HomeMy Public PortalAboutOrdinance #149 TOWN OF FRASER ORDINANCE NO. _L~J- AN ORDINANCE TO ALLOW THE TOWN CLERK TO PLACE DELINQUENT WATER CHARGES ON THE COUNTY TAX ROLLS. to and WHEREAS, the Town has previously adopted provide for, among other things, the imposition charges for water related matters; and Ordinance No. 75 of certain fees WHEREAS, the Board of Trustees has discussed the delinquent water charges and the possibility of collecting said delinquent charges through the Grand County Treasurer by imposing said charges as part of the real estate tax billowed by those property owners creating the delinquent charges, or on whose p~operty the delinquent charges have been accrued. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF FRASER, COLORADO, AS FOLLOWS: Section 1. New Article. ------------------------ (I) A new article shall be added as follows: ARTICLE IS - DELINQUENT CHARGES PLACED ON TAX ROLLS. In addition to or as an alternative to the foregoing arti- cles for collection of unpaid water charges, and to the other remedies provided in this Ordinance, in the event any charges as provided in this Ordinance shall not be paid when due, which charges shall include service fees, tap fees, penalties, inter- est, attorneys' fees, among any other charges, the Town Clerk may certify such delinquent charges to the County Treasurer to be placed by the said Treasurer upon the tax rolls for the current year, to be collected in the same manner as other taxes are collected, ~7ith ten percent (10%) of the amount of such delinquency added thereto to defray the costs of collection; and all laws of the State of Colorado for the assessment and collec- tion of general taxes and the enforcement .of liens therefor, including the laws of the sale of property, delinquency taxes and redemption of the same, shall apply. The property to be assessed the delinquent charges shall be that real property which is being benefited by the water service provided by the Town of Fraser or contemplated to be provided by the Town, for which the particular water charges have not yet been paid. This certification and assessment may be made by the Town Clerk whenever any delinquent charges exist. ~~~!~~~_~~__~~~~~~~E~~~_~!_~~~!~~~~~ (1) Article IS of Ordinance No. 75 entitled "Other Water Sources", and all subsequent article numbers of the original Ordinance No. 75, shall be renumbered in order to allow the insertion of the above- described new article, wi thout the deletion of any existing article under said Ordinance No. 75 or any subsequent amending Ordinance. ~~~!~~~_2~__~~~~E~~~l~!y~ (1) If any part, section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordi- nance and the Town Board hereby declares it would have passed this Ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that anyone or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. ~~~!!~~_~~__~~f~~l~ (I) The repeal or the repeal and reenactment of any provision of the Code of the Town of Fraser, Colorado as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceeding as com- menced under or by virtue of the provision repealed or repealed and re-enacted. The repeal of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. ~~~!!~~_1~__g~~l!~~_~~i~!r_~~~_~~li~E~ (1) The Town Board hereby finds, determines and declares that this ordinance is necessary and proper for the health. safety, and welfare of the Town of Fraser and the inhabitants thereof. Section 6. Effective Date. (1) Upon signing hereof by the Mayor and Town Clerk, this Ordinance shall become effective thirty (30) days after the publication thereof. OF THE 1986.
