shaw intendent, Parks and reation Corimission House ood City, California Mr. Shaw: July 27, 1959 Re: Coyote Point Drainage Project In line with our past discussions of the proposed drainage project near the S.P.C.A. buildings in the Coyote Point area, we have prepared the enclosed drawing. This drawing provides for a pumping station using creosoted tinter piles and redwood sheathing. The pump house will be constructed large enough to accommodate two pumps. However, we plan to install only one at this time. Recent quotations on a pump with 10,000 gallons per minute capacity was $4500.00. To this must be added the cost of the drainage pipe and the electrical wiring. The second pump can be added at a later date when warranted by future development in the area, As you know, ve excavated the drainage channel last year at a cost of approximately $2000.00. We are prepared to proceed with this project immediately with City forces and rented equipment such as pile driver and truck crane upon your agreeing to pay $5000.00 towards the project. Originally we had planned for a concrete structure at a considerably greater cost. However, the timber structure should have an economic life of 15 to 20 years and it may be that future development in that area or for other reasons the pump would be relocated. Mr. Smith has presented a plan show- ing an area west of the S.P.C.A. building which outlines pro- posed drainage ditching to be installed to take care of the run- off waters that have been occurring in the City of San Mateo and a portion of the City of Burlingame and collecting on our property at Coyote Point. This proposal is attached under date of Aug- ust 29, 1958 which is relative to the development of a pumping station and channel excavations. The water drainage to this area has been going on for years. However, with the increased run-off the need for diverting the run-off water is becoming more acute. We are also having and will have more problems regarding the drainage in that area just east of the S.P.C.A. building which, as you know and is outlined in the Five Year Plan, is ready for grading this year. Mr. Smith has suggested inasmuch as his proposal and our problem is closely related that we work together toward alleviating the run-off waters which collect in this area. I have discussed .this with Don Wilson, and I am attaching a copy of his communi- cation. I am also enclosing a letter from Gene Howell pertin- ent to this arrangement. I feel that both Don Wilson and Gene Howell with myself that this should be a mutually developed pumping plant. Mr. Smith has mentioned that the total cost would be $25,000.00, $5000.00 of which is estimated for construction of the drainage ditch as indicated on the plan. He has recommended that each ,jurisdiction pay 50% of the cost. It is my recommendation that the County of San Mateo pay for the construction of the drain- age ditch as indicated on the map up to $5000.00, or the bal- ance of the county's contribution to be providing the property for this installation which, I feel, is a fair and equitable share for the county in this project. This is made up of a permanent pumping station at $20,000 and channel excavation and incidentals estimated to cost $5,000. Inasmuch as this. pro ject will be of benefit to the City and is necessary for the future development of the County property, it is recommended that each pay 50% of the costa.
